This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2024-03.

B.1 Schedule of Items The contractor shall perform all work under this purchase order in accordance with all terms and conditions of the attached Statement of Work (SOW).

B.2. Pricing Data Submission: In order to determine price fair and reasonable in accordance with FAR 13.106-3, the contracting officer may request that pricing data be submitted to show the breakdown of costs for the above CLINs at any time after receipt of quotes. Upon such a request, quoters may be required to provide a total line item break down of all costs including overhead and profit showing how they arrived at the total lump sum quoted price. The Contracting Officer reserves the right to require submission of a detailed breakdown of subcontract services, including labor, material, profit, overhead, and other costs incidental to the performance of the work. The Government will use these figures to evaluate quoter’s costs and to ascertain that all factors have been taken into consideration.

B.3. Submit invoices in accordance with HHSAR 352.232‐71, Electronic Submission of Payment Requests (Feb 2022) and Section G.5.

IMPORTANT INFORMATION:

Under no circumstances will any oral statements made be binding upon the Government unless such statements or agreements are issued in writing by the Contracting Officer.

Only a warranted Contracting Officer acting within their delegated limits has the authority to issue modifications or otherwise change the terms and conditions of this contract. If an individual other than the Contracting Officer attempts to make changes to the terms and conditions of this contract, you shall not proceed within the change and shall immediately notify the Contracting Officer.

SECTION C

DESCRIPTION/SPECIFICATIONS/WORK STATEMENT

2025 Facility Budget Estimating System

Establish Accurate Construction Cost Data Special Location Factors (within the “Lower 48” States)

1.0 Purpose

1.1 The purpose of this SOW is to establish accurate Construction Cost Data Special Location Factors for use in the Indian Health Service’s (IHS) Facility Budget Estimating System (FBES) in FY 2025. These Location Factors are located within the “Lower 48” States, meaning they do not include locations within the States of Hawaii or Alaska.

2.0 Background

2.1 Special Location Factors are used within the FBES to account for the variation in construction costs in different geographic locations. Each geographic location where IHS facilities are located and constructed has its own location factor and represents a deviation from a national average. When estimating the construction cost for a specific project in a specific location, the FBES adjusts the base unit construction costs (the cost per square foot to construct various kinds of IHS facilities) by multiplying them by the location factor wherein the project is located.

2.2 The required locations for which Special Location Factors shall be developed via this Statement of Work (SOW) are included herein below, as well as in the attachment.

2.3 Development of the Special Location Factors shall be performed by professional construction cost estimators with a minimum of five years’ experience in estimating health care projects and using CoreLogic Marshall Swift MVS.

2.4 The selected Contractor shall provide the Special Location Factors as stated in Section 4.1.

3.0 Standard Location Factors

3.1 The primary source of Standard Location Factors is the Marshall & Swift Valuation Service (MVS) Section 99, Local Multipliers Data. The MV factors for Class A construction are used for this purpose.

3.2 Standard Location Factors are not included within this SOW (which is developed specifically for Special Location Factors). This Section is for informational purposes only.

4.0 Special Location Factors (“Lower 48” States)

4.1 Develop Special Location Factors for the “Lower 48” states by conducting market research for each of the following locations:

4.2 The Contractor shall conduct the necessary market research for development of Special Location Factors.

4.3 As part of the response to this RFP, the Contractor shall provide a detailed description of the market research methodology they will use in the final report.

4.4 Provide a complete listing of previous Special Location Factors used by the IHS and comparison to new factors, as well as an explanation for significant discrepancies from the previous year. (over 5% difference).

IHS historic Special Location Factors are provided in the attachment.

4.5 Upon review, the Contractor shall provide an explanation and resolution for Specific Location Factors that appear incongruent with other factors in similar locations.

5.0 Acceptance StandardsAcceptance of the Special Location Factors is dependent upon resolution of discrepancies as described above.Acceptance of Special Location Factors is dependent upon resolution of other discrepancies that may become apparent when IHS uses the FBES in the preparation of the FY 2025 New Construction Facility Budget Estimates (through January 2025).Deliverables

6.1 Interim Status Update Reports. Provide an assessment of the percentage complete and confirmation that Draft and Final Deliverables will be submitted on schedule. Provide an explanation for significant discrepancies from the previous year (over 5% difference).

