SPECIAL PROVISION
FOR
SOIL EROSION AND SEDIMENTATION
CONTROL IMPLEMENTATION PLAN
MDNR:OHM:CRP 1 of 3 11/2022
a. General. Perform work in accordance with Section 208 of the Michigan Department of
Transportation, 2020 Standard Specifications for Construction and the Michigan Department of Management and Budget’s Soil Erosion and Sedimentation Control Guidebook, including any supplemental specifications, except as modified herein. Any discrepancies between the MDOT and DTMB requirements shall default to the more restrictive requirement as determine by the Professional.
This work includes writing, submitting, implementing, and maintaining a Soil Erosion and Sedimentation Control (SESC) Implementation Plan.
Soil erosion and sedimentation control (SESC) will be a priority during and after all phases of construction. Following the award of the contract, and prior to the start of earthwork, prepare and issue for approval a SESC Implementation Plan", which indicates the contractor’s intended implementation of SESC on the project including a schedule and sequence. Attached is a checklist to provide assistance in writing the plan. The DTMB SESC Program, upon approval of the implementation plan, will issue to the contractor an Authorization to Proceed with Earth Change form to be posted at the jobsite. Soil erosion and sedimentation control measures included in the construction contractor’s approved implementation and sequencing plan, shall be placed and functioning before the soil is disturbed. All temporary control measures shall remain in place and be maintained until the impacted areas are permanently stabilized.
Identify off-site borrow and waste disposal areas as part of the implementation plan. The same consideration for controlling erosion and off-site sedimentation will apply to the borrow and waste disposal areas as applied to construction areas. When the contractor selects an off-site location for the borrow or waste disposal area, secure a SESC permit from the Authority having jurisdiction (AHJ) for approval prior to use of area(s). Ensure that appropriate SESC measures are implemented when off-site areas are permitted by the AHJ. If DTMB is not the AHJ, provide to the SESC Program a copy of the Part 91 permit received from the AHJ before any off-site earthwork commences.
DTMB’s SESC Program will review the SESC plans to assure they include at a minimum all information required in R323.1703 of Part 91. As a minimum, provide temporary control measures complying with SESC control measures specified on the plans and the attached silt fence detail and specifications.
DTMB SESC Program staff include:
Christopher J. McGarry, SESC Program Manager Phone: 517.388.3045 Email: mcgarryc@michigan.gov DTMB Field Representative – Assigned to projects and identified at the preconstruction meeting
MDNR/OHM/CRP 2 of 3 11/2022
Should anyone have questions regarding the procedures associated with the incorporation of soil erosion and sedimentation control measures into DTMB projects, please feel free to contact the DTMB SESC Program Manager.
b. Construction. All phases of construction and associated earthwork shall be undertaken by the Contractor as scheduled and in accordance with the SESC implementation plan. The SESC Program staff is responsible for ensuring that all SESC measures are properly installed in a timely manner, maintained, and are effectively controlling erosion and off-site sedimentation.
Based on site conditions, the SESC Program inspection team may make minor adjustments to the overall SESC strategy such as relocating or adding silt fence, check dams, or modifying inlet protection controls.
Prior to starting work, the SESC Program Manager will notify the appropriate Part 91 County/Municipal Enforcing Agency of the proposed construction project including off-site borrow and waste disposal areas.
c. Inspections. Regular and post-rain event inspections will be conducted by DTMB Field Representatives with support from the SESC Program Manager. Then Contractor shall continuously monitor the project site and adjacent areas for ineffective SESC measures. At least weekly and after every significant rain (runoff leaves the site) the DTMB Field Representative, accompanied by a Contractor’s representative, will inspect all SESC measures on and off the site and document his/her observations on a SESC Inspection Report Form developed by the DTMB.
The inspection report shall document at a minimum the following:
1) Date of Inspection
2) Name of inspector
3) Name of company representative
4) General weather conditions within last 48 hours
5) Is there a potential for sediment leaving the site?
6) Has sediment left the site since the last report? (Explain in detail) 7) SESC Controls
(a) Are controls installed per plan?
