EXECUTIVE SUMMARY

Langan Engineering, Environmental, Surveying and Landscape Architecture, D.P.C. prepared this Limited Pre-Renovation Hazardous Building Materials (Hazmat) Survey Report for six residential buildings (Units #1-#11) and the galley storage shed located at 12 Lighthouse Road, Northport, New York. Langan was given access for asbestos and lead XRF screening in units

#1-#4 and #6-#8 and to units #1-#11 for radon testing. All of the residential construction appears to be similar and uniform. The objective of this Limited Hazmat Survey was to identify the presence or absence of asbestos-containing materials (ACM), lead-based paint (LBP), radon and universal or hazardous waste articles prior to performing activities that would disturb them.

The planned renovations consist of the following and the survey was limited to accessible materials possibly to be disturbed by the planned work: replacing boilers, heaters, windows and doors and basement/crawl space fiberglass insulation.

Newport, New York contractor if they are to be disturbed by planned renovation activities. A licensed asbestos abatement project designer and abatement project monitors/air sampling technicians will also be required if abatement is necessary. The sheetrock and taping compound will be disturbed by the planned renovation work. This material when analyzed as a composite is less than one percent asbestos, therefore not regulated by EPA or New York State, however OSHA regulations are applicable and proper engineering controls should be in place to prevent visible emissions and possible exposure to workers and building occupants. The boilers should be sampled at a later date to confirm if the interior and exterior materials contain asbestos. This testing should occur after the unit(s) are no longer functional since testing will damage the units.

Lead Based Paint (LBP)

Based on the limited testing XRF screening data and comparison of the data to the Housing and

Urban Development (HUD) guidelines (1.0 mg/cm2), the paint on following building components was identified as LBP:

Interior Wood Window Components

The paint on the concrete base, interior door trim, walls and interior window components should be considered to contain lead based paint as defined by HUD. A TCLP sample will be required if the shed is to be demolished in order to properly classify the waste (lead waste versus regular construction debris). OSHA regulations will apply to the work and the contractor must follow all applicable HUD, NY State and local health department regulations as well as ground surface protection from possible lead contamination during work/demolition. This survey did not include full HUD testing that encompasses comprehensive XRF sampling, lead in water, soil and dust sampling.

Radon

Passive radon detection canisters were placed in the first floors of Units #1 - #11 and the radon results for all of the residential units were all below the EPA action guideline of 4.0 pCi/L.

Universal and Hazardous Waste Articles

Universal and other Hazmat waste articles consisting of light bulbs (possibly ballasts), batteries, possible mercury containing thermostats, smoke detectors, air conditioning units, unit heaters, electric motors, wall mounted electronic devices with circuit boards, transformers, computer equipment, paints, refrigerants, fire extinguishers, chemicals, gasoline, oils, etc. were identified throughout the interior and exterior of the buildings. Universal/hazardous waste articles affected by planned work will need to be properly removed, recycled, and/or disposed of at a landfill permitted to accept such waste. The removal, handling, recycling, and disposal shall be performed in accordance with applicable Federal, State, and local regulations.

Please see section 9.0 of the report for known limitations, exceptions and assumptions for this limited survey.

1.0 INTRODUCTION

Langan Engineering, Environmental, Surveying and Landscape Architecture, D.P.C.

prepared this limited Pre-renovation Hazardous Building Materials (Hazmat) Survey

Report for six residential buildings (Units #1-#11) located at 12 Lighthouse Road, Northport, New York. The objective of this Hazmat Survey was to identify the presence/absence of asbestos-containing materials (ACM), screening for lead-based paint (LBP), radon and universal/hazardous waste articles prior to performing renovation activities. The planned renovations consist of the following and the survey was limited to accessible materials possibly to be disturbed by the planned work: replacing boilers, heaters, windows and doors and basement/crawl space fiberglass insulation.

The remainder of this Report presents our observations, findings, laboratory test results of samples collected, and plans showing sampling locations.

2.0 SITE DESCRIPTION

The portion of the Subject Property planned for renovations is currently improved with six residential buildings (one-triplex, three-duplex, and two-single family houses), playground, lighthouse, four additional buildings, a tennis court, and multiple out-

3.0 SURVEY METHODOLOGY

Asbestos-Containing Materials

The asbestos survey was conducted in accordance with EPA protocol outlined in the

EPA publication “Asbestos in Buildings”. Suspect ACM to be disturbed by planned renovations was visually identified during a room-by-room, floor-by-floor survey of the building. Suspect ACM was categorized into various homogeneous materials and types, and sampled and analyzed for asbestos content. Sampling and analysis was conducted in accordance with EPA protocol 600/M4-82-020 per 40 CFR 763. Samples collected were properly packaged in individual containers, sealed; catalogued and chain-of-custody documentation was completed. Quantities of suspect materials were recorded and observations such as physical condition and friability of the materials were also noted. Samples were analyzed by EMSL of Cinnaminson, NJ. This survey was as a

“limited” pre-renovation NESHAP survey. Additional surveys may be required once the spaces have been vacated to access inaccessible areas and areas/materials that could not be sampled due to current occupancy/use.

