SECTION I – OVERVIEW AND SUBMITTAL INSTRUCTIONS

PURPOSE

The purpose of this RFQ is to procure the Aperture Data Studio data management suite to validate, cleanse, de-duplicate, and enrich data to prepare for migration from the legacy system to the Child Welfare Services-California Automated Response and Engagement System (CWS-CARES).

BACKGROUND

The CalHHS OTSI procures, manages, and delivers technology systems that support the delivery of services to Californians. Within the CalHHS OTSI is the CWDS, which is a collaboration of California State and local government agencies that supports its customers through technology to ensure the safety, permanency, and well-being of children at risk of abuse, neglect, or exploitation. For more information on the CWDS, please refer to its website: https://cwds.ca.gov/.

GENERAL PROVISIONS

The Information Technology General Provisions Non-Cloud Goods & Services (DGS PD 403-ITGP Non-Cloud REV. 02/20/2025) that are published at https://www.dgs.ca.gov/PD/Resources/Page-Content/Procurement-Division-Resources-List-Folder/Required-Language-for-Solicitations-and-Contracts, will be made part of any resulting Agreement. No other terms, conditions, policies, and/or provisions (“Vendor Terms”) contained within any documents provided by the bidder in its bid that are different from or in addition to the terms set forth in this RFQ shall become a part of the resulting Agreement. If any Vendor Terms are included in the bid, the parties expressly agree that Vendor Terms are rejected by the State, are deemed stricken in the resulting Agreement, and shall have no force or effect.

ITEMS REQUESTED FOR QUOTE

Bidders must submit a completed Quote Worksheet (see Exhibit B – Quote Worksheet). The Quote Worksheet must be signed by a person authorized to bind the bidder’s firm contractually (electronic signatures will be accepted).

Responsible Bidder: The CalHHS OTSI may require bidder(s) to submit evidence of their qualifications at such times and under conditions as it may deem necessary. The question of whether a particular bidder is a responsible bidder may involve an evaluation of the bidder’s experience, type of facility, expertise or financial resources regarding the particular items requested by the pertinent solicitation. If a bidder has been determined to be non-responsible, the bid shall be rejected.

Sealed Bids: Bids must be sealed. The State reserves the right to consider email bids as properly “sealed” if received prior to the closing time specified, provided that a signature is shown on the bid.

EVALUATION INFORMATION

Evaluation Process Each bidder response will be checked for the presence of required information in conformance to the submission requirements of this RFQ. Each bidder response will be evaluated to determine its responsiveness to the requirements. OTSI reserves the right to make mathematical corrections to the quote worksheet and/or to ask clarifying questions.

The overall responsiveness of each bidder is based on the complete response from the respondent to the RFQ requirements, including the Statement of Work. An award, if made, will be to the responsive and responsible bidder providing the lowest cost in accordance with Section 5.B. Evaluation Criteria below.

Evaluation Criteria The following two (2) criteria will be reviewed:

1) Administrative Requirements Evaluation (Pass/Fail) Bidders must pass the Administrative Requirements Evaluation to continue on to the cost requirements evaluation. All required attachments, forms, and documents must be submitted as outlined in Section 12. Bid Response Requirements List.

2) Cost Requirements Evaluation Criteria If the bidder response passes all Administrative Requirements, it shall be evaluated based on the Grand Total price as reflected on Exhibit B - Quote Worksheet.

Application of SocioEconomic Programs Cost adjustments for preference claims and incentive will be performed during cost assessment if applicable.

AWARD OF CONTRACT

Award of contract, if made, will be in accordance with Section 5. Evaluation Information to a responsible bidder whose bid complies with all the requirements of the RFQ documents and any addenda thereto, except for such non-material defects as may be waived by the State. Award, if made, will be made within forty-five (45) days after the scheduled date for Contract Award as specified in the RFQ; however, a bidder may extend the offer beyond 45 days in the event of a delay of contract award.

The State reserves the right to determine the successful bidder(s) either on the basis of individual items or on the basis of all items included in its RFQ, unless otherwise expressly provided in the State’s RFQ. Unless the bidder specifies otherwise in its bid, the State may accept any item or group of items of any bid. The State reserves the right to modify or cancel in whole or in part its RFQ.

Written notification of the State’s intent to award will be made to all bidders. If a bidder, having submitted a bid, can show that its bid, instead of the bid selected by the State, should be selected for contract award, the bidder will be allowed five (5) working days to submit a Notice of Intent to Protest, according to the instructions contained in the paragraph titled “Protests” of this RFQ.

