The SWIFT 5 IDIQ will provide the US Agency for International Development's Office of Transition Initiatives with the means to support US foreign policy objectives through two components. The second component is OTI program operations long-term technical assistance support, restricted to small businesses, to recruit and deploy long-term technical assistance to support OTI program operations. Amendment #02 clarifies that a letter of credit may only be sought for awardees under the grants under contract component of the transition programs work. Offerors must propose separate ceiling percentage fees with and without a letter of credit.

QUESTIONS SPECIFIED AS RESTRICTED SWIFT-SUPPORT QUESTIONS

Question 20: Section H.36 AIDAR 752.232-70, Letter of Credit Advance Payment, Mar 2015, states that “Payment under this contract must be by means of a Letter of Credit (LOC) in accordance with the terms and conditions of the LOC and any instructions issued by the USAID, Bureau for Management, Office of the Chief Financial Officer, Cash Management and Payment Division (M/CFO/CMP).” Inclusion of this AIDAR seems to imply that a LOC will be available to awardees for both SWIFT-Support and SWIFT-Programs. Yet Section B.5.1 SWIFT- Programs Task Orders states “For the Grants Under Contract component of the Transition Activities Pool as discussed in Section C.4.1.2, a Letter of Credit (LOC) may be sought for awardees.” Is it the Government’s intention to only offer a LOC to SWIFT-Programs awardees with a Grants under Contract component only? Please clarify.

ANSWER: Yes, it is the government’s intention to only offer a LOC for the Grants Under Contract component of SWIFT 5-Programs contracts. A sentence clarifying that H.36 clause only applies in these situations has been added to the RFP via amendment #2.

UNSPECIFIED (RESTRICTED VS. UNRESTRICTED) QUESTIONS

Question 5: What is the letter of credit that is required?

ANSWER: A letter of credit is a method of payment that is defined in ADS 636. It is the government’s intention to only offer a LOC for the Grants Under Contract component of SWIFT 5-Programs contracts. A sentence clarifying that H.36 clause only applies in these situations has been added to the RFP via amendment #2.

AMENDMENT #02 TO SOLICITATION #7200AA18R00012, SWIFT 5 IDIQ

The following revisions are hereby incorporated into this solicitation:

1. RFP Section B.5.1(a), page 8, first full paragraph, Delete in its entirety and replace with the following in lieu thereof [added language underlined]:

“For the Grants Under Contract component of the Transition Activities Pool as discussed in Section C.4.1.2, a Letter of Credit (LOC) may be sought for awardees. However, since issuance of an LOC cannot be accomplished prior to award of the SWIFT 5 IDIQ contract, all Offerors must propose a ceiling percentage fee if issued an LOC and a separate ceiling fee percentage if not issued an LOC. This fee is for the administration of the GUC funds. Only the appropriate fee will be included in the Task Order contract upon award as follows:”

2. H.36, Delete in its entirety and replace with the following in lieu thereof [added language underlined]:

“H.36 Letter of Credit Advance Payment

As stated in B.5.1, a Letter of Credit May be sought for awardees, and this advanced payment method would ONLY apply to the Grants Under Contract component of SWIFT-Programs work.

As such, the following AIDAR clause only applies to the Grants Under Contract component of SWIFT-Programs work:

(a) Payment under this contract must be by means of a Letter of Credit (LOC) in accordance with the terms and conditions of the LOC and any instructions issued by the USAID, Bureau for Management, Office of the Chief Financial Officer, Cash Management and Payment Division (M/CFO/CMP).

(b) Immediately upon award, or as soon as the Letter of Credit payment method is approved by the contracting officer, contractors without an established LOC account must submit the following forms with original signatures, to the address specified below:

Forms:

(1) A signed original SF-1199A (Direct Deposit Sign-Up Form); and

(2) “Division of Payment Management Payment Management System Access Form” found at the Department of State and Human Services (DHHS) Web site.

Address: ATTN: James DuBois, U.S. Agency for International Development, M/CFO/CMP—LOC Unit,1300 Pennsylvania Ave. NW., SA-44, Room 430- J, Washington, DC 20523-7700.

Contractors must also submit the forms specified above electronically to loc@usaid.gov.

(c) As long as the LOC is in effect, the terms and conditions of the LOC and any instructions issued by M/CFO/CMP constitute the payment conditions of this contract, superseding and taking precedence over any other clause of this contract concerning payment.

(d) If the LOC is revoked, payment may be made on a cost-reimbursement basis, in accordance with the other clauses of this contract concerning payment.

(e) Revocation of the LOC is at the discretion of M/CFO/CMP after consultation with the contracting officer. Notification to the contractor of revocation must be in writing and must specify the reasons for such action. The contractor may appeal any such revocation to the contracting officer, in accordance with the Disputes clause of this contract. Pending final decision, payments under the contract will be in accordance with paragraph (d) of this clause.”