Lead-Based Paint Screening

A Niton XL300 X-Ray Fluorescence (XRF) Spectrum Analyzer was used to survey the subject building for the presence of lead-based paint (LBP). The Niton analyzer uses a cadmium 109 radioactive source and an advanced solid-state radiation detector to generate an x-ray fluorescence spectrum of a painted surface. During the analysis, the intensity of the x-rays is converted by the instrument’s internal software into an estimate of the concentration of lead in the substance being analyzed. The results are interpreted as concentrations of lead in milligrams per square centimeter. This device is a field-screening tool, used to collect multiple readings in a short period of time. The method of measurement is based on spectrometric analysis of lead x-ray fluorescence within a controlled depth of interrogation. The reading is an estimate of lead content in all layers of paint. The results are displayed in milligrams per square centimeter

(mg/cm2). This survey included an XRF screening of representative accessible painted surfaces only. The lead based paint screening only included accessible painted materials known to probably be disturbed by planned renovations/demolition. This survey did not include full HUD testing that encompasses comprehensive XRF sampling, lead in water, soil and dust sampling.

And Gallery Storage Shed

Newport, New York

Radon

Passive radon detection canisters were placed on the first floors of Units #1 - #11. The detection canisters were placed in accordance to EPA recommended guidelines and

1993 EPA publication “Protocols for Radon and Radon Decay Product Measurements in

Homes”: at least twenty inches from the floor, twelve inches away from exterior walls, away from HVAC intakes and returns, doors and at least thirty six inches from windows.

Closed building conditions (at least 12 hours prior to test) were recommended for the testing.

Universal and Hazardous Waste Articles

Langan performed a walkthrough of the accessible areas and noted universal and possible hazardous waste materials.

4.0 ASBESTOS CONTAINING MATERIALS

4.1 Terminology

Suspect Asbestos-Containing Materials

Asbestos was used in certain types of construction and building materials. Until a material is examined using light microscopy or a similar technique, the building material is considered as a suspect asbestos-containing material. A few examples of these materials include floor tiles, ceiling panels, thermal system insulation, fireproofing insulation, roofing materials, etc. Any suspect ACM of unknown asbestos content (that is not tested) should be handled as if it were an asbestos containing material.

Asbestos–Containing Material

A material with an asbestos concentration greater than one percent by weight is considered to be asbestos-containing by the United States Environmental

Protection Agency (USEPA). Thus, a material which contains asbestos in concentrations greater than 1% by weight is considered as “positive” while materials that do not contain asbestos or asbestos is detected in concentrations less than one percent by weight are considered as “negative”.

FOR INFORMATION ONLY

And Gallery Storage Shed

Newport, New York

4.2 Observations and Findings

The field survey of the subject buildings was conducted on 25 August 2016 by

Langan’s Matthew Myers. During the survey, suspect materials observed in the buildings were documented, assessed, quantified, and sampled as necessary.

As required by the USEPA, samples were analyzed by individual layer (i.e., floor tile & the associated mastic were analyzed as two (2) separate samples). Bulk samples of the suspect ACM were analyzed using the Polarized Light

Microscopy (PLM) analytical methodology in accordance with 40CFR 763 and

NESHAP regulations. Non-friable organically bound (NOB) material samples which tested negative via PLM were reanalyzed using transmission electron microscopy (TEM). Some suspect materials were identified as having asbestos content greater than one percent by weight and are considered to be “positive” for asbestos in accordance with the EPA definition of an asbestos-containing material. Langan had to assume the boiler materials located in the utility rooms of each unit have asbestos containing materials. These materials could not be sampled on the date of inspection because the boilers are functional and sampling would damage them.

Refer to Table 1 for a detailed summary of asbestos survey findings. Refer to

Appendix A for the analytical test results and chain of custody documentation.

Sampling locations are depicted on Drawing ASL-1 and 2.

5.0 LEAD-BASED PAINT

The limited XRF LBP screening was conducted on 25 August 2016 by Langan’s Adem

Bajrami, a USEPA-accredited lead inspector. The locations screened primarily consisted of paint on walls, window and door components. The building components were observed to have mostly similar color surface paint.