In the event of a tie, a coin toss will be a permissible tiebreaker. Such event will be conducted by the Procurement Official and observed by another state employee as witness. Per California Government Code (GC) section 14838(g), in the event of a precise tie between the low responsible bid of a small business/microbusiness (SB/MB) and the low responsible bid of a Disabled Veteran Business Enterprise (DVBE) that is also a SB/MB, the award shall go to the DVBE that is also a SB/MB.

PROTESTS

Any bidder’s issues regarding solicitation requirements must be resolved (or attempts to resolve them must have been made) before a protest may be submitted according to the procedure below. These issues will first be resolved by the contact for the solicitation or if they result in a protest, the protest will be submitted to DGS Procurement Division Deputy Director to hear and resolve issues and whose decision will be final.

If a bidder has submitted a bid which it believes to be responsive to the requirements of the RFQ and to be the bid that should have been selected according to the evaluation procedures in the solicitation and the bidder believes the State has incorrectly selected another bidder for award, the bidder may submit a protest of the selection as described below. Protests regarding selection of the “successful bidder” will be heard and resolved by the Victim Compensation and Government Claims Board whose decision will be final.

All protests of award must be made in writing, signed by an individual authorized to bind the bidder contractually and financially, and contain a statement of the reason(s) for protest; citing the law, rule, regulation or procedure on which the protest is based. The protester must provide facts and evidence to support the claim. Protests must be mailed or delivered to:

Street and Mailing Address:

Deputy Director Procurement Division 707 Third Street, Second Floor South West Sacramento, CA 95605 Facsimile No.: (916) 375-4611 All protests to the RFQ or protests concerning the evaluation, recommendation, or other aspects of the selection process must be received by DGS Procurement Division Deputy Director as promptly as possible, but not later than the date indicated in the Notification of Intent to Award. Certified or registered mail must be used unless delivered in person; in which case the protester should obtain a receipt of delivery.

BIDDER INSTRUCTIONS

Bidder Instructions (GSPD-451) are incorporated by reference and can be accessed here: https://www.dgs.ca.gov/-/media/Divisions/PD/PTCS/GSPD/Bidders-Instructions.pdf. Bidders are advised to review the instructions in addition to this solicitation to ensure submission of a responsive bid.

BIDDER INQUIRIES

This RFQ addresses all requirements that bidders must meet to be eligible for consideration. Bidders must carefully read the entire RFQ and make sure all instructions and requirements of the RFQ are accurately followed and addressed.

If a bidder has questions or discovers any ambiguity, conflict, restrictive specifications, discrepancy, omission, or other errors in the RFQ, the bidder shall immediately notify the Procurement Official of such error, in writing, no later than five (5) business days before the bid due date, and request clarification or modification of the document.

State responses to bidder inquiries will be posted via Cal eProcure.

1. Small Business Preference Program Current law encourages state departments to first consider a SB for contracting opportunities. The CalHHS OTSI is committed to supporting SB participation in state contracting and seeks to use certified SBs whenever possible.

A five percent (5%) bid preference is available to bidders certified as a SB in accordance with GC section 14835 et seq.

The SB regulations concerning the application and calculation of the preference, certification, responsibilities, department certification, and appeals can be viewed in the California Code of Regulations (Title 2, Division 2, Chapter 3, Subchapter 8, section 1896 et seq.).

Disabled Veteran Business Enterprise Program The DVBE Participation Program requirements for this solicitation have been waived; however, this solicitation includes the DVBE Incentive. Bidders are required to submit the DVBE Declarations (DGS PD 843) form to be considered for the incentive. Refer to the following link for detailed requirements and instructions: DVBE Program Requirements.

Bidders are not required to apply for the Target Area Contract Preference Act (TACPA) preference. Denial of TACPA preference requests is not a basis for rejection of the bid.

The State reserves the right to verify, validate, and clarify all information contained in the TACPA application (STD 830). This includes, but is not limited to, information from bidders, manufacturers, subcontractors, and any other sources available at time of bid evaluation. Bidder's refusal to agree or comply with these terms, or failure to provide additional supporting information at the State's request, may result in denial of the requested preference.

Bidders wishing to take advantage of this preference must review the following website and submit the appropriate response(s) with the bid: Request Target Area Contract Preference.

BIDDER REQUIREMENTS

Bidders must meet the following requirements, as applicable, to be considered responsive and responsible. Also refer to the Bid Response Requirements List.
