Subject: Request for Proposals (RFP) No. 72065620R00019 – USAID Mission

Construction Services (PHASE I)

Dear Offerors

The United States Agency for International Development (USAID) is seeking proposals from qualified organizations to provide construction and/or renovation services for the various infrastructure projects implemented by USAID/Mozambique as described in the attached Request for Proposals (RFP).

USAID anticipates the award of multiple Indefinite Delivery, Indefinite Quantity (IDIQ) Contracts for up to five-years to provide construction activities described in section C of the solicitation for all the 11 provinces of Mozambique. Due to the geographical extension of Mozambique, three independent IDIQs are being contemplated under this solicitation to cover the Northern, Central, and Southern provinces of Mozambique.

Offerors may submit proposals for one, two, or all three IDIQs provided they have the capabilities to perform in the region. Offerors are required to undertake their internal assessments and determine whether they possess technical and corporate capabilities to complete construction activities in each of the regions they submit a proposal.

USAID/Mozambique also anticipates awarding a Task Order through this solicitation under the Central region IDIQ. Details of the RFTOP will be provided during the Phase II of this solicitation. The Geographic Code for this procurement is 935. USAID will conduct this procurement through full and open competition in accordance with FAR Part 36 and FAR Part 15. Firms organized as construction firms or duly licensed and holding a valid minimum of class V construction license to perform construction activities in Mozambique may submit proposals.

This is a Two-Phase Design Build Procurement in accordance with FAR 36.3 procedures.

In Phase I, interested Offerors will submit performance capability proposals for review and consideration. The Government will evaluate the proposals in accordance with the criteria described herein (section M) to select the Most Highly Rated Offerors to advance to Phase II. In accordance with FAR 36.303-1(a)(4), not more than five offerors will be selected (for each IDIQ) to advance to Phase II of the competition without the Head of Contracting Agency approval.

In Phase II, detailed plans and specifications for the projects will be provided, via an amendment to the solicitation, to only the Offerors advanced from Phase I. The Offerors’ Phase II proposals will be evaluated per the criteria described in the amendment.

RFP No. 72065620R00019 USAID Mission Construction Services

USAID anticipates that the maximum aggregate ordering limitation for contracts resulting from this RFP will be $70 million for all three IDIQs over the five-year ordering period. The maximum aggregate dollar value of task orders awarded to all contractors cannot exceed this contract ceiling. This ceiling is not being subdivided among the number of awardees nor is it being multiplied by the number of awardees. There is no guarantee on the number of task orders that the successful contractors will receive or the amount of money beyond the minimum order guarantee set forth in the RFP.

The procedures set forth in the Federal Acquisition Regulation (FAR) Part 36 shall apply to this solicitation. The procedures set forth in the Federal Acquisition Regulation (FAR) Part 15 will apply to Phase II. Offerors are encouraged to read the entire solicitation.

Only electronic submissions will be accepted. Questions regarding this RFP must be submitted by email to the points of contact mentioned in Section G of this RFP. Each e-mail must contain a subject line clearly indicating the name of the Offeror, the solicitation number, and the IDIQ being proposed.

Sections B through I of the solicitation will become the substantive part of the anticipated contract with blanks to be completed by the Contracting Officer upon award. Proposals must be signed by an official authorized to bind the Offeror’s organization.

Please pay careful attention to, and complete in full, RFP section K–Representations, Certifications, and Statements of Offerors.

Please refer to Section L for information regarding proposal requirements. Offerors are responsible for ensuring proposals are received at USAID by the due date and time as specified in Section L. Failure to comply with the submission date and time will deem any submission unacceptable and it will not be reviewed or evaluated.

Section L of the RFP sets forth all instructions for the preparation and submission of required proposal contents, including critical dates/times for the submission of questions, and the proposal submission closing date and time. Section M states the criteria by which proposals will be evaluated. Oral explanations or instructions given before award of the contract will not be binding.