The definition of lead based paint as per the Housing and Urban Development (HUD) guidelines was used to compare and evaluate painted surfaces. According to HUD, an

XRF reading below 1.0 mg/cm2 would designate paint as non-LBP, while a reading of

1.0 mg/cm2 or greater would designate paint as LBP.

The lead paint screening of the six residential buildings did not identify lead in excess of

1.0 mg/cm2. A summary of XRF screening data is provided in Table 2. The lead paint screening on the galley storage shed did identify lead in excess of 1.0 mg/cm2 on the

And Gallery Storage Shed

Newport, New York interior wood door trim, window components, walls, and exterior concrete base/foundation.

6.0 RADON

Passive radon detection canisters were placed on 25 August 2016 in the first floors of

Units #1 - #11 and picked up on 29 August 2016. The sampling was performed by

NEHA radon certified tester, CT Basement Systems Radon, Inc. The detection canisters were placed in accordance to EPA recommended guidelines and 1993 EPA publication “Protocols for Radon and Radon Decay Product Measurements in Homes”:

at least twenty inches from the floor, twelve inches away from exterior walls, away from HVAC intakes and returns, doors and at least thirty six inches from windows.

Closed building conditions (at least 12 hours prior to test) were recommended for the testing. Results can be found in Appendix B.

USEPA has an action guideline of 4.0 pCi/L and recommends taking further action if results are at or over 4.0 pCi/L. The radon results for all of the residential units were all below the EPA action guideline of 4.0 pCi/L.

7.0 UNIVERSAL/HAZARDOUS WASTE

As mandated by Subtitle C of the Resource Conservation and Recovery Act (RCRA), EPA promulgated hazardous waste regulations in 1980 to ensure that wastes which pose a threat to human health and the environment should be managed safely.

Hazardous waste is a waste with properties that makes it potentially harmful to human health or the environment. Hazardous waste are divided into listed wastes, characteristic wastes, universal wastes, and mixed wastes.

During Langan’s survey, a visual inventory of articles which could potentially become hazardous waste was performed which included light bulbs (possibly ballasts), batteries, possible mercury containing thermostats, smoke detectors, air conditioning units, unit heaters, electric motors, wall mounted electronic devices with circuit boards, transformers, computer equipment, paints, refrigerants, fire extinguishers, chemicals, gasoline, oils, etc. For the purpose of this report, ballasts associated with the lamp fixtures may contain PCBs or other regulated materials; smoke detectors are assumed to contain radioactive materials; and air conditioners and heat transformer systems are assumed to contain CFCs and/or HCFCs.

8.0 CONCLUSIONS AND RECOMMENDATIONS

8.1 Asbestos Containing Materials

Regulatory Guidelines and Requirements

Federal

In accordance with the Clean Air Act (CAA), the U.S. Environmental Protection

Agency (EPA) established National Emission Standards for hazardous Air

Pollutants (NESHAP) to protect the public from exposure to airborne pollutants.

Asbestos was one of the air pollutants, which was addressed under the

NESHAP 40 CFR Part 61. The purpose of asbestos NESHAP regulations is to protect the public health by minimizing the release of asbestos when facilities, which contain ACM, are being renovated or demolished. EPA is responsible for enforcing regulations related to asbestos during renovations and demolition, however, the CAA allows the EPA to delegate this authority to State and Local

Agencies. Even after EPA delegate’s responsibility to a state or Local agency, EPA retains the authority to oversee agency performance and to enforce

NESHAP regulations as appropriate.

State

Asbestos in New York State is regulated under the Labor Law Section 906, Part

56 of Title 12 of the Official Compilation of Codes, Rules, and Regulations.

Within the department and for the purpose of the Department of Labor, this part

(rule) is known as Industrial Code Rule No. 56 (ICR 56) relating to hazards to the public safety and health, during the removal, encapsulation, or disturbance of friable asbestos, or any handling of ACM that may result in the release of asbestos fiber.

Asbestos containing materials were identified in the buildings surveyed. Refer to

Table 1 for a summary of asbestos survey findings.

All confirmed ACM will need to be removed prior to any building renovation activities. The removal and disposal of ACM must be performed by a NYS-DOL licensed asbestos handling contractor in accordance with Federal, state, and local regulations. Proper notifications must be filed with the US-EPA, NYS-DOL and other regulatory agencies prior to performing such activities. Langan

FOR INFORMATION ONLY

And Gallery Storage Shed

Newport, New York recommends having abatement specifications completed by a licensed asbestos abatement designer.

As required by the NYS-DOL regulations, the abatement project must be monitored by a NYS-DOL certified project monitor. The project monitor oversees contractor’s work practices and also performs pre, during, and final clearance post abatement air sampling in accordance with the state regulations.

