# Question DRFP Section Document Page # Answer

Do the best estimated quantities (BEQs) stated in the DRFP represent the expected volume of orders for each task item number (TIN)?

L.13.3, Volume III ‐ Price L‐02 Price Template TIN Price by BEQ Tab

No, the Government provided BEQs are for evaluation purposes only and are not a limit or guarantee of future work; nor do they represent an obligation, commitment, or amount to be ordered by the Government.

Will the Government provide GSA vehicles for contractor use in performance of this contract?

N/A N/A N/A No, GSA vehicles will not be authorized or provided by the Government. The KPLSS II contractor will be responsible for providing the vehicles necessary to perform the requirements of the contract.

At a glance the appearances of the equipment is acceptable, however the age of the equipment is concerning, especially if the number of launches per year increases.

Question ‐ Is there an asset replacement plan for aging equipment (such as cryogenic storage tanks and transports)? If so, can you share it?

Attachment J‐07 Government Furnished Property‐Installation Accountable

4‐290 Refer to PRO‐RCD‐0001, Propellants and Life Support Master Plan, which is included in the Bidder's Library.

The current infrastructure, asset inventory and business/technical processes seems to be insufficient to cover future needs:

1. We understand Methane may be used by future launch vehicles Question ‐ Is there a plan for Methane storage and supply at KSC? If so, can you share it?

2. Recommendations could be included in the RFP to improve current processes based on current weaknesses

N/A N/A N/A Methane storage and supply is not currently part of the KPLSS II requirements.

It’s difficult for us to understand the details of the pre‐priced task order/maintenance :

1. Fluid inventory management system. Task orders historical data. Raw data with scheduled delivery dates and maintenance records.

Question ‐ can you provide this data?

2. Historical : Data about tasks to be performed for each launch / number of launch per week. Date, delivery location and quantities of each fluid required Question ‐ can you provide this data?

3. Launching provisions of each fluid need to be provided Question ‐ can you provide this data?

Section A‐M 109 The link will be corrected in the RFP.

The TIN prices present a risk for the contractor – has the Government considered adding any specific language that allows the contractor to adjust TIN prices when revised SCA wage determinations and/or CBAs are incorporated into the contract, or does the Government consider that FAR 52.222‐43, which allows for unit price labor rates adjustments, covers the adjustment of TINS?

Articles I.2 and I.21 Section A‐M 50, 76 and

Yes, refer to FAR 52.222‐43(a), which applies to both contracts subject to area prevailing wage determinations and contracts subject to collective bargaining agreements.

On the previous contract the minimum was $8 million which provided the ability for the contractor to staff to perform the full range of services identified in the SOW. The $5 million minimum currently advertised does not allow for staffing that would ensure 100% of the requirements identified in the SOW are available. What is the rationale for decreasing it from $8 million to $5 million? It would appear that based on normal escalation the minimum should be approximately $9M.

Article B.2 Sections A‐M 2

The minimum contract value stated in Section B.2 does not represent the expected or anticipated ordering value under the contract. The contract minimum is required pursuant to FAR 16.504(a)(1) and (4) for the sole purpose of establishing a binding indefinite‐delivery, indefinite‐quantity (IDIQ) contract. However, FAR 16.504(a)(2) provides that the contract minimum need only be “more than a nominal quantity.”

The solicitation includes a performance work statement, catalog of services, data requirements documents, and other documentation that reasonably describes the general scope, nature, complexity, and purpose of the services the Government will acquire under the contract in a manner that will enable a prospective offeror to decide whether to submit an offer. In this regard, the contractor should provide sufficient staffing to meet the requirements of the contract, not the contract minimum.

The language indicates that the government could add a new Task Order at the end of the current fiscal year that would not be executable until the following fiscal year.

This gives a false impression of meeting the annual minimum. Is that the intent? Article B.2 Sections A‐M 2‐3 The RFP will be updated to clarify Section B.2.

The instructions tab indicates an annual plug of $250K for evaluation purposes. The Non‐Labor Margin Rate Tab includes a $1M annual plug. Will the Government please confirm which plug number should be utilized?

