About this file
This is an Invitation to Bid (ITB) issued by the City of Hagerstown Finance Department in Maryland for Whole Effluent Toxicity (WET) Testing and Toxic Chemical Testing (TCT) services required to comply with the city's NPDES permit. The City of Hagerstown Water Division seeks competitive bids from qualified laboratories certified in Maryland to perform comprehensive testing at the facility's Outfall 001A. The testing program consists of four sets of definitive annual chronic testing conducted during January or February of 2027, 2028, 2029, and 2030. The scope of work includes biomonitoring toxicity testing (Ceriodaphnia survival and reproduction tests and fathead minnow larval survival and growth tests), toxic chemical testing, study plan preparation, sample collection support, report preparation, quality control checks, and all analyses performed in accordance with 40 CFR Part 136 and MDE requirements. The bid submission deadline is August 25, 2026, at 2:00 p.m., with bids submitted electronically via Dropbox. No pre-bid meeting or bid bond is required. The contract term spans four years (2027–2030), with test results to be delivered within three weeks of sample collection and submitted to MDE within one month of completion.
The bid submittal forms require vendors to provide separate line-item pricing for WET testing costs and TCT testing costs for each of the four years, with optional pricing for Toxicity Reduction Evaluation (TRE) testing if required. Bidders must demonstrate qualifications by providing three references for similar work completed within the past four years and evidence of Maryland certification for wastewater sample analysis. The City reserves the right to award contracts individually or collectively, reject any or all proposals, and waive informalities. All bids remain binding for 90 calendar days. Insurance requirements include workers' compensation (statutory), comprehensive general liability ($1,000,000 each occurrence), and business automobile liability ($1,000,000 combined single limit). The City is exempt from Maryland sales tax (exemption number 30001292). If testing is subcontracted, the subcontractor must be certified in Maryland and approved by the City prior to commencement. Failure to comply with MDE or EPA standards will result in non-compliance of the City's NPDES permit, and any additional testing costs resulting from non-compliance shall be the responsibility of the contract laboratory.

The Laboratory shall be required to ensure all testing meets the requirements identified in the permit to include chain of custody, sample containers, sample preservation (when applicable), sample storage, sample hold time, methodology, method detection limits, etc.
The WET and TCT Testing will consist of both biomonitoring toxicity, and toxic chemical testing. The testing program must consist of four sets of definitive annual chronic testing. The testing events shall be conducted annually during January or February of each year of the first four years after MDE approval of the study plan.
The sampling will be conducted in 2027, 2028, 2029, and 2030. The comprehensive bid must include all costs associated with all testing/ sampling events which include but is not limited to: Study plans (Biomonitoring and Toxic Chemical Testing), sample containers, sampling supplies, shipping of all supplies, sampling instructions, any required preservatives, chain of custodies, sample pickup or shipping associated with collected samples, preparation of reports, delivery of reports within the stipulated 3 week period after sample collection, all required quality control checks, and all MDE required detection limits. The City’s laboratory staff will be responsible for the physical collection of grab and 24-hour flow-proportional composite samples.
All sample analysis must be performed in accordance with 40 CFR part 136 and must be performed by laboratories that are certified in the State of Maryland to analyze wastewater samples. The successful bidder must be able to meet MDE’s detections limits for the analytes requested in this bid. If any part of this testing is subcontracted to another laboratory, that laboratory must be certified in the State of Maryland for all analysis being performed for this bid. The City must give prior approval before any testing can be subcontracted. The scope of work is as follows:
Biomonitoring Toxicity Testing
1. The successful bidder shall submit to the City of Hagerstown, within 10 days of receiving confirmation of bid acceptance, a study plan to evaluate wastewater whole effluent toxicity (WET) and toxic chemical testing (TCT) at the City of Hagerstown’s Outfall 001A using the biomonitoring results. The study plan shall encompass a discussion of the following items:
i. Wastewater and production variability
ii. Sampling and sample handling
iii. Source and age of test organisms
iv. Source of dilution water
v. Testing procedures/experimental design
vi. Data analysis
vii. Quality assurance/ quality control
viii. Report preparation
ix. Testing schedule
2. The testing program shall consist of four sets of definitive annual chronic testing. The testing events shall be conducted annually during January or February of each year of the first four years after MDE approval of the study plan (2027, 2028, 2029, and 2030). This testing shall be initiated no later than
January or February immediately following MDE’s acceptance of the study plan. If the results from any of the required WET test suggest toxicity in the effluent, the City shall repeat the required WET test within 60 days as follow-up test. If toxicity is observed in the follow up test, the City shall be subjected to the requirement specified in Section 10 of the Biomonitoring Toxicity Testing below. Each annual testing event shall include the Ceriodaphnia survival and reproduction test and the fathead minnow larval survival and growth test.
3. The samples used for biomonitoring shall be collected at the same time and location as the samples analyzed for the effluent limitations and monitoring requirements for this outfall (Outfall 001A). The
City shall collect 24-hour flow-proportional composite samples unless the MDE and the City have given prior approval of an alternative sampling type.