Further, be aware that amendments to solicitations are occasionally issued and will be posted on the same website from which you downloaded the solicitation. USAID advises to regularly check the above website for amendments.

The Government reserves the right to award a contract without discussions or the submittal of the final proposal revision, based upon evaluation of the Offeror’s submitted technical and cost information. Accordingly, the Offeror’s initial offer should contain its best terms for both cost and technical proposal.

SECTION B – SUPPLIES OR SERVICES/PRICES

B.1 PURPOSE

The purpose of this contract is to provide services that fall within the Scope of Work (SOW) specified in Section C. USAID Task Order Contracting Officers (TOCOs) will request the work through the issuance of task orders during the ordering period as specified in Section F of the contract.

B.2 CONTRACT TYPE AND SERVICES

This is an Indefinite Delivery/Indefinite Quantity (IDIQ) type contract. The Government intends to issue three IDIQs as a result of this solicitation, one for each region of Mozambique, and task orders that are Fixed-Priced type. The Contractor must perform the services set forth in Task Orders at prices consistent with Section B of this contract and the resulting task orders that are issued.

B.3 MINIMUM OBLIGATED AMOUNT

The basic contract includes an initial obligation of funds in the amount of $7,500 to cover the minimum order guarantee USAID is required to order and the Contractor is required to furnish the minimum order amount of services.

Following this initial obligation, individual task orders will obligate funds to cover the work required under that task order.

B.4 MAXIMUM CONTRACT CEILING

This is a multiple award Indefinite Quantity Contract (IDIQ) with an overall ceiling price of $28 million for the Northern Region IDIQ (Lot 1) $28 million for the Central Region IDIQ (Lot 2) and $14 million for the Southern Region (Lot 3) for the services provided in Section C. The maximum aggregate dollar value of Task Orders awarded to all contractors must not exceed each of the contract ceiling. These ceilings are not being subdivided among the number of awardees nor are they being multiplied by the number of awardees.

Compensation of personnel under this contract or any resulting subcontract must be in accordance with AIDAR 752.7007 Personnel Compensation (July 2007) (See Section H.).

Language fluency, relevant regional experience, and international development experience requirements will be specified in individual task orders.

(c) Subcontractor Rates.

The following provides guidance for various subcontracting arrangements:

(i) The Prime subcontracts with an approved subcontractor from the original IDIQ competition

The unburdened CDR’s for the prime contract apply to the subcontractor.

(ii) The Prime contracts with a new subcontractor not yet approved

The unburdened CDR’s for the prime contract apply to the new subcontractor.

(iii) Prime subcontracts with a new subcontractor not yet approved and may or may not have a different cost accounting system that only processes fully burdened rates. Further, subcontractor proposes rates that are “above” the prime IDIQ rates.

The Prime may then include in its TO proposal, (i) the fully burdened rate proposed to the Prime by the Subcontractor,(ii) allocation of the Prime’s indirect costs in accordance with established accounting practices, and (iii) a reasonable profit. If the rates proposed to USAID, inclusive of the Prime’s allocable indirect costs and a reasonable profit are above the Prime’s unburdened CDRs , the Prime must disclose the amount of the indirect costs, and the amount of the proposed profit that were added to the Subcontractor’s proposed rates. A reasonable profit will be negotiated by the TOCO for the specific TO.

The CDRs of the subcontractor must not exceed the prime’s CDRs in the IDIQ contract.

B.6 LABOR (UNBURDENED CDR) RATE CHANGES

The labor rates are fixed for all contract years; however, the Contractor may submit a proposal reducing the labor rates and/or indirect rates at any time during the life of this contract. The Government will review these proposals and determine if the revised rates are realistic and in the best interests of the Government. If the rates are accepted, the Government will modify the contract by incorporating the new rates into the contract.

