About this file
This document is a set of post-industry day questions and answers for NASA's Flight Test Vehicle Concept Study for Making Advancements in Commercial Hypersonics (MACH) solicitation (RFP 80AFRC25R0006). The Q&A document addresses technical proposal submission requirements, including page limits, proprietary information handling, and proposal organization guidelines. Key clarifications include: the 18-page technical volume must include a Statement of Work (SOW), with title page, executive summary, and SF 1449 excluded from page count; proprietary information is allowed if properly marked; and company-identifying information cannot appear beyond the first page of the technical volume.
The questions also cover specific contract details such as independent analyses to be conducted by NASA, Service Contract Labor Standards applicability, and submission of small business subcontracting plans. The government indicated that Amendment 0002 will be issued to remove certain clause markings related to service contract standards, as the contract will primarily be performed by executive, administrative, and professional personnel. Offerors are advised to carefully follow the detailed submission instructions and marking requirements when preparing their proposals for this NASA Armstrong Flight Research Center contract opportunity.

Post MACH Industry Day Questions
16. Q: Are CUI submissions allowed? Assume specific identifying company information is not disclosed.
A: There are no restrictions on submitting proposals that contain contractor proprietary or confidential information, as long as the information is properly marked and clearly labeled. It is essential that such information is designated appropriately to ensure it is handled in accordance with regulations and safeguarding requirements.
17. Q: Can a domestic offeror submit a proposal that draws on both domestically and foreign-developed IP and supplies, and still comply with section E.2?
A: Section E.2 of the Solicitation references FAR 52.204-24—Representation Regarding Certain Telecommunications and Surveillance Services or Equipment (NOV 2021) that primarily addresses telecommunications equipment and services. This provision requires offerors to disclose whether they provide or use covered telecommunications equipment or services in their government contracts.
If an offeror indicates that they do provide or use such equipment or services, they must furnish additional details, including the manufacturer, model, and intended use, as stipulated in the full text of the provision.
While FAR 52.204-24 does not explicitly reference foreign-developed IP and supplies, it incorporates definitions from FAR 52.204-25, which outlines restrictions on certain telecommunications equipment and services. FAR 52.204-25 also defines critical technology, which may include certain foreign-developed technologies. Offerors must ensure that any foreign-developed components do not fall under the prohibited categories outlined in these regulations.
18. Q: RFP Section E.5, Pg 25. Paragraph E.5(c) states "Identify any exclusions to the page limits that are excluded from the page counts (e.g. title pages, table of contents)."
Please explain what is meant by this? Which pages are considered excluded from the page count? Does the Government want pages which are excluded from page count to be clearly marked “Excluded from Page Count”?
A: Volume I – Technical shall not exceed 18 pages and must include a Title Page, a two
(2) page executive Summary, a Statement of Work (SOW), and Standard Form (SF) 1449.
The Title Page, two (2) page Executive Summary, and SF 1449 are excluded from the page count.
The statement "Identify any exclusions to the page limits that are excluded from the page counts (e.g. title pages, table of contents)." means proposals must clarify which parts of a document do not count toward the page limit.
19. Q: RFP Section E.5, Pg 26. Does the required SOW need to part of the Technical Volume and does it count against page count?
A: Volume I – Technical must include a Title Page, a two (2) page executive Summary, a Statement of Work (SOW), and Standard Form (SF) 1449.
Yes, the required Statement of Work (SOW) must be included in the Technical Volume and does count toward the page limit. However, the Title Page, two-page Executive Summary, and SF 1449 are excluded from the page count.
20. Q: RFP Section E.5, Pg 26. Is company proprietary information allowed in the technical volume and SOW, assuming the pages / content are marked appropriately? If the technical volume and SOW do contain proprietary information, will it be safeguarded appropriately? If proprietary information is included, will it negatively affect the proposal’s evaluation and award?
A: Yes, proprietary information is allowed in the technical volume and Statement of Work (SOW), provided that the pages and content are properly marked as proprietary.
Yes, the Government is required to safeguard contractor’s proprietary information.
Including proprietary information should not negatively affect the proposal’s evaluation or award, as long as it complies with solicitation requirements and does not restrict the Government’s ability to assess the proposal. However, offerors should ensure that proprietary markings do not limit the government’s ability to use or evaluate the information as needed.
21. Q: RFP Section E.5, Pg 27. Paragraph E.5(d)(4) requires offers to submit a small business subcontracting plan in accordance with FAR 52.219-9. Per 52.219-9(a), this requirement does not apply to small business concerns. Can you please confirm that small business concerns are not required to submit a small business contracting plan with their proposal?
A: Small business concerns are not required to submit a small business subcontracting plan with their proposal. IAW FAR 52.219-9(a), the subcontracting plan requirement applies only to large businesses submitting offers for contracts that exceed the applicable threshold and have subcontracting opportunities.
22. Q: RFP Section E.5, Pg 25. Paragraph E.5(c) states that the “submission shall be clearly indexed and logically assembled.” What does this mean? Will a table of contents suffice?
A: The requirement for the submission to be “clearly indexed and logically assembled” means that the proposal must be well-organized, easy to navigate, and structured in a manner that allows evaluators to efficiently review its contents. If the provided table of contents fulfills these, then it would be sufficient.
23. Q: RFP Section E.5, Pg 25. Paragraph E.5(c) states "Except for the first page, the Offeror shall ensure that the company name, logo, or other company identifying information does not appear within Volume 1, Technical." Does this mean that the Technical Volume should not include any company information at all, i.e., a company overview section, as is typical? Does this mean that the company should not refer to itself by name in the body of the Technical Volume?
A: This means that while the first page may include company details, the remainder of the Technical Volume must exclude company name, logo, or other identifying information.
24. Q: SOO Section IV, Pg. 9. The SOO states that deliverables for Task 1 and Task 3 will be used to support independent analyses. Will the analyses be performed by NASA, a federally funded research and development center, or another contractor?
A: The independent analyses would be conducted by NASA or federal employees, and any proprietary information will be protected.
25. Q: SOO Section IV, Pg. 9. The SOO states that deliverables for Task 1 and Task 3 will be used to support independent analyses. Are support for and discussions of those analyses part of the tasks under this contract?
A: The independent analyses will only utilize information provided in the study and these analyses will be part of the HTP report to NASA HQ.
26. Q: RFP Section C.3, Pg 10. Under FAR 52.212-5(c), clause 52.222-41 is marked as applicable. Per 22.1006(a)(1), this clause only applies if the contract is subject to the Service Contract Labor Standards statute. Per 22.1003-1, the statute only applies to contracts which have a principal purpose of furnishing services through service employees. Service employees exclude persons employed in an executive, administrative, or professional capacity (22.001). This contract will be primarily performed by persons employed in an executive, administrative, or professional capacity. Can you please confirm that the Service Contract Labor Standard statute does not apply and remove 52.222-41?
A: Amendment 0002 will be issued to remove the marking from 52.222-41 in Section C.3, page 10 of the Solicitation.
27. Q: RFP Section C.3, Pg 10. Under FAR 52.212-5(c), clause 52.222-42 is marked as applicable. Per 22.1006(b), this clause only applies if the contract is subject to the Service Contract Labor Standards statute. Can you please confirm that the Service Contract Labor Standard statute does not apply and remove 52.222-42?
A: Amendment 0002 will be issued to remove the marking from 52.222-42 in Section C.3, page 10 of the Solicitation.
