About this file

This is an RFI Response Tracker documenting 158 contractor questions and government responses for a federal construction project at NIH Building 31B involving below-grade waterproofing replacement, exterior restoration, and associated site work.

The project scope includes demolition of stairs, slabs, handrails, and wall cladding; excavation up to 18 feet deep; installation of new waterproofing systems (HRA, PUMA, and sheet waterproofing); foundation and sump pump installation; storm drainage system modifications; retaining wall reconstruction; landscape restoration; and concrete repairs. The contract period is 300 workdays from Notice to Proceed, with performance dates referenced as 05/25/2026–03/21/2027. Key requirements include engagement of Maryland-licensed professional engineers for temporary excavation support and shoring design, certified surveyor deliverables for underground utilities, third-party waterproofing inspections and integrity testing, phased work with weather protection, and coordination with occupied building spaces below the work area. The contractor must provide dedicated personnel including a Superintendent, Quality Control Manager, and Safety/Site Safety and Health Officer (with specification documents allowing role consolidation where duties do not conflict), cost-loaded schedules using Primavera P6 or Microsoft Project, and comprehensive closeout documentation including as-built drawings and O&M manuals. Government-directed unscheduled restrictions and delays are treated as excusable and compensable. Significant risks identified include uncharted utilities, rock excavation, unsuitable soils, hazardous materials discovery, unknown waterproofing tie-in requirements, and extended dewatering—with contractors permitted to submit assumptions, exclusions, allowances, and unit prices for bid evaluation. The MDE permit has been waived, no asbestos testing has been completed, no soil boring reports are available, and no existing utility as-built drawings are provided; these represent contractor means-and-methods responsibilities and differing site condition opportunities.

No. Issue Contractor Question Related RFIs Response

RFI-001 Solicitation states 300 days after NTP and PoP 05/25/2026–03/21/2027, while SOW states 300 workdays.

Please confirm whether the period of performance is 300 calendar days or 300 workdays from Notice to Proceed, and whether the listed PoP dates are fixed or placeholders.

RFI-053, RFI-079, RFI-084, RFI-

SOW section 2.2 says 300 workdays but the contractor can finish early. The SOW does not have any PoP dates noted. The PoP from NTP to Project Closeout is 300 Workdays.

RFI-002 The continuation sheet lists Delivery Location Code BLDG 13, 2C, while project work is Building 31B below-grade structure.

Please confirm the correct project delivery/work location and whether any submittals, deliveries, or Government-furnished materials are to be routed through Building 13.

GFCI items asks the contractor to coordinate with the PO, but does not ask for routing thru Bldg 13.

See section L in the revised solicitation document.

RFI-053 Proposal schedules and implementation tables may need to use relative dates because actual award/NTP dates are not yet confirmed.

Please confirm whether offerors may use T0 as the assumed contract award date, with subsequent proposal dates shown as T0 plus the applicable number of calendar/work days, until actual award and NTP dates are issued.

RFI-001, RFI-079, RFI-084, RFI-

You can use T0 (time zero) / project kick-off date.

RFI-054 Several bid risks require assumptions, allowances, unit prices, or exclusions, but it is unclear how NIH will evaluate assumptions/exclusions for price realism and technical acceptability

Please confirm whether proposal assumptions, exclusions, allowances, and unit prices will be permitted and evaluated, including items such as unknown utilities, rock excavation, unsuitable soils, hazardous materials, substrate repairs, additional waterproofing tie-ins, extended dewatering, after-hours work, and NIH-directed operational restrictions.

Proposal assumptions, exclusions, allowances, and unit prices should be used only where permitted by the solicitation or issued addenda; NIH should confirm bid-evaluation treatment for unknown utilities, hazardous materials, rock/obstructions, hidden concrete repair, and similar pricing risks.

RFI-055 M.5 states failure to comply with proposal submission instructions may result in elimination, but required submission checklist should be confirmed.

Please confirm the complete proposal submission checklist, including SF1442 execution, technical sections, price proposal, bid guarantee, bonding commitment, acknowledgments/amendments, representations/certifications, subcontracting/limitations on subcontracting compliance, and any required attachments/forms.

Please also confirm whether temporary waterproofing must remain in place during off-hours, weekends, rain events, or phased turnover of work areas.

RFI-100 Phased work is acceptable only with a weathertight building and approved weather/rain protection plan. Protect exposed substrates and complete/protect waterproofing each work period where practical.

RFI-059 The specifications identify waterproofing systems and products, but it is not clear whether equivalent manufacturer/material substitutions will be accepted during submittal review.

Please confirm whether waterproofing materials and related system components may be substituted with approved equal materials/manufacturers that meet or exceed the specified performance requirements, warranty requirements, compatibility requirements, and manufacturer inspection/testing requirements. If substitutions are permitted, please confirm the required documentation and approval process.

RFI-157 Subsitute are accepted if contractor provided product meest the contract documentations.

RFI-075 Per Paragraph 1.11.1.A of the NIH DRM, Petroleum-based contact adhesives are considered hazardous substances and the use of alternative non-hazardous materials are preferred unless unavoidable, inferior, or cost prohibitive. Contract Documents (A-503 and specification section 07 1413) call for a HRA (Hot Rubberized Asphalt) Waterproofing across the structure. This material has a significantly strong odor, and is not the specified Manufacturers (Henry) recommended product for this application. Per the local manufacturers representative," We would like to propose the Henry Prodeq cold fluid applied polyuria system in lieu of the Henry 790-11 hot rubberized asphalt system. The hot rubber system is an excellent waterproofing system, however on this project it would not be the best system based on the project conditions.

Henry 790-11 has a strong odor due to the asphalt being heated and will very likely have issues with the occupants in the building and around the immediate area. It is also very difficult to apply a 215 mil system to a vertical wall more than a few feet tall. In this application we may have to go up to 16 feet and this would not be optimal. Our cold applied Miraseal product also has odor and would not be the best choice. Henry Prodeq is a liquid applied polurea and has no odor, rapid set time (3 minutes) and can be spray applied with a spray rig. The system does not need to be reinforced, detail work is incredibly easy and efficient. Henry also has a tech present for the installation to ensure proper install. This system has been used on a number of high profile projects across the country and has had great results. “Please confirm if NIH will accept the system as recommended by the specified Manufacturer, or if Contractor is to use the specified product which is an inferior product for the application as determined by the manufacturer and would therefore go against the NIH DRM as detailed above.