Instructions & Non‐Labor Margin Rate Price Tabs

L‐02 Price Template Instructio ns 5.b & 5.c

The RFP will be updated to correct L‐02, Price Template.

The current set up of the template limits offerors to only have a total of 7 unique line items distributed between 4 Task Orders. Will the Government please provide the password to unlock the price template or increase the number of lines in the Non‐Labor Direct Cost section?

PPTO Summary L‐02 Price Template

PPTO

Summary

The RFP will be updated to unlock Attachment L‐02, Price Template.

The current CBA is set to expire within the first year of the Period of Performance on March 31, 2021. To ensure pricing consistency from all offerors, will the Government provide direction for offerors to apply a mandated escalation such as 2.5% or require the usage of the 10/01/2020 rate for all subsequent periods?

Schedule BHourly Wage Rates

J‐23 Collective Bargaining

Refer to the terms of FAR 52.222‐41, Service Contract Labor Standards, which is incorporated in Section I of the RFP.

Specifically, FAR 52.222‐41(f), states in pertinent part, “neither the Contractor nor any subcontractor under this contract shall pay any service employee performing any of the contract work . . . less than the wages and fringe benefits provided for in such collective bargaining agreement, to which such employee would have been entitled if employed under the predecessor contract, including accrued wages and fringe benefits and any prospective increases in wages and fringe benefits provided for under such agreement.”

Concerning a mandated escalation rate, refer to the requirements of FAR 52.222‐43 Fair Labor Standards Act and Service Contract Labor Standards‐Price Adjustment (Multiple Year and Option Contracts), which is also incorporated in Section I of the RFP.

Specifically, FAR 52.222‐43(b), states in pertinent part, “The Contractor warrants that the prices in this contract do not include any allowance for any contingency to cover increased costs for which adjustment is provided under this clause.”

There are several unpredictable occurrences over the life of a contract that result in base closure thus resulting in loss of revenue and ability to compensate personnel and contract. Even though NFS 1852.242‐72 is included in the contract:

(1) Does the government intend on providing a method for reimbursement for employees to be paid during base closures caused by inclement weather, government shutdowns, etc.? The current RFP language does not clearly state the parties responsible for all cost associated with Center/Base Closure as a result of natural disaster or government shutdown. Both HRT and DART cost charging are clearly defined in attachment J‐01 section 1.9. However the draft RFP language does not provide clarity as to who is responsible for the cost of employee lost wages due to Center/Base closure. Will a request for equitable adjustment be approved to reimburse KPLSS II employees for lost wages associated with Center/Base closure resulting from natural disaster or government shutdown?

(2) In addition, during base closures there is usually some level of exempted work that requires personnel to be on site to perform, however; there are no TIN sales occurring which results in a loss of revenue to the contract. Is there a method for compensating the contractor when customers are not buying TINS during a base closure, but the contract is maintaining capabilities for when the center reopens at full capacity?

No, TINs cannot be underutilized or overutilized. There is no minimum or maximum quantity for each TIN, as stated in Section B.1. Clause I.21 applies to new recurring requirements or changes in existing recurring requirements.

Along with the current CBA, will CBA demographics be provided in the Bidders Library? Collective Bargaining

Agreement (CBA) Attachment J‐23 N/A No, the Bidder's Library will not include this information.

The cancellation charge is limited to a maximum of 4 hours. However the possibility exists of charges greater than 4 hours as a result of customer cancellation, increasing contractor cost risk. Would the government consider changing the section language to allow all actual accumulated cost be charged to the as a result of cancellation within the time period?

Section I.22 Sections A‐M 77‐78 No, the Government will not change the maximum of 4 hours. However, the Government will include an example demonstrating the mechanics of Clause I.22, Service Reschedules and Cancellations, under the Sample Service Request section in Attachment J‐02, Catalog of Services to be Provided.

Would NASA consider the following minimum notification change?

Minimum notification times: for any support request with multiple TIN requirements the longest minimum notification time must apply to all the TINs required to complete the requested work.

TE 1.6‐1 1

No, the minimum notification times listed in TE 1.6‐1, Minimum Delivery Notification Times for Propellant and Life Support Services, will remain unchanged.