8.2 Lead Based Paint

Based on the limited XRF screening data and comparison of the results to the

HUD guidelines, the paint on several building components was identified as LBP.

Refer to Table 2 for the XRF screening data. This survey did not include full HUD testing that encompasses comprehensive XRF sampling, lead in water, soil and dust sampling.

Please note that although the HUD defines lead based paint as paint having lead concentrations equal or greater than 1.0 mg/cm2, the Occupational Safety and

Health Administration (OSHA) considers any concentration of lead in paint to be lead containing paint. Regardless of the lead concentrations in paint, the contractor shall comply with 29 CFR 1926.62, OSHA regulations, and take precautionary measures for dust control and limit employee exposure to lead dust during the renovations.

Painted surfaces that would be impacted by planned activities such as drilling, cutting, welding, scrapping, etc. and create dust should be properly addressed by following safe work practices, good housekeeping procedures and/or following proper abatement procedures. Grinding and sanding of paint without

HEPA filter exhaust, open flame gas fired torch, unconfined abrasive blasting, FOR INFORMATION ONLY

And Gallery Storage Shed

Newport, New York and chemical strippers containing methylene chloride or other human carcinogenic chemicals are not recommended.

The Federal Resource Conservation and Recovery Act (RCRA) regulation governs the handling, transportation, and disposal of hazardous materials. Every demolition/renovation debris generator has the responsibility to determine whether the debris exhibits one or more of the characteristic wastes listed in subpart C of 40 CFR Part 261.

Metal objects painted with LBP are exempt from disposal regulations applicable to lead, provided they are properly recycled. All metal objects that are painted with LBP should be sent to a certified recycling facility.

The paint on the galley storage shed concrete base, interior door trim, walls and interior window components should be considered to contain lead based paint as defined by HUD.

8.3 Radon

The radon results for all of the residential units were all below the EPA action guideline of 4.0 pCi/L.

8.4 Universal/Hazardous Waste

Miscellaneous and universal wastes consisting of but not limited to light bulbs

(possibly ballasts), batteries, possible mercury containing thermostats, smoke detectors, air conditioning units, unit heaters, electric motors, wall mounted electronic devices with circuit boards, transformers, computer equipment, paints, refrigerants, fire extinguishers, chemicals, gasoline, oils, etc. were noted during the visual survey. For the purpose of this report, ballasts associated with the lamp fixtures may contain mercury/PCBs or other regulated materials; smoke detectors are assumed to contain radioactive materials; and air conditioners and heat transformer systems are assumed to contain CFCs and/or HCFCs.

Universal/hazardous waste articles affected by planned work will need to be properly removed, recycled, and/or disposed of at a landfill permitted to accept such waste. The removal, handling, recycling, and disposal shall be performed in accordance with applicable Federal, State, and local regulations.

9.0 LIMITATIONS, EXCEPTIONS AND ASSUMPTIONS

Opinions and recommendations presented in this report apply to site conditions and features as they existed at the time of Langan’s site visit, and those reasonably foreseeable. They cannot necessarily apply to conditions and features of which Langan is unaware and has not had the opportunity to evaluate.

Any suspect building material that is not listed in this report must be assumed to be

ACM and treated as such unless otherwise confirmed by laboratory testing. Additional suspect asbestos containing materials could be present behind wall/ceiling

/floor/component surfaces (pipe/duct insulation, wall and floor damp-proofing and tars/adhesives, multiple layers of flooring/walls/ceilings, paper under wood flooring), materials underneath asphalt, concrete and other ground surfaces (foundation damp-proofing, transite piping, etc.), hidden older caulking and glazing compounds

(inaccessible – possibly behind newer windows and doors – would need to demolish windows/doors to investigate), light backing insulation, interior components of crawl space heaters, sink undercoating, transite cement board (under newer siding and soffits), and fire door insulation (entry doors, door into utility room, etc – need to damage door to investigate). The roofing materials (except for storage shed) were not included as part of this survey. Langan was only allowed to obtain asbestos samples and perform lead based paint screening from a limited number of units. The units appear to be similar in appearance, have similar building history and building materials.

PCB sampling of caulking/glazing/sealant compounds, paints, tars, mastics, etc. was not performed as part of this survey.

The conclusions presented in this report are professional opinions based solely upon

Langan’s visual observations of accessible areas, laboratory test data and current regulatory requirements. These conclusions are intended exclusively for the purpose stated herein, at the site indicated, and for the project indicated.

It is important to recognize that even the most comprehensive scope of services may fail to detect all asbestos containing materials that may be associated with the property.

Langan cannot, therefore, act as insurers and cannot “certify” that all asbestos
