SOLICITATION NO. 70Z08518Q31847B00

COMBINED SYNOPSIS/SOLICITATION

NOTICE FOR FILING AGENCY PROTESTS

United States Coast Guard Ombudsman Program

It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the Government Accountability Office (GAO).

Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative

Dispute Resolution (ADR) forum rather than filing a protest with the GAO or some external forum.

Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the Contracting Officer or Ombudsman.

Informal Forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer. If the

Contracting Officer is unable to satisfy their concerns, interested parties are encouraged to contact the U.S.

Coast Guard Ombudsman for Agency Protests. Under this informal process, the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, Contracting Officer, and solicitation closing date (if applicable).

Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions. If the protester’s concerns are unresolved, an Independent Review is available by the

Ombudsman. The protester may file a formal agency protest to either the Contracting Officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103. If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. To be timely protests must be filed within the period specified in FAR 33.103(e). Formal protests filed under the OPAP program should be submitted to:

C.3 52.203-17 CONTRACTOR EMPLOYEE WHISTLEBLOWER RIGHTS AND

REQUIREMENT TO INFORM EMPLOYEES OF WHISTLEBLOWER RIGHTS

(DHS-USCG DEVIATION 14-01)(APR 2014)

(a) This contract and employees working on this contract will be subject to the whistleblower rights and remedies in the pilot program on Contractor employee whistleblower protections established at 41 U.S.C. 4712 by section 828 of the National

Defense Authorization Act for Fiscal Year 2013 (Pub. L. 112-239) and FAR 3.908

(b) The Contractor shall inform its employees in writing, in the predominant language of the workforce, of employee whistleblower rights and protections under 41 U.S.C. 4712, as described in section 3.908 of the Federal Acquisition Regulation.

(c) The Contractor shall insert the substance of this clause, including this paragraph (c), in all subcontracts over the simplified acquisition threshold.

(End of clause)

C.4 FAR 52.204-1 APPROVAL OF CONTRACT (DEC 1989)

This contract is subject to the written approval of the Section Chief, CPD, C&P2 and shall not be binding until so approved.

(End of Clause)

C.5 FAR 52.211-8 TIME OF DELIVERY (JUN 1997)(ALT. I, APR 1994)

a) The Government REQUIRES delivery to be made as per Attachment 1.

The Government will evaluate quotes that propose delivery of each quantity within the applicable delivery period specified above. Offers that propose delivery that will not clearly fall within the required delivery period specified above may be considered unacceptable and may be rejected. The Government reserves the right to award under either the required delivery schedule or the proposed delivery schedule. If the offeror proposes no other delivery schedule, the required delivery schedule above will apply.

b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed, or otherwise furnished to the successful offeror, results in a binding contract. The Government will mail or otherwise furnish to the offeror an award or notice of award not later than the day award is dated. Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails.

However, the Government will evaluate an offer that proposes delivery based on the

Contractor’s date of receipt of the contract or notice of award by adding (1) five calendar days for delivery of the award through the ordinary mails, or (2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term “working day” excludes weekends and U.S.

Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date, the offer will be considered nonresponsive and rejected.

*If an alternate delivery schedule is proposed for Contracting Officer's consideration, please submit schedule for each CLIN to be delivered.

(End of clause)

C.6 FAR 52.211-11 – LIQUIDATED DAMAGES – SUPPLIES, SERVICES, OR

RESEARCH AND DEVELOPMENT (SEPT 2000)

(a) If the Contractor fails to deliver the supplies or perform the services within the time specified in this contract, the Contractor shall, in place of actual damages, pay to the

Government liquidated damages of 20% of the value of the issued delivery order.

(b) If the Government terminates this contract in whole or in part under the Default –

Fixed-Price Supply and Service clause, the Contractor is liable for liquidated damages accruing until the Government reasonably obtains delivery or performance of similar supplies or services. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.

The Contractor will not be charged with liquidated damages when the delay in delivery or performance is beyond the control and without the fault or negligence of the Contractor as defined in the Default – Fixed-Price Supply and Service clause in this contract.

(End of Clause)

C. EVALUATION FACTORS

FACTOR I- TECHNICAL

The Offeror shall provide a clear understanding and certification that their proposed item complies with the technical requirements as stated in the specification, as detailed below.

