Solicitation No.: 70Z08019Q15002B00
Combined Synopsis and Solicitation
70Z08019Q15002B00
Overhaul of Northern Lights Ship Service Diesel Generators
Notice for Filing Agency Protests
United States Coast Guard Ombudsman Program
Ombudsman
It is the policy of the United States Coast Guard to issue solicitations and make contract awards in a fair and timely manner. Parties who believe a specific procurement is unfair or otherwise defective are encouraged to use the Coast Guard Ombudsman Program for Agency Protests (OPAP), rather than filing a protest with the Government Accountability Office (GAO) or other external forum. The OPAP is designed to resolve contractor protests in a faster, less expensive manner. Concerns of interested parties can be resolved through independent, government binding adjudication taking place outside the procuring activity's chain of command.
How do I file an agency protest?
Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the contracting officer or Ombudsman.
Informal Forum
Interested parties should first direct their concerns to the responsible contracting officer. If the contracting officer is unable to satisfy the concerns, the interested party is encouraged to contact the OPAP. Under this informal process, the agency is not required to suspend contract award performance. In order to ensure a timely response, interested parties should provide the following information: solicitation/contract number, contracting office, contracting officer, and solicitation closing date (if applicable).
Formal Agency Protest
Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the contracting officer through open and frank discussions. If the protester’s concerns are unresolved, the protester may file a formal agency protest with the contracting officer or the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined to be in the best interest of the government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. If the protester fails to submit the required information, as outlined in Federal
Acquisition Regulation (FAR) 33.103, resolution of the protest may be delayed or the protest may be dismissed. To be timely, protests must be filed within the period specified in FAR 33.103(e).
Protests filed under the OPAP program should be submitted to:

IX. FAR 52.212-2 Evaluation -- Commercial Items (Oct 2014)
(a) The Government will award one (1) requirements contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the
Government, price and other factors considered.
The following factors shall be used to evaluate offers:
Technical Plan
Past Performance
Price
The evaluation of quotations/quotes submitted in response to this solicitation shall be conducted utilizing a "tradeoff" process to obtain the best value to the Government. As part of the tradeoff determination, the relative strengths, weaknesses and risks of each quotation/quote shall be considered in selecting the offer that is most advantageous and represents the best overall value to the Government. A tradeoff will be made between cost and non-cost factors permitting acceptance of other than the lowest priced offer. In determining best value, the total cost/price, including options and other cost factors is considered to be less important than technical merit. Past performance is considered to be of equal importance to technical merit. However, the closer the merits of the combination of the technical plan and past performance are to one another, the greater will be the importance of price in making the award determination. In the event that two or more technical plan and past performance reports are determined equivalent, award may be made to the lower priced quotation/quote provided the price is reasonable and realistic.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the
Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
Evaluation Criteria: The evaluation will be based on a complete assessment of the offerors’ quotes. The assessment will address technical factors, past performance, and total evaluated price. The evaluation factors for this acquisition are as follows:
FACTOR 1 - TECHNICAL PLAN: The TET will evaluate the quality of each offeror’s technical plans. The assessment of the offerors’ technical plans will be used to evaluate the relative capability of the offerors to successfully meet the requirements in the specification. The technical evaluation process consists of the quotes being reviewed, evaluated and rated using a graded system that assesses the degree of compliance with the technical criteria requirements and the level-of-performance risk. The assessment will address technical factors.
The following eight (8) sub-factors will be scored adjectively. Technical plans must address each factor and rate satisfactorily to be found technically acceptable:
1. Valid agreement/letter from Northern Lights for use of service tools and possession of technical data.
Submission Requirement:
2. Contractor must demonstrate/prove experience performing successful overhaul of Northern Lights
Diesel Generators. The experience must include all aspects of the overhaul to include performance testing, internal preservation and special packing in accordance with (IAW) Northern Lights Inc.
specifications as appropriate.
3. Contractor’s lead technicians shall be Northern Lights certified to overhaul/remanufacture the Coast
Guards configuration of Diesel Generators.
4. Contractor must demonstrate logistical ability to perform individual parts packaging, marking, labeling, bar coding and shipping of large volumes of parts. Contractor must also demonstrate ability to provide warranty and technical support services. Provision of these services must not affect the contractor's ability to meet established due dates detailed in the contract.
5. Documented quality control plan. Documented test & measuring equipment calibration system IAW the specification.
7. Ability to provide secure indoor storage of all government furnished equipment (GFE).
8. Documented warranty support plan. Documented warranty support including number of operational hours and or calendar days which item will be warranted free of defects. At a minimum contractor will be required to provide a single point of contact who will serve as the project manager who will be available from 0800 to 1630 EST, Monday through Friday and provide a plan for warranty resolution within 24 hours of notification.
FACTOR 2 - PAST PERFORMANCE: The Price Evaluation Team (PET) with the TET members at the request of the PET or SSA will evaluate the quality of each offeror’s past performance. This evaluation is separate and distinct from the Contracting Officer’s responsibility determination. The assessment of the offerors’ past performance will be used to evaluate the relative capability of the offerors to successfully meet the requirements in the specification. The Offeror shall identify at least two (2) relevant past performance references completed within the last three (3) years. Relevancy considers size and scope similar to the same type of services that are being solicited.
The following four (4) past performance sub-factors will be scored adjectively as indicated above:
1. Quality of Product or Service
2. Schedule
3. Business Relations
4. Management of Key Personnel
In evaluating offerors past performance, the government intends to review U.S. Coast Guard
Contractor Performance Assessment Reports and other existing past performance ratings on relevant contracts. General trends in an offeror’s performance will also be considered. References other than those provided by the Offeror may be contacted by the Government to obtain additional information that will be used in the evaluation of the offeror’s past performance, such as government databases and internal organizational contacts.
The offerors shall include past performance information for any teaming partners to be utilized during performance. This past performance must be relevant to the scope of work they may perform under the requirements contract resulting from this solicitation.
Offerors lacking relevant past performance history will receive a neutral rating for past performance. The offeror will be evaluated neither favorably nor unfavorably on past performance. Relevant past performance history will be rated higher than neutral past performance.
FACTOR 3 - PRICE: The price evaluation shall be conducted as follows:
(a) Calculation of Total Price: The unit price of each Contract Line Item Number (CLIN) shall be multiplied by the actual or estimated quantity to arrive at an estimated total cost. The total of all CLIN's, including all option year CLIN's, shall be added together to arrive at an aggregate total.
(b) Evaluation of Options: The Government will evaluate offers, for award purposes only, by adding the total price for the base and all option years to arrive at a total price for the entire requirements contract.
The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the options.
(End of Provision)
X. Offerors must include a completed copy of the provision at FAR 52.212-3 OFFEROR
REPRESENTATIONS AND CERTIFICATIONS – COMMERCIAL ITEMS (NOV 2017) with its offer.
FAR 52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS – COMMERCIAL

Federal taxes in an amount that exceeds $3,500 for which the liability remains unsatisfied.
(i) Taxes are considered delinquent if both of the following criteria apply:
(A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.
(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.
(ii) Examples.
(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
(D) The taxpayer has filed for bankruptcy protection.