SECTION C – DESCRIPTION/SPECIFICATIONS

C.1 BACKGROUND

USAID has a history of using infrastructure projects to achieve its DOs and plans to maintain infrastructure as an important part of its portfolio. Infrastructure plays important roles in driving economic growth, enhancing food security, improving public health, addressing climate change and advancing the nation’s capacity to be resilient to drought, epidemics and other forms of natural disasters. USAID, in collaboration with the Government of Mozambique (GOM), has been implementing and will continue to implement various construction and infrastructure projects to achieve these roles.

The construction and infrastructure projects that USAID implements are located within the following sectors: Education, Environmental and Global Climate Change; Health;

Water and Sanitation; Economic Growth and Trade; and Agriculture and Food Security.

The construction and infrastructure activities in these sectors include, but are not limited to,

a) rehabilitation, upgrade, repair, demolition and/or new construction of stores warehouses, shipping and transportation systems such as roads, ports, railroads, and bridges, power generation, transmission and distribution, irrigation systems and drainage basins; dams and storage reservoirs; erosion mitigation and flood control to include storm water drainage management; the exploration and development of groundwater resources; and supporting buildings facilities.

b) rehabilitation, upgrade, repair, demolition and/or new construction of energy systems such as solar, wind, hydropower, biogas, biofuels; green and climate resilient buildings and sustainable construction; pollution mitigation technologies for power station systems burning oil, coal, and natural gas;

c) rehabilitation, upgrade, repair, demolition and/or new construction of water and sanitation systems, drinking water disinfection systems;

watershed management systems; alternative water treatment systems;

drainage basins and irrigation systems; dams and storage reservoirs; flood control programs; exploration and development of groundwater resources;

domestic and industrial water supply; wastewater collection, treatment, and disposal; wastewater recycling; materials reuse; coastline erosion mitigation and flood control to include storm water drainage management;

and proper solid waste collection, recycling, and disposal.

d) rehabilitation, upgrade, repair, demolition and/or new construction of schools, classrooms, training facilities, training labs along with supporting facility water supply and distribution systems; wastewater collection and disposal; information communication technology; and power supplies.

e) rehabilitation, upgrade, repair, demolition and/or new construction of USAID owned residences, buildings, and facilities

f) rehabilitation, upgrade, repair, demolition and/or new construction of hospitals, clinics, warehouses, health training schools, labs, proper solid waste and medical waste collection, recycling, and disposal systems

C.2 SCOPE OF WORK

This solicitation sets forth requirements for proposals for Indefinite Delivery/Indefinite Quantity (IDIQ) contracts to acquire the services of qualified construction firms to carry out new construction and/or renovations for the various types of projects implemented by USAID/Mozambique (hereinafter referred to as “USAID”). With third party oversight provided by USAID’s Architecture and Engineering (A&E) services contractor (hereinafter referred to as “Engineer”), the contractor will execute work in accordance with the contract provisions. All work must be authorized in the form of Task Orders by USAID. The Engineer will produce the design for all infrastructures unless it is a design-build (DB) type Task Order.

The IDIQ Contractors will serve as USAID’s partners for constructing and/or renovating the different infrastructure projects implemented in the various provinces of Mozambique. This IDIQ will contribute to achieve the Mission’s Development Objectives (DOs) and better address the evolving needs of the different offices in the mission.

The activities of the IDIQ Contractors will include the provision of labor, materials, tools, equipment, direct technical supervision, and quality control for the construction of the various infrastructures located at the different provinces of Mozambique including in the remote areas with rugged roads, as well as renovating existing facilities with multiple deficiencies. The Engineer will provide expert architectural and engineering technical support, including design services; facility needs and environmental assessments;

construction quality assurance; and development of guidance for facility operations and maintenance (O&M). The Engineer will have the role of an independent expert advisor in architecture and engineering to USAID and, in that capacity, will serve as an external quality assurance advisor for work under this IDIQ, including independent verification of the quality of the construction and renovation/rehabilitation work to be performed by the Contractor and its subcontractors.

Due to the geography extension of Mozambique, three IDIQs, one for each region are being considered for proposal submission and award, namely northern (IDIQ 1), central (IDIQ 2) and southern region (IDIQ 3). Offerors may submit proposals for one, two or all of the IDIQs that they have the capability to perform.

