BRAND NAME JUSTIFICATION

Cinedeck SSD Storage

1. This justification to restrict consideration to an item peculiar to one manufacturer is prepared by the National Aeronautics and Space Administration (NASA), John F. Kennedy Space Center (KSC).

2. Nature and/or description of the action being approved.

NASA KSC requires a brand name justification in order to restrict consideration to one manufacturer for Cinedeck ZX45. Cinedeck ZX45 is a multi-channel, multi-codec, multi-format, video recording and playback system with Solid State Drive (SSD) storage cards, video record and playback decks.

3. A description of the supplies or services required to meet the Agency’s needs (including the estimated value).

Cinedeck ZX45 is a production recording and playback server to be procured and fully integrated into an existing larger operational environment. Additional scale to this existing system is being procured and must be the same manufacturer due to operational design and control system interface. The system recording channels and the associated SSDs must be consistent and properly configured to assure complete functionality The total estimated cost of this effort is $493,000 and the estimated lead-time for delivery 09/15/2019.

Line Manufacturing Part Number Description QTY

1 28045 Cinedeck ZX45 11

2 17013 Touchscreen 11

3 15018 8GB or 10 GB network card 11

4 9909 SSD Media 4TB 88

The Cinedeck ZX45 platform including hardware and accessories that support recording in J2K at 250 Mbps on all 4 channels of the deck. It also can record in H.264 at 25 or 50 Mbps and uncompressed. Thus allowing recording native files in the formats that meet Government requirements.

4. Identification of the authority and the supporting rationale for why a particular brand name, product, or feature of a product, peculiar to one manufacturer is essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company.

The authority for this brand name justification is 41 U.S.C. 1901, Federal Acquisition Regulation (FAR) 13.5, which requires the Contracting Officer to justify restricting consideration to an item peculiar to one manufacturer for simplified procedures for certain commercial items.

Brand-name uniformity is essential because the hardware is being used as part of an existing, homogeneous four channel video recording system. These items are required to enhance the existing system and will be fully integrated into the existing production environment. They will create a deck that matches existing workflows precisely. At this time Cinedeck ZX platform is not compatible with other codecs and would require additional costs because the patent holder and Software Development Kit (SDK) creator charges license fees. Procurement of a different system would demand existing infrastructure, cables and spares to be replaced. Procurement of a different system would also demand NASA’s engineers and technicians to undergo additional training to learn, operate and maintain the new system.

5. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by FAR subpart 5.2 and, if not, which exception under FAR 5.202 applies.

A notice of this proposed contract action will be publicized to the Government wide point of entry, the Federal Business Opportunities website (FedBizOpps), in accordance with FAR subpart 5.2. The notice will inform potential sources of the Government’s intent to procure this requirement as a brand name acquisition.

6. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer determines the anticipated cost to the Government will be fair and reasonable, as the solicitation for this brand name requirement will be posted on FebBizOpps for re-sellers to view and submit quotes in response. The Contracting Officer anticipates adequate price competition will result from quotes received and therefore prices will be determined fair and reasonable based on a comparison of quotations received in response to the solicitation. In the event that adequate competition is not received, the Contracting Officer will determine the price fair reasonable based on the results of market research or comparison of the proposed price with current price lists or catalogs.

7. A description of the market research conducted and the results.

Market research was conducted to identify suppliers able to supply specific brand name items as listed in section three, which are necessary to meet this requirement. As part of the market research, the Contract Specialist obtained a published price list from Cinedeck. The market analysis revealed three possible companies which were listed on the manufacture’s website as authorized resellers. For the purpose of verification of business size, certifications and eligibility to do business with the Government, these companies were validated in the SAM.gov site. Two of the three companies have active small business status.

8. A statement of the actions, if any, the Agency may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies or services is made.

The solicitation will be posted to FedBizOpps for authorized Cinedeck resellers to respond. Award for products other than Cinedeck would result in substantial cost to the Government and would not be recovered through opening competition for other than Cinedeck products.
