Question 1 Page 1 states that "Firms organized as construction firms or duly licensed and holding a valid minimum of class V construction license to perform construction activities in Mozambique may submit proposals." should we understand only locally registered level V companies may submit the proposal or an international construction company can submit proposal too which is not currently registered in the country?

Answer This procurement is open to both local and international organizations. However, it is required that the prime organization has a minimum of class V construction license to operate in Mozambique.

Question 2 The RFP requires that the offeror submit a signed Offer, Standard Form (SF) 1442, including verification of all amendments received, with their proposal. Can the USAID please provide the SF 1442 that should be completed and submitted with our proposal?

Question 3

1. How can we participate ? Do we need to subscribe to any platform ? Do we need to buy any specifications ?

2. It's not clearly in the document what we need to subnet for your evaluation in this fast fase.

can you specify our make it clearly.

3. I understand this is open tender, but how are we going to define our price? is there no any bill of quantity (Mapa de quantidade) ?

4. On 4 february we need to submit the proposal, whis proposal ? Technical only our financial also ? Is there a specific form of our method to present this proposal ?

5. Is there any draw of the building with all specifications ?

6 On page 2 B.3 refer to $7500 as a minimal guarantee. This is the guarantee of the contract ?

Answer

1. You may participate by submitting your technical proposal by email within the timeline provided in the solicitation. You can access the solicitation and all amendments by accessing www.beta.sam.gov and search for “USAID Mission Construction Services”.

All the tender documents could be downloaded in this site at no cost.

2. Please refer to Section L of the solicitation for the submission requirements and Section M for the evaluation criteria.

3. No price information is required in this phase of the procurement process.

4. Please note that per Amendment 01 of the solicitation, the deadline for submission of proposals has been extended to February 11, 2021. Only a technical proposal will be submitted in this phase. Please refer to Section L of the solicitation for the format of the proposal to be submitted. However, technical proposal format shall be organized based on the evaluation criteria provided in section M.

5. Detailed design and specifications will be provided in Phase 2 of the solicitation.

6. Section B3 means that should an organization be awarded an Indefinite Quantity

Indefinite Contract (IDIQ), USAID is required to provide a Task Order to the organization to render services for at least $7,500 during the life of the IDIQ.

Question 4

1. Nos intervenientes das construcoes nao se encontra qualquer figura do governo como representante provincial ou distrital. Porque as obras irao decorrer nesses territorios e eles os beneficiarios directos, estarao fora do processo?

2. Porque é que todos docs das propostas so podem ser apresentados em ingles? Como sabe poucos empreiteiros locais estao em condicoes de apresentarem as suas propostas.

Gostariamos que se reconsiderasse esse aspecto para nao exluir concorrentes.

1. A coordenação com o Governo central, provincial, distrital, local e comunidades onde vão ser implementados os projectos de infraestruturas é feita directamente pela USAID em todas as fases, desde o planeamento, desenho, execução até a entrega dos projectos aos beneficiários. Os pacotes dos projetos a serem incorporados na fase 2 do concurso são concebidos e coordenados entre os dois Governos, Moçambicano e Americano.

2. A proposta técnica deverá ser submetida em inglês entretanto os documentos de suporte tais como alvarás, relatórios financeiros dos últimos anos, etc podem ser submetidos em portugues. Os contratos que resultarão destes concursos serão entre as empresas selecionadas e o Governo Americano por isso por força da lei (Federal Acquisition Regulations) os contratos serão em inglês.

1. All coordination with the central, provincial, district, local and community governments where infrastructure projects will be implemented will be done directly by USAID at all stages, from planning, design, execution to delivery of the projects to the beneficiaries.

The projects to be incorporated in phase 2 of the solicitation are designed and coordinated between the two governments, Mozambican and American.

2. The technical proposal must be submitted in English, however supporting documents such as permits, licences, etc. may be submitted in Portuguese. The contracts resulting from this solicitation will be between the selected organizations and the US Government, therefore per the Federal Acquisition Regulations the contracts must be in English.

Question 5

1. Is there any quotation that should be submitted in the Phase I of this Bid?

2. Will there be conducted any site visit in the Phase I?

3. Is it required to submitted any Bid Security?

1. No cost proposal is required in the Phase I, only on Phase II.

2. No site visits will be completed in Phase I, only on Phase II.

3. No bid bond is required.

Question 6 We have noted that there are no Small Business Set-Asides? Is there any specific reason e.g.

