About this file
This is a Contractor Mobile Source Acknowledgment Form for RFP 3906 issued by Eastern Municipal Water District (EMWD) for fire hydrant painting services for 1,071 fire hydrants and blow-off valves in the City of Murrieta, California. The form must be completed and included in all bid proposals, with contractors responsible for maintaining compliance throughout the contract term and verifying compliance certificates for all subcontractors and rented equipment. The document addresses four categories of vehicle and equipment compliance requirements under California Air Resources Board (CARB) regulations: off-road diesel-fueled construction equipment operating under the In-Use Off-Road Diesel-Fueled Fleet Regulation (13 CCR 2449-2449.2, effective October 1, 2023); on-road vehicles subject to the Advanced Clean Fleets regulation (13 CCR 2013-2013.4 and 2015-2015.6) with a GVWR greater than 8,500 pounds; on-road heavy-duty vehicles complying with the Truck and Bus Regulation (13 CCR 2025) requiring 2010 or newer diesel engines; and on-road heavy-duty vehicles meeting the Heavy Duty Inspection and Maintenance Program requirements (13 CCR 2195-2199.1).
For each regulatory category, contractors must provide signed statements acknowledging their understanding of applicable requirements and their responsibility to verify compliance of all equipment, whether contractor-owned, rented, or operated by subcontractors. Contractors must obtain and maintain valid CARB compliance certificates for equipment used on the project and provide copies of current certificates with their bid proposal, along with subsequent annual certificates upon request from EMWD throughout the contract term. If a contractor determines that specific CARB regulations do not apply to their equipment, they must provide a signed statement with supporting documentation explaining the exemption. The form provides checkboxes for contractors to indicate whether all equipment will be rented, contractor-owned equipment will be used, or a combination of both will be used, as well as an option to state that the contractor is not subject to off-road regulations with accompanying reasoning.
