RFP 75H70422R00006 Fiscal intermediary (FI) services – Amendment 00001 – Questions and Answers

Page # Section Title Questions Answers

General Question Unless specifically stated, can it be assumed that all days are to be considered as business days?

Unless specified as business days – calendar days are used in the RFP and Contract Terms.

5 B.2 Contract Pricing Is this a time-and-materials contract or a firm fixed price based on price per claim?

This is a time-and-materials contract and aggregated costs will be reimbursed as fixed price based on price per claim with cascaded Contract

Line Items (CLINs) structure.

8 1.2 Background Exhibit A is listed but not included. Exhibit A has been added to the RFP.

3.1.0 Task II – Claims Payment

and Recovery 3.1.27

Does IHS anticipate the functionality to pay providers via EFT will be needed during this contract period?

Currently the providers are all paid via paper check. This may be a possibility in the future.

21 3.3.0 Task III -

Reimbursement Methods

Should claims still be priced at PRC Rates, as this is missing.

The PWS has been amended; this section now references PRC Rates.

24 3.4.9.2.1

3.4.9.2.2

Sections list Exhibit B, but there was no attachment for Exhibit B.

Exhibit B has been added to the RFP.

25 3.4.9.3 Please clarify this requirement as reports are not real-time.

Associated data/information stored in the contractor’s system must be compiled in the required reporting format and readily available to the IHS Officials via real time system access.

26 3.4.14 Payment Information "The contractor shall work with UFMS...and outbound CHS/MIS obligations..." Should this be

"...and outbound UFMS obligations..."?

The contractor shall work with UFMS support staff on any issues encountered with the transmission of FI Payment Claims to UFMS and the transmission of CHS/MIS obligations to FI.

The contractor will resolve any issues with file transmissions to eliminate any errors in both inbound and outbound interfaces.

Attachment A

26 3.4.14 Payment Information Please provide the maximum amount previously needed for Overdraft Funding.

Contractor shall consult with the COR if the overdraft amount exceeds $500,000.

37 5.6 Annual Reports

5.6.6

Does Medicare Fee Schedule Pricing need to be based on individual MAC information? Currently it is based on CMS publications of pricing information.

The information from the MAC is the same information on the Medicare Fee Schedule. CMS does direct communications regarding this to the

MAC.

38 5.7 Ad Hoc Reports Please clarify if ad hoc requests from Tribal Programs also require COR approval prior to initiation.

Complex or new routine reports from Tribal

Programs will require COR approval prior to initiation.

39 QASP 1 Please define what constitutes critical system downtime.

Critical downtime refers to any period in excess of 12 hours in which claims processing is suspended due to system breakdown, errors, etc.

40 QASP 2 Please clarify that the monthly report is for clean claims only.

The monthly report shall detail clean claims that are past the 30 days processing requirement.

40 QASP No. 2 Please clarify the need to coordinate with the SU on coverage information within 3 days if 99.9% of clean claims shall be processed within 30 days of receipt.

The timeframe is very short given 29 days to complete processing the claim.

IHS is the payor of last resort and the coverage must be verified prior to payment being made.

The requirement for SU coordination only applies to those instances in which the PDO and claim conflict.

40 QASP No. 3 Please clarify what constitutes a critical documentation error.

A critical documentation error refers to any inaccuracy or miscalculation so egregious that it substantially changes the reporting outcomes.

Note: QASP No. 3, Task IV –

Data/Information/Reporting also applies to PWS section No. 3.4.9.3.

41 QASP No. 4 Please clarify what constitutes "accepted by the COR". A deliverable is considered accepted if it is received and not disputed by the recipient within the 30-day period after receipt.

41 QASP No. 5 Please clarify what constitutes a "request" and what constitutes a "task".

With regard to helpdesk support services, a request is a call or email inquiry received from a provider, PRC program staff, etc. Tasks are the activities required to respond to, address and close the request.

42 QASP No. 8 Please clarify the requirement. Is this regarding provider disputes with initial payment amounts or with Medicare outliers? The MLR reimbursement methodology accounts for outlier payments, there is no separate payment. Is this a request for a separate report on what claims paid outliers?

The requirement refers to instances in which a provider disputes the initial reimbursement amount and the final payment amount is above the Medicare-like rate. This report will identify all payments made above the Medicare-like rate and any disputed cases that are not settled within

14 calendar days.

42 QASP No. 9 Please clarify the requirement. The PDO should specify any alternate resources the IHS patient has in place. Different states Medicaid programs can be very restrictive in the services allowed; does this requirement imply that the contractor should not pay medical claims if a patient has any form of Medicaid?

Some forms of Medicaid are for limited coverage conditions only. More information should be requested from the service unit to ensure the Medicaid is a viable alternate resource.

42 QASP No.10 Please clarify if this requirement applies to EOBs generated by the contractor for provider payments made.

The EOBs in this section applies to the EOB provided by the outside vendors.

47 Section E - Inspection and

Acceptance

There are two "Section E" with different requirements. This section has been removed; see the updated

PWS.

SECTION C- DESCRIPTION / SPECIFICATIONS / PERFORMANCE WORK

STATEMENT

1.0 General

1.1 Introduction. The purpose of this procurement is to acquire fiscal intermediary (FI) services to operate a centralized medical and dental claims processing and reimbursement system. The FI will collect, compile and organize workload and financial data, assist the Indian Health Service

(IHS) in the coordination of benefits and provide statistical and financial reports to the IHS

Purchased/Referred Care (PRC) Program. The FI shall calculate reimbursement rates in accordance with regulations and the IHS payment policy and ensure that the IHS is the payer of last resort for services provided to patients. The Contractor will participate in the solution of problems and issues that arise in the conduct of this contract. Under this contract, FI services will also be made available to Tribal PRC programs operated under the Indian Self-

Determination and Education Assistance Act (ISDEAA), Public Law 93-638, as amended.