(b) Are the controls effective?
(c) Do the controls require maintenance?
8) Necessary corrective actions and information regarding who was notified and time limits for compliance.
Corrective actions shall be completed within 48 hours of discovery for routine maintenance items including but not limited to removing sediment from behind silt fences or check dams, replacing or adding silt fence, seeding and mulching small areas, and street sweeping. Other necessary maintenance or corrective actions shall be completed as soon as possible but never more than five (5) days after detection.
SPECIAL NOTE: If sediment is impacting or there is a potential for sediment to impact lakes, streams, and wetlands, corrective actions will be completed within 24 hours.
d. Enforcement. Schedule of values for construction shall include separate line items for the sequencing of construction, installation, maintenance and removal of temporary SESC measures, and installation and maintenance of permanent SESC measures. The SESC Program and SESC inspection team will review and approve any payment application where the contractor is invoicing
MDNR/OHM/CRP 3 of 3 11/2022 for SESC work performed. If the contractor fails to install, maintain or remove the controls, the Department of Technology, Management and Budget, with proper notification, will consider stopping work or directing the work to another company and paying with the monies identified in the schedule of values. In the event the cost to remediate exceeds the contracted amount, the original bonding company will be contacted regarding the shortfall.
DTMB may impose fines of at least $500 per day and assess actual damage costs if the contractor refuses to comply with SESC requirements and corrective measures. For bonded projects, the Surety Company will be held responsible for these costs in the event the contractor refuses to perform or is found to be in default.
Enforcement actions are as follows:
1. SESC Program inspects and documents SESC measures and effectiveness using SESC Inspection Report Form. Copies distributed to the Architect/Engineer, Region Supervisor, and SESC Program Manager.
2. If SESC measures are observed to be ineffective, SESC Program will verbally direct the contractor to take appropriate corrective measures and document the action taken. Within 24 hours of issuing the verbal directions, written documentation shall be provided to the contractor.
3. Within 48 hours (24 hours if impacting waterways) of discovery and verbal notification, the contractor shall implement remedial actions. The SESC Program shall provide written documentation to the DTMB Region Supervisor and SESC Program Manager that corrective measures have been implemented by the contractor.
4. If the contractor fails to implement remedial actions within the specified time, DTMB (SESC Program Manager) shall provide written notice, sent certified mail, of Notice of Noncompliance with Part 91 of 1994 PA 451". This notification will outline fines and penalties to be imposed if corrective actions are not undertaken within a specified period of time (time dependent upon nature or the severity of violation).
5. For bonded projects the Surety Company shall be notified by a certified copy of the Notice of Noncompliance.
6. Continued inaction (after a 2nd notice regarding the same issue) by the contractor shall result in DTMB (Director of Design and Construction Division) issuing a Stop Work Order. This order shall specifically identify where work is to cease, and identify a specified period of time that will be granted to the contractor before a third party contractor is hired by DTMB or the Surety Company to perform the required remediation.
7. Multiple Notice of Noncompliance citations (more than three for the same issue) will result in DTMB (Director of Design ad Construction Division) initiating actions to terminate the contract for material breach.
e. Measurement and Payment. The completed work, including writing the plan, scheduling and sequencing, securing approval and implementation will be paid for as part of the Lump Sum contract.
SPECIAL
PROVISION FOR
SLOPE RESTORATION, NON-FREEWAY
MDNR:OHM:CRP 1 of 3 11/2022
a. Description. This work consists of preparing all lawns and slopes on non-freeway projects designated for slope restoration on the plans or as directed by the Engineer and applying topsoil, fertilizer, seed, mulch with mulch anchor, mulch blanket, high velocity mulch blanket and permanent turf reinforcement mat to those areas. Ensure turf establishment is in accordance with section 816 of the Standard Specifications for Construction and Standard Plan R-100 Series, except as modified herein or otherwise directed by the Engineer.
b. Materials. The materials and application rates specified in sections 816 and 917 of the Standard Specifications for Construction apply unless modified by this special provision or otherwise directed by the Engineer. Use the following materials on this project:
1. Seeding mixture as follows:
A. Emergent Wetland Mix in all impacted wetland areas.
B. Slope Stabilization Mix in all other areas.
2. Fertilizer, Chemical Nutrient, Class A.
3. Topsoil Surface, Furnished or Salvaged, 4 inch. Remove any stones greater than 1/2 inch in diameter or other debris from all topsoil.