In each case, the following areas shall be addressed:

Factor 1: Technical Capability of the item(s) offered to meet the Government requirement.

Offeror shall provide documentation certifying all parts to be provided under this contract are new, and are identical in part number and manufactured by the OEM as per Specification Section 3.1.2.

Offeror shall provide Quality Control Plan in accordance with FAR Clause

52.246-2 as per Specification Section 3.1.3.

Offeror shall provide documentation confirming an Inspection Plan will be provided as per the delivery schedule, as per Specification Section 3.1.4.

Offeror shall provide documentation confirming a Material Certification as per

Specification Section 3.1.5.

Factor 2- Delivery schedule- The offeror confirm in writing their ability to meet the proposed delivery schedule (Attachment 1) in accordance with FAR 52.211-8 or propose a different delivery schedule that meets the requirements of this solicitation.

Factor 3- Past Performance- The offeror shall identify at least two (2) but no more than four (4) relevant federal, state or local government or private contracts performed during the last three (3) years with similar scope and size when compared to this project, that demonstrated successful experience providing the items listed in Attachment 1 and meeting the requirements of Attachment 2. Offerors are authorized to provide information on problems encountered on the identified contracts and the offerors corrective actions. The Government shall consider this information, as well as information obtained from any other sources, when evaluating the offeror past performance. Offeror shall submit past performance information on Attachment 4- Past

Performance Information Form.

FACTOR II- PRICE

Complete Attachment 1 with prices for all Contract Line Item Number (CLIN). The offeror's Price quotations will be evaluated by CLIN level and the offerors with the lowest overall Price will be ranked accordingly. The Quote should include any quantity discounts offered by the offeror.

QUOTE EXPIRATION DATE: All quotes submitted in response to this solicitation shall be valid for 120 calendar days from the date specified for the receipt of quotes.

C.8 FAR 52.212-2 EVALUATION-COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a single contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

The following factors shall be used to evaluate offers:

Factor I – Technical

Factor II– Price

This acquisition will utilize the Lowest Priced Technically Acceptable (LPTA) procedure to make a best value award(s). A decision on the technical acceptability of each offeror’s quotes will be made. For those offerors which are determined to be technically acceptable, award will be made to the vendor(s) with the lowest overall price. The

Government intends to make an award based on the initial quotations. If further questions are required, the contracting officer may contact the offeror or offerors. Award will be made to the responsible offeror whose quotation conforms to all solicitation requirements, such as terms and conditions, representations and certifications, technical requirements, and also provides the best value to the Government based on the results of the evaluation described in the below paragraph.

FACTOR I- TECHNICAL

Each offeror’s technical quote will be evaluated to determine if the offeror provides a sound, compliant approach that meets the requirements of the Specification for Syntron

Face Type Propulsion Shaft Seal Assemblies, Attachment 2, and demonstrates a thorough knowledge and understanding of those requirements.

Technical has three factors that are equally important when compared to each other.

The price shall be evaluated to determine fairness and reasonableness. Award may be made without any type of discussions or negotiations.

An evaluation rating of Technically Acceptable / Non-Acceptable will be assigned upon completion of the technical quote evaluation. If an Offeror receives a technical rating of

“Non-Acceptable” they will not be considered for award.

RATING SYSTEM FOR TECHNICAL EVALUATION FACTORS

Rating Description

Acceptable Quote clearly meets the minimum requirements of the solicitation, as evidenced by all of the following:

1) documentation certifying all parts to be provided under this contract are new, are identical in part number and manufactured by the OEM, 2) Quality Control Plan in accordance with IAW FAR

52.246-2; 3) Documentation confirming an Inspection Plan will be provided; 4) Documentation confirming a Material Certification will be provided; 5) affirmative acceptance of delivery schedule OR proposed a delivery schedule that meets the requirements of this solicitation; and 6) relevant past performance demonstrating the offeror’s ability to successfully perform the required effort OR no past performance history exists OR the Contracting Officer has determined that the past performance information is not directly related or similar to the requirements in the RFQ.