For more information on the PRC Program, visit the IHS website at http://www.ihs.gov/prc.

1.2 Background. The IHS has a responsibility to provide health care services to eligible

American Indian and Alaska Natives (AI/AN). Direct health care services are provided through

IHS-operated and Tribally-operated hospitals, clinics and health care programs. IHS supplements its direct health care services by purchasing basic and specialty health care services from non-IHS health care providers through the PRC program. For example, PRC program funds may be used to purchase inpatient hospitalization, physician, laboratory, dental, radiology, and transportation services.

The authority to contract for a fiscal agent is contained in the Consolidated Omnibus Budget

Reconciliation Act of 1985, Public Law 99-272, Section 17003 that “. . . provides authority for the Secretary of the Department of Health and Human Services to contract with fiscal agents to perform claims payment, processing and audit functions with respect to services purchased on a contract basis by the Public Health Service ... Fiscal Agents must either be entities which could qualify as carriers for Medicare purposes, or Indian Tribes or Tribal organizations acting under the Indian Self-Determination and Education Assistance Act (ISDEAA), Public Law 93-638 contracts. While the fiscal agents need not be Medicare carriers, they must meet the same requirements regarding efficiency and effectiveness of operations, surety bonds, and financial controls.”

The PRC program is administered through 12 IHS Area Offices that consist of approximately

170 IHS and tribally-managed service units. These facilities are responsible for determining the eligibility of the patient and for purchasing medical services. Each IHS facility uses the

Purchase Delivery Order (PDO) for Health Services form (IHS 843-1A) (Exhibit A) to procure

PRC. The PDO form is also commonly referred to as, a "treatment authorization” because it authorizes the medical and dental care provider to render the health care treatment(s) requested by the respective PRC program.

The PRC program is limited by Congressional appropriations and must rely on compliance with medical and dental priorities and regulations to ensure the most effective use of PRC dollars.

75H70422R00006 Amendment-00001 Page 9 of 89

Regulations require PRC to be approved in advance by authorized individuals, except in emergency cases.

1.3 Workload. The contractor will be responsible for processing, making adjustments, reimbursements, payments and payment recoveries for approximately 466,000 medical and dental claims annually. The contractor will conduct voucher examination activities for all PRC claims to ensure payments are timely and accurate. The contractor must have the ability to receive daily transmissions from the IHS Area Offices that contain all data for PRC PDO’s subject to payment by the contractor and transmit payment information directly to Unified

Financial Management System (UFMS). The contractor will also be responsible for coordinating patient benefits to ensure that IHS is the payer of last resort on all medical and dental claims. The contractor will have the capability to contact approximately 600 primary insurers, providers, and SU staff monthly to obtain alternate resource information needed to process claims. The contractor will have the ability to respond to approximately 200 written inquiry cases monthly. The contractor shall have Customer Service staff available to respond to approximately 6,000 call per month from IHS and providers between the hours of 8:00 AM to

5:00 PM Central Standard Time to answer claims processing questions.

1.4 Performance Based Requirements. This contract is for FI services which includes a centralized medical and dental claims processing and reimbursement system for IHS in accordance with regulations, policies and standards as specified in this contract and exhibits.

3.2.6.0 DENTAL CLAIMS

https://www.fiscal.treasury.gov/dms/about/about-dcia.html

75H70422R00006 Amendment-00001 Page 19 of 89

The IHS dental program’s procure third party administrative services to meet the following objectives, simplify the administration of the PRC program; promote consistent and equitable deployment of PRC funds among individuals, local programs, and IHS Areas; expand the scope of the dental care services through efficient and effective Third Party Administration; and assure the highest level of quality dental services to AI/ANs.

PRC funds are used to provide emergency dental care coverage, reimburse private dentists who operate in IHS facilities, provide routine care services to communities distant from IHS facilities, provide services of dental specialists when treatment exceeds the competencies of IHS staff, and pay for dental laboratory services.

3.2.6.1 The Contractor shall establish a computer software program for maintaining each program as a separate client.

3.2.6.2 The Contractor shall provide a dedicated dental claims processing component to assure accurate adjudication and administration of IHS dental claims consistent with the requirements of this contract.

3.2.6.3 Schedule of Services:

Health care services are not an entitlement for AI/AN beneficiaries. In lieu of a benefits package the IHS has established medical priorities to guide the programs in the delivery of service and the expenditure of PRC funds. The dental program has developed the Schedule of Services and the referral types to suggest logical service priorities for payment. Additionally, the schedule details the limitations and exclusions which apply for each American Dental Association (ADA) procedure as appropriate. The Schedule of Services is intended as a guide to the proper use of PRC funds in order to provide services based on and consistent with sound dental public health principles. See https://www.ihs.gov/doh/clinicmanagement/ohpg/Chapters/Chapter%205%20Tab le%20of%20Contents.html, Section D, IHS Schedule of Dental Services for further details.

Under this contract the Schedule will provide the authorized services, limitations and exclusions template common to each “client.” For those programs with negotiated contracts in place, the Contractor’s system must accommodate the specification of services and incorporate the filed fees of these contracts.

These will supplant the schedule of service elements as the template for all providers with Government contracts. The Dental Professional Specialty Group will provide direction to the Contractor as to what levels of dental care will be paid.

3.2.6.4 Referrals

The IHS has developed specific referral types to assist dental programs in further delineating the authorization of PRC funds. The appropriate referral type must be entered prominently on the IHS PDO and becomes a further modifier to the authorized services template. Referral types apply both to the contract and open market providers. The referral types and their codes are as follows:
