Does (c)(1)(i) prohibit the future participation in proposals/Concept Study Reports (CSRs) in any related solicitations, based on having participated in an evaluation for one solicitation (e.g., Discovery 2019 proposal, based on Discovery 2014 CSR evaluation)?
No, (c)(1)(i) does not prohibit future participation in related solicitations (e.g., Discovery 2019 proposal, based on Discovery 2014 CSR evaluation), as long as the solicitations are from separate solicitation cycles.
Does H.3 (c)(1)(ii) impose a prohibition on participation on any future proposal/CSR or mission activities arising from or related to a proposal/CSR evaluated under the EASSS 3 contact?
No, such a broad prohibition is not intended. The prohibition is effectively intended to link an evaluation to the resulting baseline or threshold investigation implementation efforts within a single solicitation cycle, whether Phase A (CSR) or beyond. Two instances of “directly” are being added to convey this. Note, however, that the minimum duration of the restriction is being extended to one year beyond an initial contract period—something that could impact another solicitation.
The Sources Sought Synopsis states “[p]otential offerors/vendors are advised that a firewall cannot be used to mitigate OCI”. Please provide guidance on the restrictions that the statement imposes.
The Contractor must not expect that use of a firewall within its own organization to mitigate “impaired objectivity” OCIs will be acceptable to NASA. Such firewalls generally provide insufficient mitigation for an “impaired objectivity” type of OCI. Additionally, the Contractor must not expect that the use of firewalled subcontractors to mitigate “impaired objectivity” OCIs will be acceptable to NASA. Use of such firewalls, except in extremely limited circumstances, prevents the Contractor from effectively managing their subcontractor(s) and the task.