Market Research did not produce sufficient Small Business with the required capacity? Is there any envisaged role for Small Businesses apart from being subs to large contractors for example Specific Region or Country experts?

Answer

USAID encourages small businesses to participate either as primes or subcontractors as long as meeting the minimum requirements regarding construction licenses.

Question 7 We have also noted that only “firms organized as construction firms or duly licensed and holding a valid minimum of class V construction license to perform construction activities in Mozambique may submit proposals.” Kindly clarify whether this means that the firm has to be registered with ACIS before submission of the proposal or whether this can happen after award?

Answer

See the response to question number 1 above. Registration process should start during the solicitation stage. Temporary registration can be obtained from the Ministry of Public Works.

Also, offerors have the option of partnering with local firms to meet that specific requirement.

Question 8 The RFP instructs to indicate in the subject line of the submission email the desired sequence of multiple emails, and of attachments (e.g. "no. 1 of 4", etc.). For example, the first email may have a subject line which says: "ABXY, RFP No.: 72065620R00XXX, Company Name, Part 1 of 2." Does this mean that each part of the proposal should be submitted in a separate email, or does this refer to the proposals for the various IDIQ lots?

Answer

Multiple emails submission is proposed to mitigate file size uploading limitations as systems such as dropbox or equivalent are not accepted by the Government. Each part of the proposal should be sent in a separate email.

Question 9 Kindly clarify what is meant by the phrase “shop drawings” on page 10 of the RFP.

Answer:

No shop drawings are required in Phase I.

Question 10 Neste parágrafo abaixo diz que as firmas têm que ter o mínimo de classe 5 para poder participar no concurso, gostaríamos de saber se fizermos uma parceria com uma empresa que tem a classe 4 e a nossa que tem a classe 3 é possível participarmos neste concurso? Porque é o que geralmente acontece nos concursos estatais.

Answer:

A empresa principal “Prime”, lider do consórcio, deve ter um alvará mínimo de 5 Classe. O limite minimo de classe de alvará estabelecido tem a ver com a magnitude financeira de cada um das obras que será executada ao longo dos 5 anos da vigência dos contratos.

The prime organization of a consortium, must have a minimum of class 5 licence . This minimum class limit was established based on the financial magnitude of each of the works that will be executed over the 5 year period of the contracts.

Question 11

1. The Quality Control (QC) Plan, is this included in the page limitation? This is a large document similar to the Environmental Compliance Plan.

2. Mobilisation approach… it is very hard to provide specific details here as the scope of works has not been defined and is currently very generic for each CLIN. Will there be more details?

1. The quality control plan can be submitted as an attachment to the technical proposal and will not count for the 30 pages limitation

2. Solicitation does not require a specific mobilization plan rather a general mobilization approach. Offerors are expected to evaluate their corporate capabilities, location of their offices and operations and propose their intended mobilization approach.

Question 12 Na vossa página de internet não está muito claro para onde se devem enviar as propostas e ªo caderno de encargos, se assim posso chamar tem 128 páginas de um inglês muito técnico que acaba nos confundindo uma vez que o concurso no jornal está em portugues.

Answer:

Question 13 Can you please provide further clarification with regards to Section B.3 Minimum Obligated Amount?

Answer Section B3 states that USAID has reserved $7,500 in order to cover a minimum order guarantee.

This means that should an organization be awarded an Indefinite Quantity Indefinite Contract (IDIQ), USAID is required to provide a Task Order to the organization to render services for at least $7,500 during the life of the IDIQ.

Question 14 Can you please provide further clarification with regards the last sentence in Section B.4?

Answer This statement means that the total amount for a Lot will not be subdivided among the IDIQ holders for example, if there are 3 IDIQ holders for Lot 1, the $28 million will not be divided amongst the 3 contractors. The amount allocated will depend on how much is required for the performance of the Task Order. Task Orders will be issued through a competitive procurement process between the holders of the IDIQ and a Task Order will be issued to the best bidder.

Question 15 Who will be responsible for the Design? FAR 36.3 refers to the Contractor, where as Section C.2 refers to the Engineer?

Answer:

For Design-Bid-Build projects the Architectural and Engineering firm, (the engineer), will be responsible for the drawings and specs.

If USAID decides to implement any Design-Build project, the construction contractor will be responsible for the design and specs. A budget line for the design services will be incorporated in the specific Task Order. However, the USAID preferred approach for implementing construction projects is Design-Bid-Build therefore, the engineer is expected to be responsible for the design with fewer exceptions.

Question 16 Will the IDIQ for a specific region, be awarded to a contractor or to multiple Contractors?