C.3 DEFINITIONS

A) CONTRACTOR

The term “Contractor” refers to the successful Offeror under the terms and conditions of this contract with USAID/Mozambique. The Contractor shall be responsible for the design and/or construction of each as specified in each TO.

B) IDIQ CONTRACTING OFFICER (CONTRACTING OFFICER)

The term “Contracting Officer” or “CO” refers to the USAID Contracting Officer responsible for this IDIQ and Task Order awards.

C) IDIQ CONTRACTING OFFICER’S REPRESENTATIVE (IDIQ COR)

The term “IDIQ COR” refers to the USAID Contracting Officer’s Representative authorized by the Contracting officer to assist with the administration of this IDIQ.

D) TASK ORDER CONTRACTING OFFICER’S REPRESENTATIVE (TOCOR)

The term “TOCOR” refers to the USAID Contracting Officer’s Representative authorized by the Contracting officer to assist with the administration of Task Orders issued under this

IDIQ.

E) CONSTRUCTION MANAGEMENT CONSULTANT (CMC / DESIGNATED AGENT)

The term “Construction Management Consultant”, “Designated Agent” or “CMC” refers to an independent Construction Management Consultant that may be employed and funded by USAID to provide technical assistance, project monitoring, and quality assurance. If a CMC is to be utilized for a TO, the assigned CMC and their responsibilities will be defined in that TO.

C.4 DETAILED WORK REQUIREMENT

The Contractor shall have the ability to perform the following work requirements under this IDIQ as defined below:

A) GENERAL

The Contractor shall have the capabilities to provide the following activities, as further defined in each TO:

1. For Design-Build TOs, the contractor shall provide architectural and engineering services, developing the design and construction documents up to 100% design including completion of the respective construction services.

2. Provide construction management services for a variety of infrastructures projects illustrated under section C.3.

3. Perform structural assessments of existing infrastructure; design and implement structural reinforcing elements.

4. Provide general facility maintenance services.

5. Renovate and/or construct water supply improvements, which may include dams, boreholes, surface water intakes, treatment plants, pumping stations, transmission mains and respective reticulation, distribution centers, storage, cisterns, standpipes, etc.

6. Renovate and/or construct sanitation systems improvements, which may include wastewater treatment plants, septic tanks, collection systems, pumping stations, latrines, etc.

7. Rehabilitate and/or construct new highways/roads, bridges, pavements, road margins, intermediates, and curbs, etc.

8. Rehabilitate and/or construct new railways systems including supporting facilities and systems.

9. Rehabilitate and/or construct power generation, transmission and distribution systems including from alternative sources (i.e. wind, hydropower, biofuels, solar, and biogas)

10. Rehabilitate and/or construct irrigation systems and respective supporting systems

11. Rehabilitate and/or construct erosion mitigation and flood control and supporting systems

12. Construct new building facilities of various uses and repair and/or replacement structural elements, walls, painting, floors, doors, windows, ceilings, roofing elements including supporting systems such as water, electrical/electronic, mechanical, drainage, sewage, etc.

13. Purchase and/or install Fixed Furnishing and Equipment (FFE).

14. Other relevant construction activities as specified in each TO.

B) CONTRACTOR DUTIES

The Contractor shall be responsible for regular client reporting, monitoring of schedules, contract change management, management of permitting requirements, preventative maintenance inspections, certification of contract completion, document control, commissioning services, dispute resolution, monitoring and resolution of deficiencies and warranties, resolution of contractor performance issues, general technical assistance, and/or certification of progress payments. The Contractor shall:

1. Provide all labor, supervision, materials, equipment, construction means and methods, coordination, logistics, testing, surveys and tools necessary or reasonably inferable to successfully complete the Works in accordance with the contract terms and conditions.

2. Provide all temporary works, utilities and/or facilities necessary for the successful performance of this contract (e.g. water, power, sanitation, communications, etc.).

