About this file

This is an Amendment to Solicitation for a lease/rental of a Mobile Computed Tomography (CT) Trailer Unit issued by the U.S. Department of Health and Human Services, Indian Health Service, Navajo Area Indian Health Service at Gallup Indian Medical Center (GIMC) in Gallup, New Mexico. Solicitation 75H71025Q00266 is amended to update the Performance Work Statement with new period of performance dates (April 1, 2026 through September 30, 2026), add two new sections addressing Privacy and Section 508 accessibility requirements, and update Sections C and E to align with the Revolutionary FAR Overhaul. An organized site visit has been scheduled for Thursday, March 12, 2026, from 10:00 a.m. to 12:00 p.m. MT at GIMC, and the RFQ deadline has been extended to Wednesday, March 18, 2026, at 5:00 p.m. MT. All other terms and conditions remain unchanged.

The contract requires the contractor to provide a mobile CT trailer equipped with either a GE Revolution EVO or GE Revolution Maxima 64-slice system along with an Ulrich Syringeless Contrast Power Injector. The contractor must furnish preventive maintenance and service coverage (available 8:00 AM–9:00 PM, Monday through Friday), system setup and integration, network connectivity to the facility's PACS, a qualified medical physicist for safety testing, comprehensive insurance, and system orientation by an OEM-certified specialist. The Government will furnish the site preparation with electrical power, PACS network access, consumable supplies, and government-assigned technologists. This is a total small business set-aside based on brand-name justification; price reasonableness will be determined through competitive quotations. Evaluation criteria include Technical Capability, Quality Control Plan, Delivery Time, and Price. Offerors must submit technical capability statements, quality control plans, and supporting documentation via email to the Contract Specialist, with all contract terms and Federal Acquisition Regulation clauses, including HIPAA Business Associate Agreement requirements and Section 508 accessibility standards (WCAG 2.1 Level AA), incorporated into the solicitation.

NAIHS-ACQ-08 CONTRACTING OFFICER’S REPRESENTATIVE NOV 2025

(a) Definition. “Contracting Officer’s Representative (COR)” means an individual, including a contracting officer’s technical representative (COTR), designated and authorized in writing by the contracting officer to perform specific technical or administrative functions.

(b) Per FAR Subpart 1.404(a): The Contracting Officer (CO) determines that this contract requires a Contracting Officer Representative (COR).The Contracting Officer Representative (COR) is:

Aaron Yuselew, Diagnostic Medical Imaging Supervisor

(c) Upon award, the COR will receive a copy of the written designation, specifying the extent of the COR’s authority on behalf of the CO.

(d) Limitations.

(1) The COR has no authority to make any commitments or changes that affect price, quality, quantity, delivery, or other terms and conditions of the contract.

(2) The COR must not direct the contractor or its subcontractors to operate in conflict with the contract terms and conditions.

NAIHS-ACQ-09 UNAUTHORIZED COMMITMENTS NOV 2025

(a) Definitions.

Contracting Officer means a person with the authority to enter into, administer, and/or terminate contracts and make related determination and findings.

Ratification means the act of approving an unauthorized commitment by an official who has the authority to do so.

Unauthorized Commitment (UAC) means an agreement that is not binding solely because the Government representative who made it lacked the authority to enter into that agreement on behalf of the Government.

(b) Policy.

The Government is not bound by agreements with, or contractual commitments made to, prospective contractors by individuals who do not have delegated contracting authority. Unauthorized commitments do not follow the appropriate process for the expenditure of Government funds. Consequently, the Government may not be able to ratify certain actions, putting a contractor at risk for taking direction from a Federal official other than the contracting officer (see FAR 1.403-2) Government employees responsible for unauthorized commitments are subject to disciplinary action. Contractors perform at their own risk https://www.fda.gov/media/138740/download when accepting direction from unauthorized officials. Failure to follow statutory and regulatory processes for the expenditure of Government funds is a very serious matter.

(c) Procedure.

Any agreement, modification, or change to a contractual agreement made by a government personnel who lack authority will be deemed an unauthorized commitment. The Government is not liable to the Contractor or under the terms of the contract, financially or otherwise – unless the unauthorized commitment successfully passes the ratification process.

The ratification process does not have any lead time, nor does the Government make any promise that an unauthorized commitment will be ratified and, therefore, the Contractor would be paid. The Contractor proceeds at its own risk if any of the terms of the contract are altered, changed, or modified without the written concurrence by a Contracting Officer.

NAIHS-ACQ-18 COVERED ENTITIES AND BUSINESS

ASSOCIATES

APR 2025

The Standards for Privacy of Individually Identifiable Health Information ("Privacy Rule") establishes, for the first time, a set of national standards for the protection of certain health information. The U.S. Department of Health and Human Services ("HHS") issued the Privacy Rule to implement the requirement of the Health Insurance Portability and Accountability Act of 1996 ("HIPAA").1 The Privacy Rule standards address the use and disclosure of individuals' health information—called "protected health information" by organizations subject to the Privacy Rule

— called "covered entities," as well as standards for individuals' privacy rights to understand and control how their health information is used. Within HHS, the Office for Civil Rights ("OCR") has responsibility for implementing and enforcing the Privacy Rule with respect to voluntary compliance activities and civil money penalties.

A major goal of the Privacy Rule is to assure that individuals' health information is properly protected while allowing the flow of health information needed to provide and promote high quality health care and to protect the public's health and well being. The Rule strikes a balance that permits important uses of information, while protecting the privacy of people who seek care and healing. Given that the health care marketplace is diverse, the Rule is designed to be flexible and comprehensive to cover the variety of uses and disclosures that need to be addressed.