Section L4 a. is currently blank, (Anticipated Indefinite Quantity Contracts under this RFP.

USAID anticipates awarding to multiple contractors for each region.

Question 17 Is there an indication as to the amount of work that will be rehabilitation and new construction?

Answer:

Not at this stage. As stated in the solicitation, the total magnitude of construction (rehabs and new construction) will not exceed $70M.

Question 18 Please define “life support” in Section C.4 B Point 6

Answer:

Life support refers to the basic treatments and techniques performed in an emergency in the construction site in order to support life after a work accident. For example, a first aid kit shall be installed in the construction site.

Question 19 On page 36, the last paragraph refers to procedures in (d)… there is no section (d)

Answer This section refers to (d) “Request for Task Order Proposal (RFTOP)” on page 32 of the solicitation.

Question 20 Can we have the location for the site visits as per Section L.3

No site visits are required for Phase I, only in Phase 2.

Question 21 In Section L, it refers to details require demonstrating how we will successfully implement our plan and the construction activities as described in Section C. Currently the scope is generic for each location, please provide more details for us to demonstrate our proposal more accurately.

Answer:

Technical proposals shall be prepared based on the evaluation factors provided in section C of the solicitation namely, Factor 1 – Organization Structure and Key Personnel; Factor 2 – Management Plan and Approach and Factor 3 – Specialized Experience and Corporate Capability. The technical evaluation team will determine how each offeror demonstrates ability to successfully implement construction activities based on the factors listed above.

Question 22 C.2 Paragraph 1 references USAID’s plan to procure a third party oversight Architecture and Engineering (A&E) services contractor. Would you please clarify that the third party A&E contractor will be procured full and open separately from the RFP referenced above? If yes then would you please provide an estimate indication as when this procurement will be announced?

The A&E contracts for design and oversight services have already been procured and awarded.

Question 23

RFP cover Letter has the following statement;

“Firms organized as construction firms or duly licensed and holding a valid minimum of class V construction license to perform construction activities in Mozambique may submit proposals.”

Please clarify, whether the construction companies not holding a construction licence in Mozambique but willing to have it after phase I selections are made, would be considered eligible for award or not.

Construction contractors are expected to already have a valid construction license. Companies willing to submit proposals but not holding any construction license may present a temporary construction license issued by the Ministry of Public Works of the Republic of Mozambique.

Question 24 AW Section L.4 GENERAL INSTRUCTIONS FOR SUBMISSION OF PROPOSALS the following requirement is listed;

(2) Submission of proposed costs/prices and indirect cost information as required by Section B and L of this RFP;

However in Section B.5 it is stated that the contract line items are TBD.

Answer Section L.4 (2) has been deleted from the solicitation as no cost information is required in this phase.

Question 25

1. According to Section M.2 Selection Into Phase II, "Offerors whose proposals fully address all the evaluation requirements outlined in sections L and M will be selected to participate in Phase II." In this connection, are the requirements defined in Section L.6 "Evidence of Responsibility" included in the evaluation requirements for Phase I?

2. When will a full listing of all questions and answers relevant to this procurement be made available through the sam.gov website?

1. Please note that L.6 has been deleted from the solicitation. See revised solicitation.

2. After the pre-proposal conference.

Question 26 Under Section C.5 Task Order Deliverables, Paragraph T) Subcontracting Plan, Sub Paragraph e) states "...The execution of work by a subsidiary of the Contractor will not be considered direct employment unless the CO agrees otherwise." (Page 25). Please explain this sentence. Does it mean the subsidiary should be considered a subcontractor?

Yes, subsidiaries must be presented as subcontractors

Question 27 F.6 Ordering Procedures:

It is Offeror understanding that:

- Phase 1 has a pre-qualification purpose

- Phase 2 has the purpose of assigning to multiple Contractors different IDIQ Contracts (to be intended as frame agreements) for each lot

- Based on the different Task Order that USAID will decide to develop in the Contact period of 5 years, USAID will issue RFTOP to the above mentioned Contractors to assign the particular Task Order execution.

Company is kindly required to confirm or revert the above statements.

Answer

1. Yes, the purpose of Phase I is to “pre-qualify” construction contractors including determining the five years’ IDIQ holders per lot.

2. Yes, understanding of Phase 2 is accurate.

3. Yes, based on the different Task Order that USAID will decide to develop in the Contact period of 5 years, USAID will issue RFTOP to the above mentioned Contractors to assign the particular Task Order execution: Yes.