3. Be responsible for coordinating with local utility providers. The Contractor shall pay all costs incurred in connecting, converting, and transferring the utilities for the work. The Contractor shall make connections as identified on the plans, including providing backflow-prevention devices on connections to domestic water lines; providing meters; providing transformers; and making disconnections when necessary.

4. Provide adequate quality control measures to ensure that all work adheres to the applicable standards in the Design and Specifications.

5. Cooperate and coordinate with the TOCOR and/or its designated CMC, if applicable, at all times.

6. Provide life-support and security services for Contractor personnel at project sites.

7. Utilize a registered and licensed Customs Broker for importation of materials and/or equipment.

C) SITE ASSESSMENTS

The Contractor may be requested to develop and submit for USAID approval, site assessments and/or engineering assessments for specific TOs that establish the ”base-line” conditions of the existing site and facilities, and identify and prioritize the improvements to be included in the designs and subsequent construction documents.

D) CONSTRUCTION MANAGEMENT

The Contractor shall ensure that the various stages of the services are completed in a timely and seamless fashion, and shall be responsible for coordination and accomplishment of the overall project including the organizing, supervising, subcontracting, and purchasing of all materials and equipment necessary to accomplish the purpose of the designer. Contractor shall assure that construction is completed in accordance with approved technical specifications and plans and in compliance with all contract documents.

E) MANAGEMENT AND SUPERVISORY RESPONSIBILITIES

The Contractor shall provide direct management and supervision of Contractor personnel and subcontractors assigned to work on this contract. The quality of performance of the Contractor personnel and subcontractors is the direct responsibility of the Contractor. The TOCOR, may, on a frequent basis, directly coordinate with or provide technical guidance and direction or other types of information to the Contractor personnel and subcontractors concerning the technical or administrative aspects of work being performed. However, at all times the direct lines of communication for establishing work requirements and standards of quality shall come through the Contractor’s management chain of supervision.

As such, the Contractor shall establish a sufficient managerial and supervisory structure to ensure that work being performed by Contractor personnel and subcontractors is in accordance with the various TO scopes of work and that the quality of work being performed by Contractor personnel and subcontractors is representative of the Contractor’s best professional standards.

a) The Contractor shall keep fully informed of all national and local laws, customs, and regulations and all orders and decrees of bodies or tribunals having any jurisdiction or authority, which in any manner affect those engaged or employed on the work, or which in any way affect the conduct of the work.

b) If the Contractor observes that the contract documents are at variance with any applicable law or regulation, he/she shall promptly notify the CO and the Engineer, any necessary changes shall be adjusted as provided in the contract for changes in the work. If the Contractor performs any work knowing it to be contrary to such laws, rules, customs, and regulations, and without such notice, he/she shall bear all costs arising therefrom.

c) The Contractor hereby represents and warrants that:

i. It is qualified to do business in Mozambique and that it will take such action as, from time to time hereafter, may be necessary to remain so qualified;

ii. It is not in arrears with respect to the payment of any monies due and owing to the Government of Mozambique, including but not limited to the payment of taxes and employee benefits, and that it shall not become so in arrears during the term of this Contract;

iii. It shall comply with all National and local laws, and regulations applicable to its activities and obligations under this Contract; and

iv. It shall obtain, at its expense, all licenses, permits, insurance, and governmental approvals, if any, necessary to the performance of its obligations under this Contract.

d) Only the CO is authorized to change or modify the contract. Neither the COR nor the Engineer is authorized to make any changes to the contract requirements.