6.2 Special Location Factors Report. Provide the Draft and Final Submittal according to the requirements in Section 4.0 and 7.0. Include the following:

(1) Narrative describing the methodology used to prepare the special location factors for the “Lower 48” states.

(2) Listing of Local Multipliers with Class A, B, C, D, and S construction that are similar to those in the MVS publications.

(3) Copy of Local Multiplier Form used in each location.

7.0 Milestone Schedule for Deliverables

7.1 Conference calls between the Contractor and IHS may be conducted in relation to each report. The Draft Submittal shall include the completion of all work to be performed. The Final Submittal shall incorporate any revisions required as determined by a review by IHS of the Draft Submittal.

5.0 Special Location Factors

5.1 Develop Special Location Factors within the State of Alaska by comparing overall costs, materials, mobilization, heavy equipment transportation and rental, site preparation, utilities, fire protection, weather & seasonal impacts, and labor of projects in a specific location to National Average Costs. To the maximum extent possible, costs should be based on actual constructed projects from a specific area and should include differences in material and labor costs, specific design and construction problems of a location, and features common to that area. Create a table which quantifies the cost impacts for locations listed. Use the following assumptions unless contradicted by actual construction costs:

Base cost on an appropriately sized facility for the Alaskan community. Create a table that lists type and size of typical facilities for each location.

Energy costs in Alaska are typically significantly higher than national averages. Adjust building envelope, mechanical system and electrical system costs to reflect levels of insulation, efficiency and performance required for sustainable facilities.

Alaskan Communities not on road system: Equipment such as cranes, loaders, dump trucks, pile drivers etc.

are typically not available locally. Include in mobilization costs shipping to the community, lease costs which reflect the seasonal shipping window for the community, and delays related to no locally available parts or service facilities.

Alaskan Communities in locations with discontinuous or continuous permafrost: Include costs associated with active cooling of foundation system or other climate change related foundation stabilization requirements. Address other typical building construction costs associated with constructing on permafrost, including arctic water & sewer service, elevated building entrance, heated utility space under 1st floor, managing storm water run-off, etc.

Many locations in Alaska do not have access to a reliable public water supply. In communities which cannot provide piped water and sewer to the facility, include costs for establishing a water source, water treatment and sewage treatment facilities. See paragraph 5.2 for additional guidance.

Small community water utilities which do not serve the majority of the population with piped water and sewer typically do not have the capacity to reliably deliver a large fire flow. For Alaskan communities of less than 10,000 people and without majority of the community on piped water and sewer, assume fire sprinkler service will require a fire water storage tank and associated appurtenances such as insulated/elevated foundation, fire pump, yard piping, and so forth. See paragraph 5.2 for additional guidance.

Freight impact: Some Alaskan communities are “fly in” only, and some communities have seasonal barge service. Both situations impose additional costs associated with logistics. Develop freight costs which address freight shipping impacts.

Cost of room & board: The majority of rural communities in Alaska do not have sufficient locally available skilled tradesmen. Include room and board costs for construction crews, inspectors, technicians, engineers, and managers. See paragraph 5.2 for additional guidance.

Cost of travel: Identify and include costs associated with moving construction crews, inspectors, technicians, engineers, managers etc. to the project location. Include travel time & cost of transportation.

Weather related costs: Alaska has a very short summer construction season. Adjust labor costs to reflect work performed at low temperature and during inclement weather. Include mitigation work such as temporary work enclosures, heating of work spaces during construction, and impacts on shipping and storage.

Local Hire related costs: A necessary element of rural Alaskan construction is to prepare the community with the necessary skills to perform maintenance and repairs to the maximum extent possible. Where possible, local workers are trained and employed. Develop cost associated with local hire recruitment, training and deployment.

General Contractor Overhead & Profit, bond and Insurance: Because of significant employee turnover, weather and logistics related risks, projects in rural Alaska typically have significantly higher margins.

Include location relevant GC O&P, bonding & Insurance.