4. Mulch and Mulch Anchoring, Mulch Blanket and/or High Velocity Mulch Blanket.
5. Permanent Turf Reinforcement Mat (TRM) must be 100 percent synthetic and consist of 100 percent ultraviolet (UV) stabilized polyolefin fibers sewn between two layers of black UV stabilized polypropylene netting with polyolefin thread. The TRM must meet the following “minimum average roll value” requirements:

c. Construction. Ensure construction methods are in accordance with subsection
816.03 of the Standard Specifications for Construction. Begin this work as soon as possible after final grading of the areas designated for slope restoration but no later than the maximum time frames stated in subsection 208.03 of the Standard Specifications for Construction. It may be necessary, as directed by the Engineer, to place materials by hand.
Shape, compact and assure all areas to be seeded are weed free prior to placing topsoil.
Place topsoil to the minimum depth indicated above, to meet proposed finished grade. If the area being restored requires more than the minimum depth of topsoil to meet finished grade, fill this additional depth using topsoil or, at the Contractor’s option, embankment. Furnishing and placing this additional material is included in this item of work.
Ensure topsoil is weed and weed seed free and friable prior to placing seed. Remove any stones greater than 1/2 inch in diameter or other debris. Apply seed mixture and fertilizer to prepared soil surface. Incorporate seed into top 1/2 inch of topsoil.
Apply mulch at a rate of 2 tons per acre. Place mulch anchoring over the mulch at a rate specified in subsection 816.03.F of the Standard Specifications for Construction. Place mulch blanket and high velocity mulch blanket in accordance with subsection 816.03.G of the Standard Specifications for Construction and as shown on Standard Plan R-100 Series.
Install areas constructed with the TRM on prepared (seeded) grades as shown on the plans in accordance with the manufacturer’s published installation guidelines. Anchor the top edge of the TRM in a minimum 6 inch deep trench. Operation of equipment on the slope is prohibited after placement of the TRM. No credit for splices, overlaps, tucks or wasted material will be made.
If an area washes out after this work has been properly completed and approved by the Engineer, make the required corrections to prevent future washouts and replace the topsoil, fertilizer, seed and mulch. This replacement will be paid for as additional work using the applicable contract pay items.
If an area washes out for reasons attributable to the Contractor’s activity or failure to take proper precautions, replacement will be at the Contractor’s expense.
The Engineer will inspect the seeded turf to ensure the end product is well established, in a vigorous growing condition, and contains the species called for in the seeding mixture.
If the seeded turf is not well established at the end of the first growing season, the Contractor is responsible to re-seed until the turf is well established and approved by the Engineer.
If weeds are determined by the Engineer to cover more than 10 percent of the total area of slope restoration, the Contractor must provide weed control in accordance with subsection 816.03.I of the Standard Specifications for Construction. Weed control will be at the Contractor’s expense with no additional charges to the project.
d. Measurement and Payment. The completed work, as described, will be paid for as part of the Lump Sum contract.

DAM MONITORING DURING CONSTRUCTION
OHM:AHP 1 of 2 11-13-2022
a. Description and Background. This work includes monitoring the condition of the existing dam during construction of the proposed bridge. This work includes submittal of dam monitoring plan, EGLE Part 315 Dam Safety permit application (if required), installation of monitoring elements, monitoring, reporting to engineer during monitoring, operation adjustments as required, and removal of the monitoring elements post-construction.
Design of the bridge included considerations for reducing the overall disturbance to the existing dam (e.g., shallow foundation system, lack of deep nearby excavations, etc.), however with the construction proposed, dam monitoring is still required as part of a prudent construction plan.
Matters related to dam monitoring and safety…