F) CONSTRUCTION SUBMITTALS

The Contractor shall prepare construction submittals as required by TOs and IDIQ and shall monitor the timeliness of all such submittals in order to ensure their completion within the required time frames.

a) The contractor shall check and verify all field measurements and comply with the requirements specified in the contract before submitting any document. The contractor shall submit, to the Engineer, in accordance with the master project schedule, shop drawings and other material submittals with specific written information that he/she has satisfied his/her responsibility under the contract with respect to the review of the submission. The data on the shop drawing or material submittal must be complete with respect to quantities, dimensions, and other specified performance criteria to enable the Engineer to review the information.

b) All shop drawings and material submittals must show the name of the project, the submittal date, the section of the specification pertaining to this submission and the contract number.

c) Shop drawings shall be required for all items which are specifically fabricated for the work or when the assembly of several items is required for a working unit. Shop drawings are required for all concrete reinforcing and structural steel, specially made or cut masonry units, miscellaneous metal work, specially made millwork, plaster molds, special rough hardware and all heating, ventilating, plumbing and electrical items requiring special fabrication or detailed connections.

d) Contractor shall supply three copies of shop drawings and material submittals for use by the Engineer and USAID (if delivered in hard copy).

In addition to these, the contractor shall add the copies that he/she may desire to be returned for his/her own use.

e) The Engineer will examine and return shop drawings, material submittals, and requests for information (RFI) with reasonable promptness noting desired corrections, or approving them with or without conditions, or rejecting them. The Contractor shall allow the Engineer and USAID up to 14 calendar days (unless a longer review time is identified in the contract documents) following receipt of each submittal or resubmittal of shop drawings, material submittals, and RFIs to review the documents and respond to the Contractor. The time for the review shall be increased to the extent that additional time for review is needed due to the fault or responsibility of the Contractor or his/her subcontractors and suppliers.

The Contractor will be notified of the cause of the delay and advised of how long it will take to complete the review; provided however that mere failure to give the Contractor such notice shall not entitle the Contractor to compensation or a time extension.

f) The Contractor is responsible for checking dimensions and existing conditions in the field.

g) When the Engineer notes desired corrections or reject the drawings, the Contractor shall resubmit the drawings with proper corrective changes in a timely manner. USAID reserves the right to charge the Contractor its actual cost for review of re-submittals.

h) Unless the Contractor has, in writing, expressly notified the Engineer and USAID to the contrary at the time of the submission, USAID and the Engineer may assume that shop drawings and other material submittals from the Contractor are in conformity with the contract and do not involve any change in the contract price, or any change which will alter the space within the structure, or alter the nature of the building or work from that contemplated by the contract documents, or constitute a substitution of materials or equipment or a change in the contract or the SOW. If the Contractor fails to give notice strictly in accordance with this subsection, approval of any shop drawing or material submittal shall not be binding to

USAID.

i) Should the Contractor consider any rejection or notation by USAID or the Engineer on the shop drawings or other submittals, or any other action or inaction of USAID or the Engineer, to cause an increase or decrease in the requirements of the SOW, the Contractor shall:

i. Desist from further action relative to the item he/she questions;

ii. Immediately notify in writing the Engineer and the CO; and

iii. Furnish both, within fourteen days, with a written statement of the increased or decreased cost involved.

No work shall be executed until the entire matter is clarified and the Contractor is ordered by the CO to proceed. Failure of the Contractor to serve written notice, as required above, shall constitute a waiver of any claim in relation thereto.

j) Individual submittal is not required for similar projects under the same task order unless the contractor uses different materials.

k) Contractor shall submit material submittals and test results every time when there is a change in the source of material from originally approved.

G) COORDINATION AND IMPLEMENTATION OF WORK

The Contractor shall advise the TOCOR of any discrepancies, ambiguities, and lack of clarity noted in drawings, and other data furnished for use in connection with any TO. The review periods established in the completion schedules set forth in the TO’s are the maximum anticipated periods required with the Contractor making every effort to accomplish reviews within shorter periods.

Upon written approval from the Contracting Officer, the Contractor shall make all necessary corrections and/or revisions to construction plans and specifications, design analyses, quantity surveys, cost estimates, schedules, reports, and drawings, as defined under individual TOs. Contractor shall also make corrections thereto as may be necessary due to errors or omission identified by the Contractor or the TOCOR. This includes the preparation of addenda during the solicitation period, or changes during construction, which may be required as a result of such deficiencies.