Individuals, organizations, and agencies that meet the definition of a covered entity under HIPAA Rules at 45 CFR

160.103 must comply with the Rules' requirements to protect the privacy and security of health information and must provide individuals with certain rights with respect to their health information. If a covered entity engages a business associate to help it carry out its health care activities and functions, the covered entity must have a written business associate contract or other arrangement with the business associate that establishes specifically what the business associate has been engaged to do and requires the business associate to comply with the Rules’ requirements to protect the privacy and security of protected health information. In addition to these contractual obligations, business associates are directly liable for compliance with certain provisions of the HIPAA Rules.

Under this contract the contractor and its employees agree to the Business Associate Agreement labeled as Attachment C that has been incorporated into this solicitation or contract.

PERFORMANCE WORK STATEMENT (PWS)

LEASE/RENTAL OF MOBILE COMPUTED TOMOGRAPHY (CT) TRAILER UNIT

General Information

1. GENERAL:

This contract is for the provision of Mobile Computed Tomography (CT) Trailer Unit. The contractor shall provide all personnel, equipment, and materials necessary to fulfill the contract requirements in accordance with applicable federal and Indian Health Service (IHS) regulations. All services shall be delivered independently by the contractor, who shall be fully responsible for the performance and conduct of their equipment and for ensuring compliance with the contract terms.

1.1. Indian Health Service (IHS):

The Indian Health Service (IHS), an agency within the U.S. Department of Health and Human Services, is responsible for providing federal health services to American Indians and Alaska Natives. The provision of health services to members of federally recognized Tribes is based on the special government-to-government relationship established in 1787 under Article I, Section 8 of the U.S. Constitution. This relationship has been further defined through treaties, laws, Supreme Court decisions, and Executive Orders.

IHS serves as the principal federal health care provider and health advocate for Indian people, with a mission to raise their health status to the highest possible level. The agency delivers a comprehensive health service system across a wide range of clinical settings and programs for American Indians and Alaska Natives.

Navajo Area Indian Health Service (NAIHS):

NAIHS is one of twelve regional administrative units within IHS. It serves a user population of over 244,000 American Indians across five federal service units located on or near the Navajo Nation. The Navajo Nation— one of the largest Indian reservations in the United States—spans more than 25,000 contiguous square miles across portions of Arizona, New Mexico, and Utah, including three satellite communities.

NAIHS delivers health care primarily to members of the Navajo Nation and the San Juan Southern Paiute Tribe and also extends services to other Native American groups, including the Zuni, Hopi, and others. The five Federal Service Units include: Chinle, Crownpoint, Gallup, Kayenta, and Shiprock.

Gallup Indian Medical Center (GIMC):

Gallup Indian Medical Center is a 99-bed hospital located in Gallup, New Mexico, near the Navajo Reservation.

The facility provides a broad range of medical specialties, including Internal Medicine, Cardiology, Anesthesia, OB/GYN, General Surgery, Orthopedics, Ophthalmology, ENT, Radiology, Pathology, Pediatrics, Psychiatry, Emergency Medicine, and Urology.

GIMC is one of the highest-volume service providers within the Indian Health Service, with over 250,000 outpatient encounters and 5,800 inpatient admissions annually. It also has the largest workforce among Navajo Area IHS facilities.

1.2. Description of Services / Introduction:

The contractor shall furnish all equipment, supplies, facilities, transportation, tools, materials, and other resources required to provide Mobile Computed Tomography (CT) Trailer Unit services as outlined in this Performance Work Statement, except for those items identified as government-furnished property or services. All work shall be performed in accordance with applicable contract requirements, performance standards, and regulatory guidelines.

1.3. Background:

The request for a secondary CT scanner is driven by the increasing volume of imaging exams required to support clinical operations. An additional CT unit is necessary to meet the growing demand for diagnostic imaging and to help maintain timely access to care. Deployment of a secondary scanner will also support the separation of outpatient and Emergency Department (ED) imaging workflows, thereby enhancing operational efficiency, reducing patient wait times, and improving adherence to infection control and patient safety protocols.

1.4. Objectives:

To address the increased demand for CT imaging and enhance patient throughput, the government requires a mobile CT unit equipped with either a GE Revolution EVO or GE Revolution Maxima system, along with an Ulrich Syringeless Contrast Power Injector. The purpose of this unit is to support operational capacity by accommodating higher imaging volumes, minimizing patient wait times, and separating outpatient and Emergency Department (ED) imaging workflows to improve overall efficiency and infection control measures.

1.5. Scope:

The Gallup Service Unit requires the lease of a mobile CT unit housed in an approximately 50-foot-long by 8.5-foot-wide trailer, to be deployed at Gallup Indian Medical Center (GIMC), 516 E. Nizhoni Blvd, Gallup, NM 87301. The trailer shall be positioned on a level, load-bearing pad capable of supporting a unit weighing approximately 30,000–40,000 pounds.

This mobile CT unit is intended to expand diagnostic imaging capacity in response to a sustained increase in patient volume. It will be primarily used to support outpatient imaging services, allowing the facility to separate outpatient workflows from Emergency Department imaging. This separation will improve operational efficiency, reduce patient wait times, and enhance infection control by minimizing patient traffic crossover between clinical areas.

1.6. Period of Performance:

The period of performance is expected to begin on April 1, 2026, and continue through September 30, 2026.

This requirement is driven by increased demand for diagnostic imaging services and the operational need to separate outpatient and Emergency Department (ED) workflows to enhance patient flow, safety, and infection control.

Optional extension periods may be exercised based on ongoing operational requirements, with specific dates to be determined by the Contracting Officer.

The mobile CT unit, equipped with either a GE Revolution EVO or GE Revolution Maxima system along with a Ulrich Syringeless Contrast Power Injector, shall be delivered and fully installed no later than one week prior to the start of the performance period. Delivery shall be FOB Destination.
