This is Amendment 0 to Solicitation 75H70627R00003, issued by the Aberdeen Area Indian Health Service on October 9, 2026, for OB/GYN physician services and nursing support at the Federal Building in Aberdeen, South Dakota.

The amendment extends the offer due date to October 22, 2026, at 12:00 p.m. Central Time and provides answers to ten vendor questions. Key solicitation changes include: revision of the SAM.gov notice to reflect an Indian Small Business Economic Enterprise (ISBEE) set-aside with a $34.0 million size standard; incorporation of applicable Service Contract Labor Standards provisions and FAR 52.222-41 and 52.222-43 clauses with wage determination 2015-5377 Rev. 32; addition of Buy Indian Act provisions (FAR 52.219-14 and HHSAR 352.226-6) with limitations-on-subcontracting requirements; inclusion of an HHSAR 352.237-73 declaration in Section J; and revisions to the Performance Work Statement (PWS) clarifying clinic operations. The revised PWS establishes clinic coverage on Tuesdays and Wednesdays from 8:00 a.m. to 8:00 p.m., approximately 1,160 hours annually, with one qualified nursing support staff member anticipated to be sufficient. The contractor must provide $1,000,000 per incident and $3,000,000 aggregate professional liability insurance. The anticipated contract start date is November 8, 2026, structured on a Firm-Fixed-Price, Month-of-Service basis with prorated payment for partial months and no additional cost for contractor-caused makeup clinics. The requirement follows prior Contract No. 75H70621C00009.

E. The solicitation is amended to incorporate the applicable Buy Indian Act and limitations-on-subcontracting provisions and clauses.

F. The solicitation is amended to include the declaration referenced by HHSAR 352.237-73 in

Section J.

G. The Performance Work Statement (PWS) is revised to clarify the clinic schedule, estimated annual level of effort, nursing support requirements, professional liability insurance requirements, and other changes identified in the

Government's responses to vendor questions.

H. The revised PWS is incorporated into the solicitation and supersedes the previous version in its entirety.

All other terms and conditions remain unchanged.

Question 1. Hours to price.

PWS §7.1 sets clinic Tuesday–Wednesday, 8:00

AM–8:00 PM (~1,160 hours per year), but PWS §7.2 and §18.2 estimate 832 hours per year. Which should offerors price, and is the clinic held every week?

Answer: Offerors shall price based on clinic coverage two (2) days per week, Tuesday and

Wednesday, from 8:00 a.m. to 8:00 p.m., for both the OB/GYN physician and nursing support. The anticipated annual level of effort is approximately 1,160 hours per year. The 832-hour estimate in the current PWS does not reflect the intended annual coverage requirement and will be revised.

Question 2. Set-aside type.

SAM.gov lists an Indian Economic Enterprise (IEE) set-aside; Synopsis §D states an Indian Small

Business Economic Enterprise (ISBEE) set-aside with a $34.0M size standard. Which applies?

Answer: This requirement is an Indian Small

Business Economic Enterprise (ISBEE) set-aside.

SAM.gov will be corrected, if necessary, to reflect the ISBEE set-aside. Under HHSAR

326.603-1, IHS gives priority to ISBEEs to the maximum extent practicable, and HHSAR 352.226-4 specifically addresses ISBEE set-asides.

Question 3. Service Contract Act clauses.

SCA Wage Determination 2015-5377 Rev. 32 is attached, but FAR 52.222-41 and 52.222-43 are not listed. Will they be added for the nursing CLIN?

Answer: Yes. The solicitation will be amended to include the applicable Service Contract Labor

Standards clauses. FAR 52.222-41 applies to covered service employees, and FAR 52.222-43 is prescribed for applicable fixed-price service contracts with option periods when FAR 52.222-41 applies. The applicable wage determination will remain incorporated into the solicitation.

Question 4. Buy Indian clauses.

FAR 52.219-14 and HHSAR 352.226-6 are required for Buy Indian set-asides but are not listed.

Will they be added, and does work performed by joint venture members count as the joint venture’s own work?

Answer: Yes. The solicitation will be amended to include the applicable Buy Indian and limitations-on-subcontracting provisions and clauses, including FAR 52.219-14 and HHSAR

352.226-6, as applicable. For a joint venture, compliance with FAR 52.219-14 will be measured based on the aggregate performance of the joint venture participants, subject to all applicable

FAR, SBA, and HHSAR requirements.

Question 5. Section J declaration.

HHSAR 352.237-73 refers to a declaration “found in Section J,” which is not attached. Please provide it or confirm it is not needed at proposal.

Answer: The declaration is not required with the proposal. The applicable declaration will be included with the solicitation/contract documentation and must be completed and signed prior to affected personnel providing services under the contract.

What nursing level is expected (RN, LPN or certified medical assistant), and is one nurse sufficient for both clinic days?

Answer: The PWS does not require a specific nursing support classification. The Contractor shall provide qualified nursing support personnel appropriate to the duties to be performed and within the individual’s applicable scope of practice. Acceptable support may include an RN, LPN, CNA, medical assistant, or other appropriately qualified clinical support personnel, provided the individual possesses the education, certification and/or licensure required for the assigned duties and meets all PWS requirements. The Contractor is responsible for determining the appropriate level of nursing support necessary to support the OB/GYN physician and successfully perform the required services.

One (1) qualified nursing support staff member is anticipated to be sufficient during the scheduled clinic hours, provided all PWS requirements are met.

Question 7. Professional liability.

What minimum professional liability limits apply

(PWS §14.1)?

Answer: The minimum professional liability insurance coverage is $1,000,000 per incident and

$3,000,000 aggregate.

Question 8. Housing.

Is Government housing available for a weekly visiting physician, and at what rate?

Answer: Government housing is not guaranteed and is subject to availability.

Question 9. Prior contract.

Does this requirement follow Contract No.

75H70621C00009, and does the 832-hour estimate reflect hours ordered under it?

Answer: Yes. This requirement follows Contract No. 75H70621C00009. The intended schedule for the new requirement is clinic coverage two (2) days per week, Tuesday and Wednesday, from 8:00 a.m.

to 8:00 p.m., for 52 weeks. The 832-hour estimate Continued ...

Question 10. Clinic volume and procedures.

What are the expected daily patient volume and procedure mix? Does the physician or facility staff perform ultrasound?

Answer: The anticipated patient volume is approximately 30 patients per clinic day. The expected procedures are those within the OB/GYN physician’s approved clinical privileges and identified in the PWS and attached OB/GYN privilege form. Ultrasound services are performed by the facility’s existing ultrasound technician;

the contracted OB/GYN physician is not expected to provide ultrasound technician services.

Question 11. Start date and invoicing.

What is the anticipated start date, and how are partial months and makeup clinics (PWS §7.3) priced and invoiced?

Answer: The anticipated start date is November 8, 2026. The contract will be structured on a

Firm-Fixed-Price, Month-of-Service (MOS) basis rather than an hourly basis. The Contractor shall invoice the applicable monthly CLIN price for satisfactorily performed and accepted services.

For any partial month of performance, the

Government will prorate payment based on the portion of the applicable Month of Service actually required and performed, as specified by the Contracting Officer.

Makeup clinics required due to Contractor-caused service interruptions shall be provided at no additional cost to the Government and shall not result in a separate invoice or additional MOS payment.