All engineering manuals, guides, specifications, and other data furnished by the USAID shall be returned within seven (7) calendar days following final acceptance of the TO to the TOCOR. Final implementation and mobilization plans for the activities will be based on the work plan to be developed by the Contractor under the specific TO.

H) QUALITY CONTROL / QUALITY ASSURANCE

Unless otherwise stated in the TO, construction quality at sites will be ensured through an integrated system of Quality Control by the Contractor and Quality Assurance services provided by USAID. The Contractor shall be responsible for constructing the work in accordance with approved plans and specifications. The Contractor shall be responsible for establishing procedures, tests, checks and controls during the construction process which will assure that construction quality (as required by contract documents) is maintained.

Quality Assurance performed by USAID will serve to verify that the levels of workmanship and quality of materials stipulated in the contract specifications are met. The TOCOR will accomplish these tasks by assigning a Quality Assurance Engineer (QAE), CMC, and/or independent Architectural and Engineering firm (A/E firm). Notwithstanding Quality Assurance efforts of USAID, Contractor shall remain fully responsible and liable for the quality work performed under this IDIQ.

I) COST CONTROL REPORTING SYSTEM

The Contractor shall develop and implement a cost control reporting system including financial data required by TOCOR to monitor progress of cost versus budget for all activities under the contract. Contractor shall forecast cost based on changes in project conditions as each element progresses through its various stages. Contractor’s cost control and reporting system shall include provision of “look ahead” schedules, “earned value” analysis and simulations capable of depicting “what-if” scenarios.

J) SOURCE OF SUPPLY AND QUALITY OF SOURCE MATERIALS

The Contractor shall furnish only new materials and supplies for incorporation into the Work, except as specifically otherwise permitted in the Contract. All materials and supplies shall be stored in such a manner as to ensure the preservation of quality and fitness, and for efficient facilitation of inspection. Materials shall comply with the terms and conditions of the contract. Materials shall be subject to inspection by USAID and its CMC at any time.

The quality of all materials shall conform to requirements listed in the Technical Specifications.

Manufacturers test reports may supplement Contractor's inspections, sampling, testing, and certification provisions for new materials. Manufacturers’ warranties, guarantees, instruction sheets, parts lists, and other material that are furnished with certain articles or materials incorporated into the project shall be provided to the TOCOR and CMC with each Application for Payment.

K) GENERAL SAFE WORK PRACTICES

The Contractor shall establish standard operating procedures to train employees in safe work practices. All employees, including managers and supervisors, shall conduct regular training and instruction on general and job-specific safety and health practices.

The Contractor shall provide specific instructions to each employee regarding hazards unique to each specific task, to the extent that such information is not covered in other trainings. The Contractor shall establish written safe work practices covering all phases of work. Safety, Quality and all other project programs and requirements that are placed upon the Contractor shall all be required of all Sub-Contractors.

L) REPORTING OF ACCIDENTS AND SECURITY INCIDENTS

The Contractor shall immediately notify the TOCOR and CMC of any accident or incident pertaining to the security of its personnel, equipment, the site, or the completed Works as soon as possible after its occurrence. The Contractor shall conduct a detailed investigation and provide a comprehensive report to the TOCOR and CMC addressing:

1. What occurred (with explanatory sketches or photos as necessary)

2. Who was involved (including names and affiliations of such persons)

3. What caused the incident

4. When the incident occurred (time and date)

5. Where the incident occurred

6. Why the incident occurred

The report shall fully describe the means and measures the Contractor shall take to prevent the future occurrence of such incident. In the case of any fatality or serious injury, the Contractor shall, in addition, notify the TOCOR and CMC immediately by the quickest available means.

M) DATA RIGHTS

USAID shall retain the sole and unlimited right to own and use any design, document, drawing, notes, calculations, specifications, or other works developed in the performance of this contract by the Contractor at no additional cost to USAID/Mozambique. The Contractor shall relinquish its right to publish, advertise, or use any material created in the performance of this contract for gain or profit, without a written approval from USAID.

