1475D301-21-R-71805As currently written, the RFP’s Past Performance requirements do not account for an offeror that may submit the experience or past performance of a parent or affiliated company. An agency properly may attribute the experience or past performance of a parent or affiliated company to an offeror where the firm’s proposal demonstrates that the resources of the parent or affiliate will affect the performance of the offeror. See FAR § 15.305(a)(2)(iii); Ecompex, Inc., B-292865.4 et al., June 18, 2004, 2004 CPD ¶ 149 at 5. The relevant consideration is whether the resources of an affiliated company--its workforce, management, facilities or other resources--will be provided or relied upon for contract performance, such that the parent or affiliate will have meaningful involvement in contract performance. West Sound Servs. Grp., LLC, B-406583.4, B-406583.5, July 9, 2014, 2014 CPD ¶ 208 at 14. Please clarify that an offeror is permitted to consider the experience and past performance of its corporate affiliate as “direct experience” where the offeror will be using the resources, management, and personnel of the affiliate to perform the contract by inserting the following language into the RFP: “Offerors who submit past performance and experience information of a parent, sister, predecessor or other affiliated company must describe what involvement such company will have on the instant acquisition. The proposal should clearly indicate how the resources of the parent, sister, predecessor or other affiliate company – its workforce, management, facilities, or other resources – will be provided or relied upon for contract performance. An offeror is permitted to consider the experience and past performance of its corporate affiliate as “direct experience”.

"
Will the survivor member's primary BIN, Processor Control Number, Group ID, Cardholder ID, and other payer help desk phone number (PH) be provided in the eligibility file provided to the PBM?It is the Program's intent to provide this information to the PBM. 21page 12, C.4.2.4.3The requirement states "The PBM shall utilize electronic tools and interfaces that allow program prescribers using e-prescribing software to confirm member eligibility and formulary requirements for a prescription prior to sending the prescription to the network pharmacy (e.g., Surescripts). The system must work in real time and be compatible with most e-prescribing systems. 30Page 13"The PBM may not enact any changes to the pharmacy network that will cause disruption to members without written approval from the WTC Health Program 90 days prior to the prospective change."
Would Client consider adding a threshold to this term to limit scope (e.g. the number of impacted members or size of disruption). Pharmacies consistently move from PSAO to PSAO or close pharmacies, and Vendor may need to restrict pharmacies due to audit, FWA or exclusion which may require changes/disruption.WTC Health Program considers 90 days to be a standard notice time but is aware that other business disruption events can occur and would be expected to be notified of these immediately.
31Page 23"Pharmacy audits are required to ensure that claims submitted to the Program for payment meet the WTC Health Program policies and rules." Could Client provide a copy of the applicable policies and rules for Vendor's review? The policies and rules are the business requirements within this Work Statement, subsequent service agreements and amendments, and any documentation incorporated into the final executed agreement with the vendor.

40Page 30To expand the pool of potential qualified vendors, would Client consider modifying the following minimum requirement as follows: "Three (3) continuous years of experience providing PBM services to a client organization with a group size of sixty thousand (60,000) or more covered lives."WTC Heath Program encourages responses with clarifying information from bidders regarding how closely they can come to meeting the minimum requirements.

49Page 2, Section BX001 CLINS call for a 1 year fixed price for PBM work to be performed with the performance work standard. In the Technical evaluation criteria spreadsheet, financial tab, you ask for individual drug pricing implying this is IDIQ per unit pricing. Please clarify if you will be revising this CLIN to breakout pricing on a per unit basis. This is required at Phase II from finalists, as a Best and Final Offer (BAFO). This corresponds to Financial tab that vendors will complete on Attachment J.5.
50Page 17, C.4.2.7Is the Federal Supply Schedule related to Federal Workers Compensation Federal Fee Schedule billing guidelines? If so, is that a mandatory requirement? Our adjudication platform currently does not support the federal supply schedule in the lesser of logic as this is not industry standard outside of Workers Compensation. We request that the logic be amended to lesser of AWP discount, MAC (where applicable), or U&C (where applicable). This is not a mandatory requirement. Please provide your best value offer to WTC Health Program.
51Page 17, C.4.2.7The nature of Medi-Span MNOY classification can result in single-source generics being bucketed as "MNO" which means the "Y" bucket may not include all generic claims as requested. Does the Program favor MNOY for purposes of guarantee reconciliation in which "MNO" would be considered Brand and "Y" Generic; or would the Program prefer BGA classification whereby all generics (including multi- and single-source generics) are always considered generic for discount guarantee reconciliation purposes.Yes. The MNOY classification is required.
52Page 17, C.4.2.7We see the Program is open to different pricing arrangements - would a combination offer also be acceptable? (ie. Pass-through at Retail and Traditional at Mail)Yes. Please provide the price arrangement that provides your best value offer to WTC Health Program.
53Page 17, C.4.2.7A PBM can support 340b pricing as part of the lesser of logic to the extent that participating pharmacies submit a 340b price at the time of claims adjudication. Please confirm that this is sufficient to meet the requirement. This is sufficient to meet this requirement.
54Page 22, C.4.3.1Can you provide the Program's current formulary documents in Excel? In order to accurately model rebates, we request the following:

- NDC-level file of each formulary

- Flags for any drug that requires prior authorization or step therapy, and the criteria or policy associated with each drug subject to PA or ST

- The benefit design for each formulary (i.e. open, closed, incentive)

- Tiers (if applicable) and what each tier represents (i.e. Tier 1 = generic, 2 = preferred brand, etc)