Question 28

L5 GENERAL INSTRUCTIONS FOR SUBMISSION OF PROPOSALS FOR ALL THREE

IDIQs:

As per Factor 2 request, Offeror is required to propose a QC plan. Since this document is usually much longer then the 30 pages limit imposed by the Tender for this proposal, the Company is kindly required to clarify if the QC plan can be added to the list of deliverables that does not http://sam.gov/ contribute to the 30 pages limit of the proposal indicated in pages 109 / 110

Yes. The quality control plan can be submitted as an attachment to the technical proposal.

Question 29 The offeror intends to submit this proposal through its local company registered in Mozambique that has all the licences and permits required by the Tender and also by the Mozambique government. For references, financial statements and other aspects (such as eventual registration on the SAM system), this company will instead rely on the data of the Parent Company, that is able to produce a Parent Company Guarantee (if needed by USAID).

Offeror kindly requires the Company to indicate the suitability of this set-up.

Answer:

Offerors are free to make any legal joint ventures/partnership/consortium to further enhance their technical capabilities. The prime shall meet construction license requirements as required in the solicitation.

Question 30

B.3 MINUMUM OBLIGATED AMOUNT

- Minimum Task Order amount that is foresee to be executed

- Indicative information about the avarage Task Order value to be executed

Answer:

The minimum TO amount is $7,500. As stated in the solicitation, the total magnitude of construction (rehabs and new construction) will not exceed $70M.

Question 31

L.5 GENERAL INSTRUCTION FOR PROPOSAL SUBMISSION

With reference to what indicated by the Company in bullet (f), Offeror highlights that the Standard Form (SF) 1442 is not available in the Tender documentation hence Offeror kindly required this to be forwarded (unless not needed for this specific proposal / phase)

Answer:

See answer to question 2.

Question 32

F.6 ORDERING PROCEDURE

Offeror kindly requires Company to clarify to how many Contractors will USAID assign IDIQ contracts for each of the 3 lots

It will depend on the submitted technical proposals meeting the solicitation requirements.

However, a minimum of 5 holders per lot/region is expected.

Question 33

IDIQs & L9 DELIVERY INSTRUCTIONS According to the latest Amendment the due date for submission of proposals to February 11, 2021 at 16:00 PM (Maputo Time), and according to the introductory letter to offers only electronic submissions for proposals will be accepted. In the first paragraph of Section L9 on Page 116, the notion that only electronic submittals will be accepted in accordance with the currently official due date and time is supported. However, the last paragraph of Section L5 on page 112, states that if electronic submittals are made, they will be considered late if they are not received on or before 4pm, one working day prior to the date specified for receipt of the proposals.

Moreover, in the last paragraph of Section L.5, states that "Any proposal, modification, or revision received by the Government after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the contracting officer determines that accepting the late offer would not unduly delay the acquisition, and (1) if it was transmitted through an electronic commerce method authorized by the solicitation, and it was received at the initial point of entry to the Government infrastructure not later than 4:00 p.m. one working day prior to the date specified for receipt of proposals..."

Arguably, under these conditions, it appears that the electronic submittal for Phase 1 is actually due, in accordance with Amendment 1, on or before 10 February at 1600 (Maputo Time), one working day before the date specified in the 19 January 2021 Amendment.

In this case, will you please clarify the actual due date and time for electronic submission for Phase 1 performance capability proposals for review and consideration?

The deadline for submission of the proposals per Amendment 01 is February 11, 2021 at 16:00 PM (Maputo Time). Please note that this section has been deleted from L.5. See the revised solicitation.

Question 34

IDIQs It is Offeror understanding that the Phase 1 proposal shall only be constituted by the information required by Fact 1, 2 and 3 of Section L.5, Company is kindly required to confirm / revert this statement.

Yes. The technical proposal shall be prepared based on the evaluation factors of phase 1, provided in section M of the solicitation. Section L provided instructions.

Question 36

1. Na fase II da pré-qualificação os concorrentes irão dar preços unitários que ficarão válidos durante os 5 anos que vigorará o contrato ou a validade da pré-selecção?

2. Na altura do contrato, irão emitir “Request for task order proposal” para cada trabalho a executar, no entanto, os preços unitários serão os apresentados na phase II deste processo, ou o empreiteiro poderá apresentar preços revistos a cada Task Order emitida?

