About this file

This is a Questions and Answers document that clarifies the applicable federal wage determination requirements for the USCG Base New Orleans swales and culverts repair contract. The document addresses a discrepancy regarding wage obligations, where the Statement of Work initially referenced the Service Contract Act, but the incorporated clauses included Construction Wage Rate Requirements (Davis-Bacon) along with a wage determination document titled "Construction Wage Rates for Orleans Parish." The Government's response confirms that this procurement is subject to Construction Wage Rate Requirements rather than Service Contract Act labor standards, requiring offerors to ensure their quotes reflect the correct Davis-Bacon wage determination for construction work on the project.

Questions and Answers

Question: The Statement of Work states that the Service Contract Act applies to this procurement. However, the incorporated clause package includes FAR 52.222-6, Construction Wage Rate Requirements, along with its related Davis-Bacon clause family, and the attached wage document is titled "Construction Wage Rates for Orleans Parish." We did not find any Service Contract Act labor standards clauses included in the package. Could you please confirm whether this procurement is subject to the Davis-Bacon Act (Construction Wage Rate Requirements) or the Service Contract Act, so we can ensure our quote reflects the correct wage determination?

Answer: Sorry for any confusion. This will be subject to the Construction Wage Rate Requirements.