Non-Acceptable Quote fails to meet requirements of the solicitation in any way to include any one or more of the following: 1) absence of documentation certifying all parts to be provided under this contract are new, are identical in part number and manufactured by the

OEM, 2) failure to provide a Quality Control Plan in accordance with IAW FAR 52.246-2; 3) failure to provide documentation confirming an Inspection Plan will be provided; 4) failure to provide documentation confirming a Material Certification will be provided; 5) failure to accept the solicitation’s delivery schedule or to propose a delivery schedule that meets the needs of the requirement; and 6) past performance information was provided or accessed that provides substantial doubt that the offeror will successfully perform the required effort.

The Government will evaluate Factor 1: Technical Capability of the item(s) offered to meet the Government requirement and determine whether the quote is acceptable or unacceptable. To be found technically acceptable under factor 1, an offeror must include all of the following in its Technical Quote:

Offeror shall provide documentation certifying all parts to be provided under this contract are new, are identical in part number and manufactured by the OEM.

The Offeror shall provide a Quality Control Plan in accordance with IAW FAR

52.246-2.

Offeror shall provide documentation confirming an Inspection Plan will be provided as per the specification

Offeror shall provide documentation confirming a Material Certification will be provided as per the specification

The Government will evaluate Factor 2: Delivery Schedule and determine whether the quote is acceptable or unacceptable. To be found technically acceptable under factor 2, an offeror shall describe their ability to meet the proposed delivery schedule in accordance with FAR 52.211-8 or propose a different delivery schedule that meets the needs of the government.

The Government will evaluate Factor 3: Past Performance to determine whether the quote is acceptable or unacceptable. - To be found technically acceptable under factor 3, the Government will review the 2-4 past performance references submitted with the quote on Attachment 4- Past Performance Information Form, as well as Contractor Performance

Assessment Reports (CPARS) and other existing past performance rating on relevant contracts and make a determination that relevant past performance demonstrates the offeror’s ability to successfully perform the required effort OR no past performance history exists OR the Contracting Officer has determined that the past performance information is not directly related or similar to the requirements in the RFQ. General trends in an offerors performance will also be considered.

References other than those provided by the Offeror may be used by the Government to obtain additional information that will be used in the evaluation of the offeror’s past performance such as government databases and internal organization. A quote will be deemed technically acceptable for the factor of past performance if the relevant past performance demonstrates the offeror’s ability to successfully perform the requirements of solicitation.

Offerors lacking relevant past performance history will receive a Neutral Rating for past performance. The offeror will be evaluated neither favorably nor unfavorably on past performance and the past performance factor will be treated as technically acceptable.

Consistent with FAR 15.306(a) & (b), offerors may provide information on adverse past performance information to which the offeror has not previously had an opportunity to comment.

FACTOR II –PRICE

The price shall represent the best price in response to the request for quote. All prices on

CLINs (Attachment I Schedule of Supplies and Delivery) shall be firm fixed-price with the cost of packaging, marking and bar-coding along with shipping, F.O.B.

Destination, included in the cost of the parts.

If adequate price competition is not obtained or if price reasonableness cannot be determined using price analysis of Government-obtained information, additional information in accordance with FAR 15.4 may be required to support the proposed price.

The Government intends to evaluate quotations and award a contract without discussions.

Therefore, the initial quotation should contain the vendor’s best terms from a cost standpoint and all other factors being considered. The Government reserves the right to seek information clarifying any element of a quotation prior to award without discussions. The Government reserves the right to conduct discussions if the Contracting

Officer later determines it necessary.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced.

Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Note: Unrealistically low proposed prices initially or subsequently, may be grounds for eliminating a quotation from competition either on the basis that the offeror does not understand or the offeror has submitted unrealistic quotations. The Government may make a final determination as to whether the Offeror’s quotation is acceptable or unacceptable solely on the basis of the initial quotations as submitted. Offerors are advised to submit quotations that are fully and clearly acceptable without requests for additional information. Offerors are required to meet all solicitation requirements, such as terms and conditions and technical requirements as outlined in the solicitation. Failure to read the specifications in its entirety will not relieve the offeror from the responsibility for properly estimating the difficulty or price of successfully performing the work.

Failure to do so will be at the offeror’s risk. All quotes submitted in response to this solicitation shall stand firm for 120 calendar days from the date specified in this solicitation for receipt of quotes (End of Provision)

C.9 FAR 52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS—