N) PERMITS / CUSTOMS

The Contractor may request the TOCOR, in writing, if any reasonable assistance is needed in the permit clearance process. A request for assistance shall not relieve the Contractor of any responsibility or obligation for these tasks, nor shall the Contractor hold USAID liable for any delays, damages or inabilities to assist. The Contractor shall:

1. In accordance with 48 CFR 52.236-7 “Permits and Responsibilities”, be responsible for obtaining all necessary licenses and permits, and for complying with all Government of Mozambique and local laws, codes, and regulations applicable for the performance of the contract.

2. To manage the customs clearance process for all imported construction materials, supplies and equipment.

O) SUSTAINABILITY

Learning from this IDIQ will be directly applicable to future programming. This activity is directly tied to renovation, but the framework could well be adaptable to other contexts where there is need for increased coordination and communication among service providers, NGOs, the government and the global donor community. Improved synergy and shared knowledge has been consistently shown to expand programmatic impact, conserve resources by avoiding duplication, and ensure widely-reaching provision of high-quality services, regardless of the technical area.

This is especially crucial in Mozambique where the coordination capacity of the country government is limited. Success and challenges of this program could inform similar recovery and rebuilding efforts in other sectors within the country.

C.5 TASK ORDER DELIVERABLES

The following shall apply to each TO that contains elements of permanent construction as defined in defined in each TO:

A) PRE-CONSTRUCTION CONFERENCE

Prior to start of work with each Subcontractor, the Contractor shall conduct a pre-construction conference to acquaint key personnel, local authorities, inspectors and other involved parties with the procedures, lines of authority and the interrelationship with the Contractor and TOCOR.

B) SCHEDULE

The Contractor shall create, submit for TOCOR approval, and maintain a Critical Path Method (CPM) based schedule for the TO. The Contractor shall integrate all subcontractors’ schedules into the CPM schedule. At a minimum, the schedule shall reflect: baseline schedule (award schedule), all critical path activities, actual progress, forecast schedule for remaining work, estimated completion date, and other data as may be specified in the TO or reasonably required by the TOCOR.

The Contractor shall provide written notification to the TOCOR no less than seven (7) calendar days of any actual or potential delay(s) due to performance and/or other reasons.

The Contractor shall provide recommendations and actions it intends to take to mitigate the delay(s).

C) PROJECT COMPLETION AND TURNOVER ACTIVITIES

As required, the Contractor shall prepare and submit final as-built drawings of completed work and operation and maintenance manuals for all major systems and ensure the proper start-up and usability of each separate project, as defined in each TO. The Contractor shall prepare contract closeout and turnover documentation pertaining to construction according to contract requirements. TOs may require a one (1) year warranty period on all equipment, systems, and construction works.

D) BRANDING AND MARKING PLAN

Within fourteen (14) calendar days from the performance start date as specified in the TO, the Contractor shall develop and submit for TOCOR approval, a Branding and Marking Plan as defined in Section D of the IDIQ.

E) SITE LAYOUT PLAN

Within fourteen (14) calendar days from the performance start date as specified in the TO, the Contractor shall develop and submit for TOCOR approval, a site plan clearly indicating the locations of temporary facilities (including layouts and details), on-site and off-site equipment and material storage areas, locations of any specific environmental mitigation measures, and any additional information the Contractor deems essential for the performance of this contract. At a minimum, the Contractor shall identify the locations of safety and construction fences, site trailers, construction entrances, trash dumpsters, sanitary facilities, and construction parking areas.

F) SECURITY PLAN

the Contractor shall develop and submit for TOCOR approval, a Security Plan that shall clearly detail means and procedures to be used by the Contractor to ensure adequate security for all personnel, materials, equipment, and all other property related to the performance of the TO.

G) GENDER EQUITY PLAN

Gender issues are central to the achievement of strategic plans and Objectives for USAID.

USAID policy requires that gender issues be addressed, as appropriate, in all USAID-funded activities.
