NOTICE FOR FILING AGENCY PROTESTS

United States Coast Guard Ombudsman Program

It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the Government Accountability Office (GAO).

Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative Dispute Resolution (ADR) forum rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the Contracting Officer or Ombudsman.

Informal Forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer. If the Contracting Officer is unable to satisfy their concerns, interested parties are encouraged to contact the U.S. Coast Guard Ombudsman for Agency Protests. Under this informal process the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, Contracting Officer, and solicitation closing date (if applicable).

Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions. If the protester’s concerns are unresolved, an Independent Review is available by the Ombudsman. The protester may file a formal agency protest to either the Contracting Officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for reasons of unusual and compelling urgency or is determined in writing to be in the best interest of the Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103(d) (2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. To be timely protests must be filed within the period specified in FAR 33.103(e). Formal protests filed under the OPAP program should be submitted to OPAP@uscg.mil or by hand delivery to the Contracting Officer.

Election of Forum. After an interested party protests a Coast Guard procurement to the Contracting Officer or the Ombudsman, and while the protest is pending, the protester agrees not to file a protest with the GAO or other external forum. If the protest is filed with an external forum, the agency protest will be dismissed.

The Ombudsman Hotline telephone number is 202.372.3695.

The Contractor shall clean the catch basins of debris such as roots, sticks, gravel, leaves, and other debris, which may slow or stop flow. The Contractor shall avoid washing any obstructions through the piping systems. Cleaning and inspection of the storm drainage catch basins shall be performed twice a year in mid-spring (April) and again in late autumn or early winter (November/December). The results of the preliminary inspection shall be furnished to the COR within 7 calendar days from the date of inspection. The General Permit for the Discharge of Storm water from Small Municipal Separate Storm Sewer Systems issued by the Connecticut Department of Energy & Environmental Protection to the U. S. Coast Guard Academy requires the permittee to report the volume or mass of material removed from all catch basins. The Contractor shall furnish this information within 7 calendar days from the date of cleaning catch basins.

The preliminary inspection shall address the level of debris found, any obstructions to flow, and any visible damage to the structure of the manhole. The Contractor shall clean the manholes of debris such as roots, sticks, gravel, leaves, and other debris, which may slow or stop flow. The Contractor shall avoid washing any obstructions through the piping systems. Cleaning and inspection of the storm drainage manholes shall be performed once a year in the month of October. 10.1. CONTRACTOR QC PLAN (QCP)

The Contractor shall develop, submit within one week after contract award, and maintain a QCP delineating the Contractor’s QC program/inspection system to monitor and control their performance of services, as required in accordance with Section 9.0, Deliverables, herein.

10.2. The QC program/inspection system shall encompass all functions of the contract. The Contractor shall develop and implement quality control procedures addressing the areas identified in the PWS herein and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The Contractor's management shall keep the Coast Guard informed of all issues affecting quality to include timely and effective corrective actions. The QC records shall, in part, consist of checklists of inspections/service and shall indicate the nature, frequency, and number of observations made the number and type of deficiencies found, and the nature of corrective action taken as appropriate.

10.3. Additionally, the plan must include a description of the inspection system to cover all services listed on the performance work statement. The description must include specifics as to the areas to be inspected on both a scheduled and unscheduled basis, frequency of inspections, and the title and organizational placement of the inspectors. It must also include a description of the methods to be used for identifying and preventing defects in the quality of service performed, and a description of the records to be kept to document inspections and corrective or preventive actions taken.

The records of inspections must be kept and made available to the contracting officer, when requested, throughout the contract performance period and for the period after contract completion until final settlement of any claims under this contract.

11.0. QUALITY ASSURANCE REQUIREMENTS

11.1. FUNDAMENTAL GOVERNMENT RESPONSIBILITIES

The COR is responsible for representing the Contracting Officer for all facets of the requested services quality. The COR will carry out inspections, reviews and approvals, handle deficiencies, and ultimately accept on behalf of the Contracting Officer. The specific COR functions are identified below.

11.2. GENERAL QUALITY ASSURANCE FUNCTIONS

The USCG will evaluate the contractor’s performance under this contract. For those tasks listed on the PRS, the contracting officer’s representative (COR) will follow the methods of surveillance specified in this contract. USCG personnel will record all surveillance observations. When an observation indicates defective performance, the COR will require the contract manager or representative at the site to initial the observation. The initialing of the observation does not necessarily constitute concurrence with the observation, only acknowledgment that he or she has been made aware of the defective performance. USCG surveillance of tasks not listed in the PRS or by methods other than those listed in the PRS (such as provided for by the Inspection of Services clause) may occur during the performance period of this contract. Such surveillance will be done according to standard inspection procedures or other contract provisions. Any action taken by the contracting officer as a result of surveillance will be in accordance with the terms of this contract.

11.3. SPECIFIC QUALITY ASSURANCE FUNCTIONS

The COR shall establish an Inspection Schedule using the Quality Checklists from the Contractor’s QC Program. The COR shall perform the following Quality and Evaluative functions that comprise the Government Quality Assurance Surveillance Plan (QASP):

11.3.1 Carry out periodic inspections using the Quality Checklists.

11.3.2 Report findings resulting from these inspections to the Contractor or Contracting Officer.

11.3.3 If discrepancies are discovered as a result of the periodic inspections, or any other means, use Contract Discrepancy Report (CDR) to communicate them to the Contractor and follow up to ensure nonconformance are corrected.

11.3.4 The COR shall meet with the Contractor as agreed to or as often as necessary. The Contractor and COR shall sign the written minutes of these meetings, prepared by the COR. Should the Contractor not concur with the minutes, the Contractor shall state any areas of non-–concurrence in writing to the COR within 5 calendar days of receipt of the signed minutes.

11.3.5 Review changes as well as initial and annual equipment inventories.

11.3.6 Take appropriate actions based on Health, Safety, Environmental and any other inspection results.

12.0 PERFORMANCE REQUIREMENTS SUMMARY (PRS)

The PRS establishes key elements of Contractor performance that represent “mission essential” service requirements, which are identified in the table below in the “Service Output” column. The “Performance Objective” column represents the standard against which Contractor performance will be measured in relation to accomplishment of the corresponding service output. The performance objective or “standard” describes the minimum acceptable level of service by the Contractor for satisfactory performance. The “Acceptable Quality Level (AQL)” column displays the maximum allowable deviation from the performance objective, which, if exceeded, evokes the negative incentive specified in the table below.
