The contract was competitively bid with three vendors participating, and the recommended award goes to A.C. Schultes of Florida, Inc. The contract period is four years from the effective date of the blanket purchase agreement, with no renewal periods specified.

The total contract amount is $246,190.00, which includes a $95,000.00 allowance for unspecified parts that may be required for future projects. A.C. Comparison to Original Estimate: The recommended award amount is 1.52% ($3,810.00) less than the department’s estimate for this project. SUBJECT: Bid No. 21658 (Vertical Turbine Pumps Maintenance Services and Parts)

Dear Mr. Whitlatch:

We sincerely appreciate your firm’s participation in the above-referenced procurement process. After careful consideration, your firm’s bid has been deemed nonresponsive for failing to demonstrate or provide evidence that your firm holds the required licensing as specified in the subject solicitation.

Specifically, Section 1.2.2., required the Bidder shall have a current active Florida Contractor’s license at the time of bid submission. On July 22, 2021, you confirmed that your firm does not hold the required licenses. As such, the bid submitted by your firm does not comply with the solicitation requirements.

Generally, a responsive bidder means a bidder who has submitted a response to a solicitation, which conforms in all material respects to the requirements set forth in the same. When the bid fails to meet one (1) or more material requirements of a solicitation, it must ultimately be deemed nonresponsive.

Awarding a contract to a bidder whose bid deviates from policy may adversely impact both potential and competing bidders, is contrary to public policy, injures the integrity of the procurement process, and irreparably damages the public’s confidence. As a result of this determination, staff will recommend that your bid be rejected. Also, it should also be noted that due to the material nature of this deviation, no other aspects of your bid were evaluated; therefore, there may be other deficiencies not described in this letter.

Should you have any concerns or objections to this finding, you are required to address them in accordance with the Protest Ordinance. You must submit your concerns, in writing, to my office no later than five (5) working days after receipt of this notice. This letter is being sent on the date above and the five (5) day period begins on the working day following the date of this letter. Any concerns or objections expressed must also include all pertinent documents, information, and evidence necessary to support your position. If you choose to submit a rebuttal, we will give your concerns or objections our fullest consideration.

Mr. Joshua Whitlatch August 2, 2021 Page Two (2)

Please also be advised that a Cone of Silence remains in effect for this procurement to safeguard the integrity of the County’s procurement and protest process. As a reminder, the Cone of Silence prohibits bidders/offerors from communicating with County employees, members of the Board of County

Commissioners (including their aides and employees) and the Hearing Master regarding a procurement solicitation and/or its related protest. However, the Cone of Silence does not prohibit your company from communicating with myself or the person(s) listed as contacts in the bid solicitation.

For specifics regarding the Cone of Silence and other protest procedural requirements, please visit the following link to Hillsborough County Ordinance 13-24:

Any concerns or objections expressed must also include all pertinent documents, information, and evidence necessary

Mr. Vickery Dye August 20, 2021 Page Two (2) to support your position. If you choose to submit a rebuttal, we will give your concerns or objections our fullest consideration.