- Excluded drugsThis information can be provided for Phase II.
55Page 26, C.7Should the Operations Manual referenced in this section, to be provided with Factor 1, concern only the 5 sections included in the rightmost column of the table in Section C.7, or should it cover all of the operational sections in C.4.2, C.4.3, and C.4.5 as well? All operational sections should be included. The sections listed in the rightmost column are plans that were referenced within the SOW that should be maintained as part of the Operations Manual.
56Page 27, C.8In an effort to provide transparency and "real-time" rebate value; would the program be acceptable of 100% pass-through of all rebates and manufacturer admin fee revenue with a monthly payment schedule?WTC Health Program is open to the price arrangement that provides your best value offer.
57Page 61, K.3This contract is commercially competed and awarded. All competitors are quoting industry standard drugs with industry benchmarked pricing using AWP. Drug costs account for well over 90% of the contract value. Services account for a small fraction of total spend. We recommend cost accounting puts an unnecessary burden on the costs with little value. Please consider removing this requirement and changing this procurement to a FAR 12 contract. We will be awarding a commercial contract under FAR 15 procedures and will use the exemption from CAS for commercial items. We have removed the CAS clauses.
58Page 65, L.4.(a)This contract is currently a Part 15 contract calling for cost accounting even though this contract is a commercially competed and awarded contract where FAR Part 12 is the norm for federal government PBM contracts. All competitors are quoting industry standard drugs with industry benchmarked pricing using AWP. Drug costs account for 90%+ of the total contract value. Please consider changing this to a FAR Part 12 contract.See question 57.
59Page 66, L.4.1Please confirm that the page limit for Prior Demonstrated Experience should be five; two for Part A and three for Part B.Yes, that is correct. See factor 2 under "M.3.2 Instructions for each Factor" for more details.
60Page 70, M.3.2Please confirm that Attachment J.6, IT System Security Plan does not count towards the Factor 1 12 page limit.Confirmed. Attachment J.6 will not count towards the 12-page single-spaced limit.
61Attachment J.1Is drug spend counted towards the $700,000 threshold, or only administrative fees?Only costs that can be invoiced on the contract are counted towards the $700,000.00 threshold.
62Attachment J.1We maintain a corporate wide subcontracting plan to address all of our very important subcontracting requirements. Will a corporate subcontracting plan that encompasses all of our subcontracting contracts meet this requirement? Please submit the individual plan on the template provided. Offerors may propose goals and do not have to accept CDC's proposed goals.
63N/ADoes the Program conduct any 340b negotiations? If not, are there plans to do so?No. There are no plans to do so. To the extend an offeror can incorporate its own 340B arrangement to the benefit of WTC Health Program, that should be included in your ultimate offer.
64N/ADoes Service Contract Wage Rates apply to the PBM employees working on this contract?Since CDC has not identified the labor categories which will be utilized under the resulting contract, the offeror shall determine whether employees are exempt or not from SCLS. SCLS are generally applicable.
65Attachment J.5, Financial tabWill the financial tab be updated to reflect the base period and OY 4?The financial tab should be completed with the prospective rates for the plan year(s) in which the contract would be live.
66N/AWill the Program provide a second Q&A opportunity following Phase I? Due to the short period allocated for Phase I, we believe a second Q&A period will help all bidders gain a deeper understanding of the requirements.No. There are no plans to do so.
67N/AThe RFP response template does not appear to give us an opportunity to respond with alternative language to various parts of the RFP, like Section C. Will we be allowed the page limit for alternative contract language? If changes to the SOW correspond to the technical approach, offerors may submit a tracked changes version of the SOW. The submission shall be made as part of Phase II and discussed as a part of the oral proposal.
68N/APlease provide a detailed list of all current clinical and utilization management programs the Program has in place. Please see Section C.4.3.2 of the SOW. The PBM shall have the ability to apply all standard utilization management edits – PA’s, DUR, step therapy, quantity limits, days’ supply limits, prescriber blocks, and others that may optimize medication utilization.
6915 of 72Can the CDC please clarify the preference of what times are required for the call center to be staffed. In one section it states 24/7/365 hours and in another section it states 5 am -- 9 pm ET minimum with 24-hours for on-call: a)Furnish a dedicated toll-free number exclusive to WTC Health Program for incoming service calls, including telephone technology for the hearing impaired and multi-lingual support. The dedicated call center for pharmacies, members, and account management must be staffed 24 hours / 7-days per week/ 365 days per year.
e)Minimum live contact hours of 5am – 9pm ET with 24 hour on-call emergency messaging for returned calls within 4 hours. Does this mean that that an on-call service is acceptable between 9pmET and 5am ET?Yes.
7028 of 72One of the minimum vendor qualifications is that the bidder have "5 continuous years of experience providing PBM services to a client organization with a group size of 100,000 or more covered lives." If we have a client that provided services to over 100,000 unique individuals annually, but whose average daily population is less than 100,000 on a month-by-month basis, does that disqualify us? Please clarify.WTC Heath Program encourages responses with clarifying information from bidders regarding how closely they can come to meeting the minimum requirements.
71Page 59, Section KThe beta.sam.gov lists the NAICS code as 524292 - Third Party Administration of Insurance and Pension Funds, but the solicitation document lists 621498 - All Other Outpatient Care Centers as the NAICS code in Section K. Which NAICS code is correct?NAICS code 524292, Third Party Administration of Insurance and Pension Funds, is the correct NAICS code.
