Article I.1 incorporates by reference FAR Clause 52.227-14, Rights in Data – General (May 2014) and FAR Clause 52.227-17, Rights in Data – Special Works (Dec 2007). Article I.4 additionally incorporates FAR Clause 52.227-18, Rights in Data – Existing Works (December 2007). Would the Government consider allowing 52.227-14 (Rights in Data – General) to govern all information collected or generated in performance of this work?

Section I, Articles I.1 and I.4

31, 33 The Government will retain the FAR clauses currently included in the RFP.

ARTICLE H.13.1, Item 6 (Confidentiality and Nondisclosure of Information) states that “Any information provided to the contractor (and/or any subcontractor) by HHS or collected by the contractor on behalf of HHS shall be used only for the purpose of carrying out the provisions of this contract and shall not be disclosed or made known in any manner to any persons except as may be necessary in the performance of the contract.” Can the Government clarify how this requirement would impact the ability of any institution of higher education (IHE) contractor or subcontractor to publish or otherwise disseminate findings from this study?

Section H, Article H.13.1, Item 6

19 As outlined in the RFP, the Contractor is required to develop and submit an external communication plan to the COR for approval. The external communication plan may include a range of publications/written products based on data collection and other contract activities undertaken by Contractor and any subcontractors, including subcontractors affiliated with institutions of higher education (see Task 10:

External Communication for more information).

ARTICLE H.13.1, Item 11 (Contractor Non- Disclosure Agreement (NDA)) states that “Each Contractor (and/or any subcontractor) employee having access to non-public government information under this contract shall complete the NIH nondisclosure agreement…” Can the Government confirm whether this requirement applies to employees of institution of higher education (IHE) contractors and subcontractors?

Section H, Article H.13.1, Item 11

22 The NDA pertains to all contractor and/or subcontractor who has access to non-public government information under this contract.

Total Compensation Plan should include narrative information outlining the contractor’s approach to compensation for all full-time employees rather than the specific employees bid in this proposal. Please also confirm whether the Total Compensation Plan need only be provided for the prime contractor and not for any subcontractors.

Offerors, Business Proposal Instructions, Total Compensation Plan) contractor and any major subcontractor (over 25%).

The SOW for Services Component 1, Subtask 3.2 states, “the Contractor shall provide site payments up to a per-organization maximum to be determined in consultation with COR and other federal staff.” Can the Government provide guidance on the total amount of funding the Contractor should designate for site payments?

Section C.2.1 (Services Component 1), Subtask 3.2

84 Offerors should propose site payment amounts consistent with their proposed technical approach for offsetting the burden and costs associated with sites participating in the study and to accomplish the project’s objectives. The total amount for site payments is subject to other costs and bidding assumptions proposed by Offerors;

however, the Government estimates that the total amount of funding designated for site payments would fall within the range of $1,300,000-2,400,000.

Will electronic submission of the proposal to the CO be sufficient?

Section L, Item 2.a.2 (Instructions to Offerors, General, Authorized Official and Submission of Proposal)

44 Yes, electronic submission is required. Submit to kathmank@od.nih.gov. Hard copies will not be accepted due to shortage of on-site staffing.

Would the Government consider extending the response date to May 13, 2022?

SF-33 1 The Government is amenable to extending the deadline for responses to May 9, 2022.
