2. As part of its submission, Bidder must certify that it has not defaulted on any government contract in the last five years or must explain any such default in reasonable detail. The County may deem any such explanation of default insufficient if it does not include contact information for the government on whose contract Bidder defaulted.

3. As part of its submission, Bidder must certify that no government has terminated a contract with the Bidder for cause in the last five years or must explain any such termination for cause in reasonable detail.

The County may deem any such explanation of termination for cause insufficient if it does not include contact information for the government that terminated a contract with the Bidder for cause.

4. As part of its submission, Bidder must certify that neither it nor any of its officers, directors, partners, or owners is currently barred from bidding on contracts by any federal, state, or local government body. If Bidder cannot make such certification, Bidder must explain any ban in reasonable detail. The County may deem any such explanation insufficient if it does not include contact information for the public body that barred Bidder or Bidder’s officer, director, partner, or owner from bidding on any federal, state, or local government body’s contract.

5. If the Bidder fails to submit certifications or explanations in accordance with this section, the County may deem the Bid nonresponsive and reject it.

6. The Bidder must notify the County immediately if the Bidder discovers that its certification was erroneous when submitted or has become erroneous.

7. The fact that a Bidder defaulted on a government contract in the last five years; the fact that a government terminated a contract with the Bidder for cause in the past five years; or the fact that Bidder or any of its officers, directors, partners, or owners has been barred from bidding on contracts by any federal, state, or local government body will not necessarily result in the County deeming the Bidder nonresponsible.

8. If it is later determined that the Successful Bidder knowingly made a false certification, the County may terminate the resulting contract for cause without giving the Successful Bidder an opportunity to cure.

§ 4.2 Bid Security § 4.2.1 Each Bid shall be accompanied by bid security in the form of either a cashier's or certified check or an acceptable Bid Bond in the amount of five percent (5%) of the Bid amount, and made payable to the County of Henrico, Virginia. The bid security is a guarantee that if the Contract is awarded by the Owner to the Bidder, the Bidder shall enter into the Contract with the Owner for the Work described in the Bidding Documents or forfeit the bid security to the Owner, not as a penalty, but as liquidated damages. No forfeiture under a bid security shall exceed the lesser of (i) the difference between the Bid for which the bid security was written and the next low Bid of another Bidder, or (ii) the face amount of the bid security (Code of Virginia, Section 2.2-4336B).

1. Bid Bonds: If a Bidder is submitting a Bid Bond, it must upload to the Portal a PDF of the duly executed County of Henrico, Virginia Bid Bond, including a certified and current copy of the power of attorney for the attorney-in-fact who executed the Bid Bond on behalf of the surety. This is the only instance when a Bidder may submit a required element of the Bid package physically and separate from the remainder of the Bid package. All other portions of the Bidder’s Bid package must be submitted through the Portal. In addition, the Bidder must upload to the Portal a letter indicating that it deposited a cashier’s or certified check with all other required documents.

§ 4.2.2 All bonds shall be executed by a surety company selected by the Bidder which is legally authorized to do business in the Commonwealth of Virginia (Code of Virginia, Section 2.2-4337B), and the bond shall be the same in both form as well as substance as County of Henrico, Virginia Bid Bond. The Bidder shall require the attorney-in-fact, who executed the required bond on behalf of the surety company, to affix thereto a certified and current copy of the power of attorney.