4. The following EPA document discusses the appropriate methods: “Short-term Methods for Estimating the Chronic Toxicity of Effluents and Receiving Waters to Freshwater Organisms” Fourth Edition, EPA-821-R-02-013, October, 2002, unless a more recent version is required by MDE.
5. Test results shall be submitted to MDE within one month of completion of each set of tests. Test results must be reported to the City within 3 weeks of completion of each set of tests, along with the results of the concurrent toxic chemical test (TCT).
6. Test results shall be reported in accordance with MDE’s “Effluent Biotoxicity Testing Protocol for
Industrial and Municipal Effluents, Appendix E (Reporting Requirements for Effluent Biomonitoring
Data), as amended”, Which is available at the website link: https://mdewwp.page.link/Biomonitoring
7. As a minimum, the reported chronic results shall be expressed as NOEC, LOEC, ChV, and IC25, unless other endpoints are required by MDE.
8. If a 50% mortality or greater occurs in one or more effluent concentrations during the first 48-hours of the chronic tests, 48-hour LC50s shall be calculated and reported along with the chronic results.
9. If testing is not performed in accordance with the MDE-approved study plan, additional testing may be required by MDE. In the event the contract laboratory fails to perform the testing as defined in the approved testing plant, the cost of the additional required testing will be the responsibility of the contract laboratory.
10. If the test results of any two consecutive valid toxicity tests show acute or chronic toxicity (LC50 equal to or less than 100% for acute tests and an IC25 equal to or less than the in-stream waste concentration for chronic tests), the City shall repeat the test within 30 days to confirm the findings of acute or chronic toxicity. Intermittent toxicity or other concerns may require additional testing or limits. If acute and/or chronic toxicity is confirmed, the City shall:
https://mdewwp.page.link/Biomonitoring
a. Eliminate the source of toxicity through operational changes as soon as possible but in any case, not longer than within three months, or
b. Perform a TRE. If the City repeats the toxicity testing as stated above and the results of the repeat test do not confirm the acute or chronic toxicity, MDE will require the City to repeat the toxicity testing as stated above to reconfirm a finding of no acute or chronic toxicity. After reconfirmation, the City shall complete any remaining quarterly testing required.
11. If the City is required to complete a TRE in accordance with 10.b above, and unacceptable toxicity is confirmed, a Whole Effluent Toxicity (WET) permit limit and a compliance schedule will be required which shall become a discharge permit condition through a permit modification or through a permit renewal.
12. When a WET test result shows reasonable potential for toxicity, unless it can be demonstrated that the source of toxicity has been eliminated, inappropriate test procedures were utilized, or the source has been controlled via a chemical specific permit limitation, WET limits shall be required. These limits may be implemented by reopening the current permit or in a permit renewal. Where reasonable potential has been assumed based on one test result, the permit shall include a WET limit effective within three years unless the effluent shows no toxicity in six follow-up quarterly tests. The permit may be modified to remove the WET limit if the six follow-up quarterly tests show no toxicity.
13. If plant processes or operations change so that there is a significant change in the nature of the wastewater, MDE may require the City to conduct a new set of tests.
14. If a significant industrial user locates within the service area so that significant change in the nature of the wastewater might be anticipated, MDE may require the City to conduct a new set of tests.
Toxic Chemical Testing
1. Concurrently with the biomonitoring study plan, the successful bidder will submit to the City of
Hagerstown, within 30 days of receiving confirmation of bid acceptance, a study plan to perform the sets of analytical testing for toxic chemicals.
2. The toxic chemical testing study plan shall include a description of:
a. Sampling methods
b. Analytical methods
c. Practical detection levels
d. Quality control procedures
3. Concurrent with each biomonitoring toxicity test, the successful bidder shall perform analytical testing for the toxic chemicals identified in MDE’s “Toxic Pollutant Monitoring Protocol and
Reporting Requirements for Toxic Chemical Testing Analytical Data, as amended” which can be downloaded from the following website link: https://mdewwp.page.link/TCT .
https://mdewwp.page.link/TCT
4. Toxic chemical testing shall be performed in accordance with 40 CFR Part 136 and the MDE approved toxic chemical testing plan. Grab samples must be used for cyanide, phenols, and volatile organic compounds. All other pollutants shall be collected using 24-hour flow-proportional composite samples unless MDE has given prior approval of an alternative sampling type.
5. Substances other than those identified in Section 3 of the Toxic Chemical Testing above may be detected in the effluent. If so, the successful bidder shall identify and quantify the ten present in highest concentration for those compounds for which standards are available.
6. Results of each toxic chemical test performed as per Sections 3 and 4 of the Toxic Chemical Testing above shall be submitted to the City with results of the concurrent biomonitoring toxicity test.
7. Toxic chemical testing results shall be reported in accordance with MDE’s “Toxic Pollutant
Monitoring Protocol and Reporting Requirements for Toxic Chemical Testing Analytical Data, as amended”.
8. If testing is not performed in accordance with MDE’s approved study plan, additional testing will be required by the City at the successful bidder’s expense. Failure of the successful bidder to comply with all MDE/EPA standards will result in a non-compliance of the City of Hagerstown’s NPDES
Permit. A copy of the permit is attached.
