OFFEROR QUESTIONS
for Delivery Of 200,000lbs Virgin (Unused) 1,1,1,2 Tetrafluoroethane (R-134a)
Instructions. Q = Question / R = Government Response.
Q-01. Is billing after each delivery acceptable or is the Vendor expected to wait until the full duration of the contract (ending December 2026) to bill the 6 requested loads totaling 240,000 lbs.?
R-01. As written, the purchase order allows a Vendor to submit invoicing after the full completion of each CLIN delivery to LaRC. For example, once CLIN 001 has been fully delivered and accepted by LaRC (anticipated quantity of 80,000 lbs R-134a on or around 9/30/2024) the Vendor may submit invoicing against CLIN 001 to receive payment for the completed delivery.
(End Question 01)
Q-02. Will bids for less than the total requested volume be considered?
R-02. No. Please reference Attachment C – Terms and Conditions, NFS Provisions, 1852.214-72
FULL QUANTITIES. (DEC 1988).
(End Question 2)
Q-03. Can a clause be added for market-based price increase(s) in 2025 and 2026?
R-03. The Office of Procurement (OP) has decided not to include clauses for economic price adjustments. Offerors are encouraged to submit a comprehensive firm-fixed-price quote accounting for expected future forecasted prices based on knowledge of the industry and technical expertise.
For example, a percentage-based escalation in price for each delivery based on indexes or other generally accepted industry sources.
(End Question 3)
Q-04. As refrigerant is a commodity, refrigerant prices can fluctuate due to demands that don't change.
With Government phasing out and regulation changes, and pricing for 1 + years out, [it seems to us that] getting fair and reasonable pricing for refrigerant is all but impossible to lock in pricing.
Would a cost-plus pricing be acceptable?
R-04. The proposed work is commercial in nature. Submission of a cost-plus-price type contract quote is not acceptable for this procurement. Please refer to Q-03 above.

Q-05. Can you take all the refrigerant at once?
R-05. No. Delivery will only be accepted on or around the dates provided in the Statement of Work and within the specified quantity for each CLIN.
(End Question 5)
Q-06. Taking the EPA Phase Down of HFC refrigerants into account, will NASA Consider a lower GWP refrigerant for this project, such as R-513A?
a. [R-134a GWP = 1,430: R-513A GWP = 631]
R-06. No. Our equipment is currently designed to run with R-134a only.
(End Question 6)
Q-07. [Regarding Notice to SBA qualified Nonmanufacturers and Wholesale Suppliers]; There are only two producers of R134A in the US and neither of them would be classified as a small business concern under the NAICS.
R-07. An active SBA waiver has been identified that effectively waves the NMR requirement.
Therefore, the solicitation will be amended to apply the SBA waiver and remove the requirement.
(End Question 7)
Q-08. [The solicitation states] this product [is] required to be American made. Is this the case or can it be from an international source?
R-08. Offerors may choose to submit a quote for other than American made refrigerant. However, the restrictions of the Buy American statue apply to this solicitation. An offer for a foreign end-product may be contemplated if the contracting officer determines that the price of the lowest domestic offer is unreasonable. Reasonableness of cost will be determined in accordance with FAR 25.106(b)(1). Quotes will be evaluated in accordance with FAR 25.5 - Evaluating Foreign Offers- Supply Contracts.
(End Question 8)