3. A moeda de pagamento do contrato será USD?

Answer

1. Os preços apresentados na fase II servirão de base para a adjudicação do contrato de empreitada em consideração na Task Order (TO) específica. Para cada TO a ser emitido os empreiteiros selecionados apresentarão preços de acordo com o objeto específico de empreitada a ser executado. Os preços iniciais apresentados podem ser usados pela USAID como preços de referência mas não terão como e óbvio validade de 5 anos.

2. Para cada TO a ser emitido, preços específicos no horizonte temporal específico serão apresentados pelos empreiteiros selecionadas.

3. Os pagamentos dos contratos de empreitada a serem executados serão em dólares Americanos e em conformidade com a lei cambial de Moçambique.

1. The prices proposed in phase II will serve as a basis for the award of the contract to be used for the specific Task Order (TO). For each TO to be issued, the selected contractors will propose prices based on the specific objective of the work to be carried out. The initial prices submitted may be used by USAID as reference prices but may not be valid for 5 years.

2. For each TO to be issued, the IDIQ contract holders will provide prices for that Task Order when the Requequest for Task Order Proposal is issued.

3. Payments for works contracts to be executed will be in US dollars and in accordance with Mozambique's foreign exchange law.

QUESTIONS FROM THE PRE-PROPOSAL CONFERENCE

This provides a clear unambiguous direction for proposal format. However, how are the elements of Evidence of Responsibility as detailed in L6 to be inserted into the format detailed in L5? Assuming that all elements in Sections L & M are to be addressed in the PHASE 1 proposal, how are L6 elements to be included if there is no reference in L5 to Evidence of Responsibility? It is simply not clear where in the proposal, documents and answers for L6 requirements should be placed; perhaps in an Addendum created specifically for this purpose?

IAW Section L.4 GENERAL INSTRUCTIONS FOR SUBMISSION OF PROPOSALS the following requirement is listed; (2) Submission of proposed costs/prices and indirect cost information as required by Section B and L of this RFP; However in Section B.5 it is stated that the contract line items are TBD. Please clarify, whether the costs/prices and indirect cost information has to be submitted within the Phase I submission. If so, please provide the CLINs or submission format for costs/prices.

Cost information is not required at this phase.

Answer

The intent of Phase 1 is to pre-qualify construction firms that could be part of an IDIQ for each of the regions (lots). Once the IDIQs are established, USAID will compete task orders for the IDIQ holders for each of the regions as construction works are identified.

Does USAID expect the majority of "new" projects to be Des-Build or DBB?

Answer USAID preferred approach for implementing construction projects is Design-Bid-Build therefore, it is expected that the majority of projects will be implemented through Design-Bid- Build mechanisms. However, there might be cases where the Design-Build mechanism can be utilized.

Question 45

Are you also required to register through SAM ?

Answer SAM registration is not required at the solicitation phase but it is required before the award is signed. USAID recommends contractors begin their SAM registration as soon as possible as it could take time to be fully registered.

Question 46

If the contractor intends to Bid for more than one lot, can it be submitted in the same file or it has to be separated files as 3 Bids ?

Answer Proposals should be provided for each region that you are interested in. Therefore if an organization is bidding for two regions, then it should submit two proposals, one for each region.

How the oversight contractor is procured? a separate procurement process.

The Design and oversight services are already procured through full and open competition.

Answer USAID generally does not provide advance payments however, on a case by case basis a mobilization fee is considered upon completion of mobilization of personnel or equipment or materials or all.

Answer Todas as empresas, independentemente se são estrangeiras ou não, para serem autorizadas a exercer atividade de construção civil e obter alvará no Ministério das Obras Públicas, seguem a lei Moçambicana. E por isso que o requisito mínimo para ser considerado para adjudicação é ter alvará válido/legal para exercer actividade de construção em Moçambique nas suas variadas especialidades.

All organizations, whether international or local, to be authorised to carry out civil construction activity must obtain a licence from the Ministry of Public Works, have to follow Mozambican law. This is why the minimum requirement to be considered for award is to have a valid/legal permit to carry out construction activity in Mozambique in its various specialities.

Answer

Yes, all answers to questions received prior to the Pre-proposal conference and those received at the pre-proposal conference are included in this amendment.

Answer The award of the contract is expected to be in June/July 2021 and there is ample time for registration up till then. However, offerors should demonstrate that they have started the registration process during the solicitation stage. Offerors have also options to partner with local contractors.

Section L.5 notes that the Offerer shall submit Standard Form (SF) 1442. This form is not part of the RFP document. I have sourced a version of the form, which seems to be very similar to SF 33. Please confirm whether or not SF 1442 is to be submitted and that REV.8/2014 is the latest version to be used.