Would NASA consider establishing a standby utilization TIN to address customer requests for dedicated equipment required for operational support standby? TE 1.6‐1 1 Refer to Attachment J‐02, Catalog of Services to be Provided.

Regarding drawings and file storage noted in above PWS paragraphs and T.E J‐11:

1. Configured drawings with an outstanding EO is a subset of all configured drawings. Do all existing Microstation configured drawings require conversion to PTC Creo in first two years?

2. Do existing Microstation non‐configured drawings require conversion to PTC Creo if it is modified for use on a project?

3. Existing Microstation documents are compatible with the KDDMS environment. Is Microstation allowed as a design tool or is PTC Creo the only tool allowed?

4. Is KDDMS a Government Furnished Service?

5. Is KDDMS administered andmaintained by NASA or KPLSSII contractor?

6. Is training provided for KDDMS?

7. Is PTC Creo GFS?

8. Current drawing documentation is released into TecDoc/KEDS folder for access by all KSC users by KIAC. Will release into TechDoc/KEDS be required or only KDDMS?

J‐1 PWS para. 2.2.C, 2.4.C, 2.4.F, 2.4.F.i and Attachment J‐11 Gov’t.

Furn. Ser.

2. No, conversion is only required for configuration drawings. See updated PWS 2.2.C in RFP.

3. PTC Creo is the only tool. See PWS 2.2.C.

4. Yes, KDDMS will be provided.

5. KDDMS is administered and maintained by NASA.

6. Training will be provided by the Government.

7. Yes, PTC Creo will be furnished by the Government.

8. The PWS specifies what is released into TechDocs, and what is released into KDDMS.

The second paragraph seems to have been cut off. Would the Government provide the full content of that paragraph?

Attachment J‐10 002 Section 1.0

6 The RFP will be updated to correct Attachment J‐10, Pre‐Priced Task Orders.

We do not feel the 15 days for providing Task Plans for TOs of < $250,000 and 20 days for providing Task Plan for TOs of > $250,000 is reasonable.

Would the government consider the following Task Plan due dates?

o Twenty (20) business days from CO request when the estimated TO award value is $250,000 or less.

o Thirty Five (35) business days from the CO request when the estimated TO award value is more than $250,000.

Section I.19 (d)(2)(i) Sections A‐M 74 The requirements of I.19(d)(2)(i) will remain unchanged.

Please consider changing the Task Plan due date to add a value affiliated with project complexity and material lead time as opposed to only estimated award value. The estimated award value is a lagging indicator that is not known until after the estimate is formulated. In some cases the ability to obtain estimates is completely out of the contractors control with respect to timing. Further complication arises from the FAR requirement to obtain three estimates. Please consider adding project complexity into the equation which would serve to recognize the inherent difficulty obtaining quotes for complex items/systems. Project complexity scoring could become a part of the NTO process and discussed and negotiated as an agreed to “objective metric” as part of the NTO process.

Clause I.19(d)(2)(i) Sections A‐M 74 The requirements of I.19(d)(2)(i) will remain unchanged.

Given that Anomaly Reports will require investigation period, root‐cause analysis, approval of resolution, and procurement of materials (if required), will a waiver to the 30 calendar due date be available on a case‐by‐case basis?

DRD DRD 1‐3 number 2 2 Refer to DRD 1‐3 paragraph 2, which states completion of all corrective plan tasks and final documentation is due within 30 calendar days after occurrence of anomaly unless a specific due date is assigned by the Government or regulatory agency.

Government states “Audits shall be required to be performed annually on all Ground Support Systems (GSS) and biennially for all other configured systems.” Is this audit requirement limited to PVS systems or is it for all configured systems?

If the audit requirement is for all configured systems is it expected to inspect every piece of equipment for a particular system, i.e. all EORs/ELSAs?

DRD DRD 2‐3 number 2 2 All configured systems and equipment shall be audited; see PWS 3.1.D.

How will the cost for any spare inventory deficits at the beginning of the contract be addressed (who will pay for them)?

DRD DRD 2‐12 1 Attachment J‐07, Government Furnished Property ‐ IAGP, specifies ownership and responsibilities of spares.

