Amendment 001

Questions and Answers to RFP 89233122RNA000153

1. Is the inventory “already in storage” required to be produced from a Vendor’s domestic uranium recovery facility that is making the offer to NNSA?

NNSA does not require that the vendor offering the material has also produced the exact material being offered. However, offerors must have produced uranium at some point since January 1, 2009 and the uranium being offered must be domestically produced.

If no, is the “inventory already in storage” limited to U.S. origin or any other origin that does not have any peaceful-use or endues restrictions?

Yes, the uranium offered must be U.S. origin and free of any peaceful-use and end-use restrictions.

2. Does “already in inventory” mean inventory only in the Vendor’s account at the Honeywell Metropolis Works uranium conversion facility located in Metropolis, Illinois?

The material offered must be in the vendors account and physically located at the Honeywell Metropolis Works conversion facility no later than 14 days after award date.

3. Is there a specific date associated with the terms “inventory already in storage”?

Inventory in storage as of the RFP date?, Offer submission date? Award date? Delivery Date? Or any other specific date?

Metropolis Works conversion facility within 14 days after award date.

4. Will NNSA accept offers for less than 100,000 pounds U3O8?

No – vendors are required to propose at least 100k pounds. Reference Vol II “Offerors are required to proposed at least a minimum quantity of one hundred (100) thousand pounds and not more than a maximum of five hundred (500) thousand pounds. Offerors are required to propose in one hundred (100) thousand-pound increments.”

5. Does the uranium offered for sale need to have been actually produced at a US facility? Does it need to be US-origin?

The Statement of Work attachment specifies that the uranium should be “domestically produced,” so the uranium offered must be both produced at a U.S. facility and be classified as U.S.-origin. For the timing restriction, the uranium must have been produced by a vendor whose facility has operated at some point since January 1, 2009, but the material itself may have been produced earlier as long as the vendor meets the facility operating timeline requirement. The operating timeline requirement requires the vendor to have operated a domestic facility at some point since January 1, 2009. The vendor is not required to have operated a domestic facility on a continuous basis since January 1, 2009.

Amendment 001

6. Provide clarification as to the meaning of “inventory already in storage at the Honeywell Metropolis Works uranium conversion facility located in Metropolis, Illinois” as provided in Section

1.2 of the RFP’s Statement of Work. We understand that NNSA would like to purchase U.S.-produced U3O8 to be transferred to NNSA’s accounts by book transfer at the Metropolis facility from inventory at Metropolis. However, it is not clear whether this means the material must be at Metropolis at present, or whether it simply must be there by date of delivery (or some other date, like date of bid) under the contract so that it can be book transferred with no other transportation obligation to be incurred by NNSA.

Metropolis Works conversion facility within 14 days after award date.

7. We are in the process of determining whether we can meet all of the requirements of the RFP and submit a conforming bid, but would like to understand as soon as possible what NNSA intends by the language “already in storage”, i.e., whether “already” means “currently” or “as of the date of bid and/or delivery.” In other words, if a bidding party that could meet all other requirements had to physically transport (not swap) its U.S.-produced U3O8 to Metropolis at its own cost in time to bid and/or deliver on a successful award, would such movement of the uranium concentrates be permitted under the RFP so long as it was “already in inventory” at Metropolis by the time delivery was due under the contract?

The vendor may bid on this requirement as long as the vendor can have uranium in storage at the Honeywell Metropolis works conversion facility within 14 days after award date.