5.2 Assumptions (5), (6), and (8) in paragraph 5.1 might be best addressed as a line item cost when generating a facility budget estimate with the FBES, rather than rolled into locality factors which are used to adjust base unit costs. Therefore, the Contractor, in one of the Interim Status Update Reports, shall make a recommendation to IHS whether they should be included in the development of Special Location Factors.

5.3 Compare the Anchorage Special Location Factor developed under Section 5.1 to the published MVS Standard Location Factor for Anchorage. Analyze any difference. Based upon the analysis, normalize the Alaska Special Location Factors to MVS Anchorage Standard Location Factor.

5.4 Deliverables include a matrix for each location which shows the base construction cost and location adjustments for materials, mobilization, heavy equipment transportation and rental, site preparation, utility connections, fire protection, weather and seasonal impacts, and labor.

5.5 Provide a complete listing of previous location and size factors used by the IHS and comparison to new factors, as well as an explanation for significant discrepancies (over 15% difference). IHS historic location factors within the State of Alaska are provided in the attachment.

5.6 Unless prior approval is obtained, the scope shall be limited to examination of existing and reported data with no field trips or onsite inspections. Wherever available, building plans, record drawings, and specifications will be provided for the Contractor's review.

6.0 Acceptance StandardsAcceptance of the Special Location Factors is dependent upon resolution of discrepancies as described above.Acceptance of Special Location Factors is dependent upon resolution of other discrepancies that may become apparent when IHS uses the FBES in the preparation of the FY 2025 New Construction Facility Budget Estimates (through January 2025).Deliverables

7.1 Interim Status Update Reports. Provide an assessment of the percentage complete and confirmation that Draft and Final Deliverables will be submitted on schedule.

7.2 Special Location Factors Report (Alaska). Provide Draft and Final Submittal according to Section 8.0.

Include the following:

(1) Cover Sheet including:

8.1 Conference calls between the Contractor and IHS may be conducted in relation to each report. The Draft Submittal shall include the completion of all work to be performed. The Final Submittal shall incorporate any revisions required as determined by a review by IHS of the Draft Submittal.

SECTION D

PACKAGING AND MARKING

D.1 PACKAGING AND MARKING

(a) All shipments of materials, equipment and/or supplies to the project site shall be addressed to the Contractor and not the Indian Health Service. Preservation, packaging and packing shall be in accordance with industry standard packaging appropriate for the item(s) involved. The Indian Health Service is not responsible in any manner for deliveries intended for the project that are not generated by the Indian Health Service.

(b) Equipment and materials provided by the Contractor shall be new and, where appropriate, shall arrive on-site sealed in original manufacturer’s containers. The Government reserves the right to refuse any items deemed to not meet this requirement.

SECTION E

INSPECTION AND ACCEPTANCE

(a) The Contracting Officer or the duly authorized representative will accept supplies and services to be provided under this contract.

F.1 CONTRACTOR PERFORMANCE EVALUATION

The contractor will be evaluated on the overall general work, quality of work performed, compliance with the Statement of Work, and all matters associated with the requirements of this purchase order.

F.2 CONTRACT TYPE

This is a firm-fixed-price, lump sum, services purchase order.

F.3 PERIOD OF PERFORMANCE

This will be a performance-based service contract with a completion date of November 15, 2024. All work must be completed and accepted by the government by the end date of this purchase order.

SECTION G

CONTRACT ADMINISTRATION DATA

G.1 CONTRACTING OFFICER AUTHORITY

The Contracting Officer (CO) is the individual appointed with the authority to enter into, obligate funds, administer and make related determinations pertaining to the contract on behalf of the federal Government.

The Contracting Officer must sign all contractual documents, including contract modifications, and approve payment requests. The Contracting Officer is the only individual authorized to make changes to the contract.

If an individual other than the Contracting Officer attempts to make changes to the terms and conditions of this contract, you shall not proceed with the unauthorized direction and shall immediately notify the Contracting Officer.