Given the long lead time on some materials there is a chance some will go beyond the 30 day requirement for completion of discrepancies, will a waiver to the 30 calendar due date be available on a case‐by‐case basis?

J‐01 Reference J‐01 PWS

1.5.4 (F)

10 Refer to PWS Section 3.0 A i.

What is the determining factor for the 2‐hour flow test considering the high cost of Helium? It will be very expensive to perform a test of this duration, venting helium to atmosphere. The government states, “Assessment of spare parts required on‐sight shall be included in the report.” Is this assessment limited to the Liquid Helium pump spares?

J‐01 Reference 2.3 (K) (iv)

There is no requirement to vent helium to the atmosphere. The liquid helium pump spares are not a requirement of KPLSS II.

Pickled and passivated are requirements for the scrubbers, CRCA does this type of work, should we consider this to be a government furnished activity for estimating purposes?

J‐01 Attachment J‐10 001 Refurbish and Mobilize Scrubbers 7.0 (iii)

See GFS Supplement 2 ‐ Laboratory Descriptions and Capabilities in Attachment J‐11, Government Furnished Services.

Which section of the RFP addresses the “field validations” mentioned in the Deduction Description?

J‐13 Attachment J‐13 item 7

4 The deduction schedule applies to all field validation requirements in the PWS.

Does the Configured Drawing requirement include updating all drawings to CREO or is it only incorporating all EOs? Many drawings have sheets that do not have CAD files (no native file), thus they will be required to be redrawn adding many hours to the process.

Will the government provide a list of these drawing sheets so they can accurately be estimated?

Template L‐08 Sections A‐M

The PWS will be updated to clarify this requirement in the RFP. The Government will provide additional information in the Bidder's Library for information purposes only. It is the responsibility of the Offeror to understand requirements and propose adequate resources to meet the requirements of the solicitation.

The Government established page limitations for each portion of the proposal submitted in response to the solicitation, specifically a 40 page limit for Volume I Mission Suitability.

As Mission Suitability is the most important evaluation factor, and with the amount of information to be provided in response to the RFP, would the Government consider increasing the page limitation to 80 for the Volume I response?

L.6 Sections A‐M 105 The RFP will be updated to reflect a 50 page limit for the Mission Suitability Volume.

It is unclear how bidders can fairly account for $500K per year (10% of minimum yearly contract value) in non‐routine maintenance/repair/replacements to be fully covered by TIN pricing for tasks with no specified minimum or maximum quantities. Please clarify. B.1 and G.10 Sections A‐M 2, 24

It is the responsibility of the offeror to understand requirements and propose an approach to meet the requirements of the solicitation.

Does the incumbent have any approval authority on purchase of contractor‐owned equipment by successor?

L‐15 Sections A‐M 122 No.

If a TIN is deleted due to development of another method for providing service will there be an opportunity to recoup lost revenue, as in reprice the remaining TINs to respread the costs that were spread against the deleted TIN? For example, when the contract is responsible for providing JET A fuel and another vendor establishes a fueling system which replaces the contract capability.

I.21 Sections A‐M 76, 77 Clause I.21, TIN Negotiation Procedures, specifies circumstances upon which a TIN negotiation will occur.

Recognizing that the government cannot drive the commercial customers to use the contract services, however, is the government going to use the contract services provided for the duration of the contract? For example, GN2 is traditionally provided through the contract, and if another method is available for obtaining GN2 will all government customers be required to use the KPLSS II services? If they will not be required to use KPLSS II, will the contractor be given the opportunity to reprice the remaining TINs to re‐ spread the costs that were spread against the TINs that the government is not using due to change in circumstance?

I.21 Sections A‐M 76, 77

Refer to Section B.3 Contract Maximum for the total maximum quantity of services (stated in a dollar value) the Government may acquire under the contract. Additionally, refer to Section B.1 Supplies and/or Services to be Provided regarding adjustments to TINs. Specifically, there is no stated minimum or maximum quantities for each TIN.. See also Clause I.21 for new recurring requirements or changes in existing recurring requirements.
