Brand Name Justification for Restricted Competition

1. This document is a justification for other than full and open competition prepared by the NASA, John F. Kennedy Space Center (KSC).

2. The nature and/or description of the action being approved:

This justification provides the rationale for contracting by other than full and open competition for the acquisition of the Enerpac brand Hydraulic Split Flow Pumps and Associated Hardware.

3. Description of the supplies or services required (including the estimated value):

I recommend that NASA, Kennedy Space Center negotiate with only with vendors who can provide the subject brand name from Enerpac for hydraulic split-flow pumps and associated hardware. The total estimated cost of this effort is $400,000 and the estimated period of performance or lead-time for delivery is November, 15 2018.

4. Statutory authority permitting other than full and open competition:

The statutory authority permitting other than full and open competition is:

FAR 6.302-1(a)(2). “When the supplies or services required by the agency are available from only one responsible source, or, for DoD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.”

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:

Enerpac Corporation is the only source to offer commercial off the shelf hydraulic split flow pumps that meet NASA KSC’s requirement of a 40 gallon pump reservoir.

6. Description of the efforts made to ensure that offers are solicited from as many potential sources as practicable:

A combined synopsis/solicitation will be publicized on FBO in accordance with FAR 12.603

“Streamlined solicitation for commercial items”.

The GSA Federal Strategic Sourcing Home Page was reviewed on 06/11/2018 and it was determined that there were no contracts currently available under which to procure the required hydraulic split flow pumps.

7. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable:

The anticipated cost to the Government will be fair and reasonable for the commercially available hydraulic split flow pumps as a combined synopsis/solicitation will be posted on FBO for authorized vendors to submit competitive quotes.

8. Description of the market survey conducted and the results, or a statement of the reasons a market survey was not conducted:

Market survey by the technical staff between 03/01/2018 and 03/09/2018 has determined that Enerpac meets all the necessary requirements. There are only two other companies in the field of heavy lifting that offer the split flow pumps as part of their COTS products. The companies are Hi-Force head quartered in England and Larzep head quartered in Spain. Hi-Force offers a two outlet split flow HPU but the reservoir is only 13.2 gallons which does not meet our requirement of 40 gallons. This volume cannot supply the 18 gallon volume that is required to actuate two cylinders. Larzep may have the capability but does not have fork lift slots that would allow for loading onto a truck which is a requirement. Furthermore, Larzep does not have a distributor located in the United States of America.

Pre-solicitation conference calls were conducted with Enerpac’s territory manager and engineering that confirmed Enerpac had the COTS cylinders, HPUs, flex hoses and components that can meet the NASA

KSC requirements. This acquisition is limited to the identified source as no other sources possess a commercial off the shelf hydraulic split-flow pump which can meet the Agency’s need.

9. Other facts supporting the use of other than full and open competition, such as: None.

10. A listing of sources, if any, that expressed in writing an interest in the acquisition: None.

11. A statement of the actions, if any, the Agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:

For any subsequent requirement for hydraulic split flow pumps, NASA will conduct market research at that time to determine if there are any other sources for the pumps.
