About this file

This is a Justification for Other Than Full and Open Competition (JOFOC) document for the U.S. Coast Guard's procurement of evaluation and calibration services for Actuator and Trim/Feel Test Sets (P/N 418-65037-004) used on MH-65 helicopters. The document justifies sole source procurement from Safran Electronics & Defense, Avionics USA, LLC under FAR 13.106-1(b)(1) for an initial quantity of 4 units with an optional quantity of up to 10 additional units.

The justification cites that Safran (formerly Sagem Avionics) is the Original Equipment Manufacturer and only authorized repair provider, owning all rights to service manuals, technical data, and specifications needed for the work. The test sets are flight-critical safety items specifically designed for MH-65 helicopters in partnership with Airbus Helicopters. The procurement includes a 60-day turnaround time, with the option period extending one year after award. The Contracting Officer will determine fair and reasonable pricing through comparison with previous purchases and similar items in related industries. The requirement is unrestricted with a NAICS code of 811210 and small business size standard of $34 million in average annual receipts.

BRAND NAME – Items peculiar to one manufacturer: The particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs.

BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED AND THE INTENDED USE:

The United States Coast Guard (USCG) requires the evaluation and calibration (E&C) of the Test Sets listed in the following table. Based on the results of the E&C, additional repairs may be required to return the Test Set(s) to serviceable condition. The USCG intends to procure these services on a sole source basis directly from the Original Equipment Manufacturer (OEM), Safran Electronics & Defense, Avionics USA, LLC (CAGE Code: 003T0), hereinafter referred to as Safran.

The USCG intends to include an addendum to FAR 52.212-4 in the resultant purchase order. IAW this addendum, the USCG may require the E&C of additional units up to maximum optional quantity specified in the following table at the same price, terms, and conditions as specified in the original purchase order. The Contractor shall quote any repairs identified during the evaluation separately for approval and funding by the Contracting Officer. THROUGH YOUR MARKET RESEARCH TO SUPPORT THE JUSTIFICATION TYPE:

The original OEM of these Test Sets is Sagem Avionics which is now part of Safran. This test equipment was specifically designed for use on the MH-65 helicopters in partnership with the helicopter’s OEM, Airbus Helicopters, Inc. This is the only test equipment capable of ensuring the continued airworthiness of the MH-65 helicopter and is approved for use by the USCG’s Aircraft Configuration Control

Board (ACCB).

Market research has revealed that Safran is the only authorized repair provider for these test sets. Safran owns all rights to the service manuals, technical data, performance specifications, and drawings required to perform evaluation, calibration, and repair work on these

Test Sets. The proprietary rights to the technical data necessary to have this equipment serviced by other than the OEM are not owned by the Government nor are they licensed to any commercial sources.

These services are not available from any mandatory Government source IAW FAR 8.002 or from any non-mandatory source IAW FAR

8.004. Safran does not have any other authorized repair facilities. A combined synopsis/solicitation will be posted to the Contract Opportunities section of the web site at www.sam.gov. All responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency.
