JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SIMPLIFIED ACQUISITION PROCEDURES (SAP)

SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY ONE SOURCE IS REASONABLY AVAILABLE. THIS DETERMINATION MUST BE SUPPORTED WITH FULL JUSTIFICATION FOR SOLE SOURCE FROM THE CUSTOMER. WHEN THE CUSTOMER DESCRIBES AN ITEM WITH A PURCHASE DESCRIPTION WHICH LIMITS THE AVAILABILITY TO ONE SOURCE, THE JUSTIFICATION MUST EXPLAIN WHY THE ITEM IS THE ONLY ONE THAT WILL MEET THE GOVERNMENT’S REQUIREMENT.

STATEMENTS SUCH AS "ONLY KNOWN SOURCE" OR "ONLY SOURCE WHICH CAN MEET THE REQUIRED DELIVERY DATE" ARE

INADEQUATE TO SUPPORT A SOLE SOURCE PURCHASE.

IDENTIFICATION OF THE AGENCY AND THE CONTRACTING OFFICE, AND SPECIFIC IDENTIFICATION OF THE DOCUMENT AS A JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION.” PLEASE CITE THE AUTHORITY AND TYPE OF JUSTIFICATION.

The United States Coast Guard (USCG), Aviation Logistics Center (ALC), Engineering Services Division (ESD), Airworthiness Sustainment Branch (ASB), Vibration Program Office (VPO) anticipates the award of a firm-fixed price purchase order on a sole source basis. This justification for other than full and open competition is submitted for approval in accordance with (IAW) Federal Acquisition Regulation (FAR) 6.303-1(a) using the authority in FAR 6.302-1(b)(1)(ii) – only one responsible source and no other supplies or services will satisfy agency requirements.

BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED, AND THE INTENDED USE.

ESD requires the purchase of an OROS OR38 integral noise and vibration signal analyzer, part number (PN) OR38-INTG-

32). This analyzer will replace the first generation OROS OR38-32 Analyzer (PN: OR8110-32) which is no longer functioning or supported by the original equipment manufacturer (OEM). The OEM of both Analyzers is OROS, Inc.

(CAGE Code: 1KJ14). The OR38 Analyzer is equipped with 32 channels and works as a dynamic signal analyzer, portable vibration analyzer, and multichannel Fast Fourier Transform (FFT) spectrum analyzer. The Analyzer is used on all USCG aircraft types to perform rotating, structural, and acoustic analysis in order to conduct specialized dynamic engineering testing and troubleshooting on aircraft and their components. The OR38 Analyzer is a crucial measurement and analysis tool to determine airworthiness for the safe operation of USCG aircraft.

UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES

CAN BE USED.

The VPO currently uses multiple different models of OROS noise and vibration analyzers to conduct specific vibration troubleshooting and engineering testing. Only analyzers manufactured by OROS are compatible with the USCG’s existing equipment. In addition, the VPO is required to use OROS’s proprietary software, NVGate 8.3, in order to assemble, program, process, and analyze the data collected by these analyzers. Currently, NVGate 8.3 is the only advanced vibration diagnostic software approved by the USCG’s Telecommunications and Information Systems Command (TISCOM) approved for installation and use on USCG Data Network (known as CGOne).

Furthermore, market research has revealed that OROS, Inc. is the only manufacturer of multichannel noise and vibration signal analyzers that:

are capable of acquiring, measuring, and analyzing large amounts of noise and vibration data across up to 32 channels which are also suitable for use across all USCG aircraft platforms;

are able to measure up to 1,000 channels by cascading or distributing the analyzers; and are rugged and portable enough for use in the field.

A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT QUOTATIONS OR OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES

AS PRACTICABLE (INCLUDE YOUR MARKET RESEARCH EFFORTS HERE).

Extensive market research was conducted using both Government and commercial sources. This included querying the following information systems and web sites: Defense Logistics Agency (DLA) Federal Logistics Information Service

(WebFLIS); Department of Defense Electronic Mall (DoD EMall); General Services Administration (GSA) Advantage online purchasing service; Inventory Locator Service e-marketplace (ILSmart); internet search engines; and the OEM’s web site. This item is not available from any required or optional source of supply IAW FAR 8.002. This item is only available from OROS, Inc. and OROS, Inc.-owned distributors. A combined synopsis/solicitation will be posted to the

Federal Business Opportunities (FBO) web site at www.fbo.gov IAW FAR 5.101(a)(1). All responsible sources may submit a quotation which shall be considered by the agency.

REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES.

As the OEM of the OR38 Analyzer, OROS, Inc. owns all rights to the configuration and technical data, specifications, and drawings required for its production, including the Analyzer’s integrated software. OROS, Inc. has not licensed these rights to any other entity so there are no other sources capable of its manufacture.

The acquisition and analysis of the data captured from the aircraft and its components by the OR38 must be completely reliable and accurate. These critical measurements are used in diagnosing issues and making decisions which have a direct effect on the safety of the aircraft and its personnel.

EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN

COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE.

The Analyzer and its integrated software is complex and must meet critical operational and reliability requirements, the achievement of which require extensive and sophisticated testing. The Government does not own or possess any rights to the technical data, specifications, and drawings required to produce and test this Analyzer and it would not be economical to purchase these rights. In addition, the Government has not developed the technical data required to produce and test this

Analyzer and has no plans to do so.

PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO

COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED.

As previously stated, the Government does not own or possess any rights to the technical data, specifications and drawings necessary to produce the Analyzer. This has prevented the USCG from being able to provide an adequate technical description to potential new sources. Therefore, it is difficult to take steps to foster competition when the manufacturing, performance, and testing data are proprietary to the OEM.
