Justification and Approval for Other Than Full and Open Competition/Expedited Procedures
This is a Justification and Approval (J&A) document for the U.S. Department of State's use of other than full and open competition procedures for a contract modification. The document justifies a non-competitive extension and cost increase for Task Order-10 (Contract #720-696-25-F-00002) under Indefinite Delivery Indefinite Quantity Contract #720-696-21-D-00001 with Rwanda Medical Supply Ltd (RMS), a Government of Rwanda commercial parastatal entity. The modification extends the period of performance from April 27, 2026, to September 30, 2026, and increases the ceiling by $8,000,000 from $25,436,744 to $33,436,744, with the total estimated value for the entire period of performance set at $33,436,744. This increase remains within the overall IDIQ TEC ceiling of $89,000,000.
The contract provides HIV/AIDS commodities procurement and distribution services under the President's Emergency Plan for AIDS Relief (PEPFAR). The J&A is authorized under the Expedited Acquisition and Assistance Procedures (EPP) for PEPFAR, valid from January 1, 2025, through December 31, 2029, and was approved by the Secretary for Foreign Assistance on December 19, 2025. The justification cites AIDAR 706.302-70(b)(3)(ii) and 40 U.S.C. 113, determining that full and open competition would impair foreign assistance objectives. RMS is identified as the only organization in Rwanda with demonstrated capacity to procure, manage, warehouse, and distribute PEPFAR commodities while meeting State quality requirements. The extension is deemed essential to avoid disruption of life-saving HIV and malaria services and maintain program continuity during the transition from international to local partner management. No synopsis was published per AIDAR 705.202(b) exception due to the time-sensitive nature directly tied to ongoing services. The cost is determined to be fair and reasonable based on Independent Government Cost Estimates developed from current market rates and historical costs, with the Contracting Officer retaining the right to apply additional price analysis techniques as needed.