G.2 CONTRACTING OFFICER'S REPRESENTATIVES

a. Contracting Officer's Representatives (COR), may be appointed for the purpose of representing the Contracting Officer and assuring compliance with the contract requirements. The COR is also responsible for the inspection and acceptance of all performance, reports and deliverables, and such other responsibilities as may be specified in the purchase order.

b. The COR has NO AUTHORITY to make any changes to the purchase order documents.

c. Any Contractor request for changes shall be referred to the Contracting Officer directly or through the COR. No such changes shall be made without the expressed prior authorization of the Contracting Officer. The COR may designate Inspector(s) or assistant COR(s) to act for the COR in writing with specific authorities and transmitting a copy of such designation through the Contracting Officer to the Contractor.

G.3 ADMINISTRATIVE MATTERS

a. A list of the names and telephone numbers of the Government team comprising the contract administrator and Contracting Officer’s Representative (COR) will be provided after purchase order award.

b. Only Contracting Officers from the Division of Engineering Services (DES) have the authority to modify the term and conditions of the purchase order.

c. All correspondence shall be addressed to the purchase order’s Contracting Officer, a copy of all correspondence shall be furnished to the contracting officer representative.

d. The Contracting Officer will appoint a Contracting Officer’s Representative (COR) for the purposes of technically administering the task order; however, all matters concerning this purchase order must first be approved by the Contracting Officer. This in no way authorizes anyone other than the Contracting Officer to commit the Government to changes in terms of the purchase order.

G.4 ADDRESS FOR CORRESPONDENCE

a. It is the intent of the Government to use electronic means as much as possible while administering this purchase order.

b. Most correspondence should be sent via e-mail directly to the Contracting Officer. Include the

Purchase Order number on all correspondence. Overnight Mail and U.S. Mail shall be sent to the Contracting Officer, unless otherwise specified, at the following address:

G.5 INVOICE REQUIREMENTS AND BASIS OF PAYMENT

a. Invoices shall be prepared, submitted and paid in accordance with HHSAR 352.232‐71.

b. The Contractor is responsible for delivery of each request for payment electronically using the

Department of Treasury Invoice Processing Platform (IPP) www.ipp.gov or successor system.

Hand delivery to the COR in the field does not constitute delivery to the billing office.

c. Prior to submission of the invoice to www.ipp.gov, invoices shall be submitted with signature for the Contractor certification statement (scanned signature okay) to the CO and COR. The CO and COR will review the request for payment prior to submission to IPP.

d. If the contractor wishes to inquire concerning the status of any pay request, the contractor should contact the Contracting Officer.

e. A completed Release of Claims that complies with the requirements of the “Payments” clause must be submitted with the request for final payment. A sample format is available from the Contracting Officer.

f. The final payment request will be rejected and returned to the contractor if all items required under the purchase have not been completed, submitted, approved, and accepted prior to the receipt of the request.

G.6. INVOICE REQUIREMENTS

(a) Invoices shall be prepared, submitted and paid in accordance with the following FAR clauses specified in Section I:

(b) The Designated Billing Office for this contract is the same as the address for correspondence, sent to the attention of the CO. Invoices that have been verified as correct by the COR and shall be emailed to the CO, unless otherwise instructed by the CO. The signed payment invoice shall be sent via e‐mail to the IHS Contracting Officer.

(c) The final invoice must be marked “Final” and be accompanied by a Release of Claims form, which lists the final payment as outstanding, in the Remarks field. The Release of Claims form is available from the CO. Final payment will be made within 30 Calendar days upon receipt of a properly executed invoice.

(d) The contractor will contact the Designated Billing Office with any payment issues or concerns.

Note: In accordance with FAR 52.232‐40, Providing Accelerated Payments to Small Business Subcontractors (Mar 2023) ‐‐ Upon receipt of accelerated payments from the Government, the Contractor shall make accelerated payments to its small business subcontractors under this contract, to the maximum extent practicable and prior to when such payment is otherwise required under the applicable contract or subcontract, after receipt of a proper invoice and all other required documentation from the small business subcontractor. This applies to all small business subcontractors at all tier levels.

G.7. CERTIFICATION OF PAYMENTS - RELEASE OF CLAIM

The Contractor, when submitting final payment under this contract, shall submit to the Contracting Officer:

(a) A certification that the Contractor has made payment from proceeds of prior payments, or that he will make timely payment from the proceeds of the progress or final payment then due him, to any subcontractors and suppliers in accordance with established contractual arrangements; and

(b) A properly executed Contractor's Release. The Release of Claims form is available from the Contracting Officer. Failure to submit this completed release will result in a delay of final payment.

SECTION H

SPECIAL CONTRACT REQUIREMENTS

H.1 SENSITIVE INFORMATION STORAGE

Sensitive But Unclassified (SBU) information, data, and/or equipment will only be disclosed to authorized personnel on a Need-To-Know basis. The contractor shall ensure that appropriate administrative, technical, and physical safeguards are established to ensure the security and confidentiality of this information, data, and/or equipment is properly protected. When no longer required, this information, data, and/or equipment will be returned to Government control, destroyed, or held until otherwise directed. Destruction of items shall be accomplished by following NIST Special Publication 800-88, Guidelines for Media Sanitization.

The disposition of all data will be at the written direction of the COR, this may include documents returned to Government control; destroyed; or held as specified until otherwise directed. Items returned to the Government shall be hand carried or sent by certified mail to the COR.

H.2 PROTECTION OF INFORMATION

The contractor shall be responsible for properly protecting all information used, gathered, or developed as a result of work under this task order. The contractor shall also protect all Government data, equipment, etc. by treating the information as sensitive. All information about the systems gathered or created under this contract should be considered as SBU information. It is anticipated that this information will be gathered, created, and stored within the primary work location. If contractor personnel must remove any information from the primary work area they should protect it to the same extent they would their proprietary data and/or company trade secrets. The use of any information that is subject to the Privacy Act will be utilized in full accordance with all rules of conduct as applicable to Privacy Act Information.

The government will retain unrestricted rights to government data. The ordering activity retains ownership of any user created/loaded data and applications hosted on vendor’s infrastructure, as well as maintains the right to request full copies of these at any time.

The data that is processed and stored by the various applications within the network infrastructure contains financial data as well as personally identifiable information (PII). This data and PII shall be protected against unauthorized access, disclosure or modification, theft, or destruction. The contractor shall ensure that the facilities that house the network infrastructure are physically secure.

H.3 CONFIDENTIALITY AND NONDISCLOSURE

The preliminary and final deliverables and all associated working papers and other material deemed relevant by the agency that have been generated by the contractor in the performance of this contract, are the property of the U.S. Government and must be submitted to the COR at the conclusion of the contract. The U.S.

Government has unlimited data rights to all deliverables and associated working papers and materials in accordance with FAR 52.227-14.

All documents produced for this project are the property of the U.S. Government and cannot be reproduced, or retained by the contractor. All appropriate project documentation will be given to the agency during and at the end of this contract. The contractor shall not release any information without the written consent of the Contracting Officer.

Personnel working on any of the described tasks may, at Government request, be required to sign formal non-disclosure and/or conflict of interest agreements to guarantee the protection and integrity of Government information and documents.

H.4 DISCLOSURE OF INFORMATION

Any information made available to the Contractor by the Government shall be used only for the purpose of carrying out the provisions of this contract and shall not be divulged or made known in any manner to any persons except as may be necessary in the performance of the contract. In performance of this contract, the Contractor assumes responsibility for protection of the confidentiality of Government records and shall ensure that all work performed by its subcontractors shall be under the supervision of the Contractor or the Contractor’s responsible employees. Each officer or employee of the Contractor or any of its subcontractors to whom any Government record may be made available or disclosed shall be notified in writing by the Contractor that information disclosed to such officer or employee can be used only for that purpose and to the extent authorized herein. Further disclosure of any such information, by any means, for a purpose or to an extent unauthorized herein, may subject the offender to criminal sanctions imposed by 18 U.S.C.§§1030.

H.5 SUBCONTRACTED SERVICES

Outside associates, consultants or subcontractors may be used to provide specialized service, which the Prime is not equipped to do, in which event, such individuals or firms will be subject to approval by the Contracting Officer. The Government reserves the right to require submission of a detailed breakdown of subcontract services, including labor, material, profit, overhead, and other costs incidental to the performance of the work.
