About this file
This is a Justification for Other Than Full and Open Competition submitted by the Department of Homeland Security, United States Coast Guard (USCG) for a sole source award to Lockheed Martin Corporation (LMCO).
The USCG seeks to award a five-year Indefinite Delivery Indefinite Quantity (IDIQ) contract with a hybrid Cost Plus Fixed Fee (CPFF) and Firm Fixed-Price (FFP) structure for Engineering and Sustainment Support Services for the Sea Commander system onboard the National Security Cutter fleet and the Maritime Communication Console. The contract will run from September 16, 2025, through September 15, 2030, with an estimated total value of $48,120,800. The minimum obligation is $11,090,800, funded through Fiscal Year 2025 USCG Procurement, Construction, and Improvement (PC&I) and Operations & Sustainment (O&S) funds. The services include performance specification reviews, asset performance specifications, training, technical field support, hardware and software development, sensor and tactical systems support, communication and navigation systems, information assurance, system certification and accreditation, testing, safety, and integrated logistics support. LMCO is the original designer and developer of the Sea Commander system and holds restricted data rights to the architecture, precluding competition from other entities. The justification cites 10 U.S.C. § 3204(a)(1) as the statutory authority for sole source procurement. A Request for Information published on SAM.GOV from January 7 through January 24, 2025, received four responses; market research conducted November 2024 through January 2025 identified no alternative sources capable of meeting the requirements. The contracting officer determined the anticipated price to be fair and reasonable based on the Independent Government Cost Estimate and comparison to previous contracts awarded to LMCO for similar services dating back to 2011.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
10 U.S.C. § 3204
Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.3, and in accordance with the requirements of FAR 6.303-1, the use of the statutory authority under FAR Subpart 6.302-1 is justified by the following facts and rationale as required by FAR 6.303-2:
1. Agency and Contracting Activity.
The Department of Homeland Security, United States Coast Guard (USCG), Office of Contract Operations Formal Contracts Division VII (CG-9127), Washington, D.C., proposes to enter into a contract on a basis other than full and open competition.
2. Nature and/or Description of the Action being Approved.
(a) Nature of the action: This sole source requirement is for Engineering and Sustainment Support Services for the Sea Commander system onboard the National Security Cutter (NSC) fleet and the Maritime Communication Console (MCC). The architecture is the foundation for a network that collects, processes, integrates, analyzes, evaluates and interprets mission information.
(b) Name and address of the contractor:
Lockheed Martin Corporation (LMCO) 199 Borton Landing Road Moorestown, NJ 08057
(c) Action Type: Hybrid Cost Plus Fixed Fee (CPFF) & Firm Fixed-Price (FFP) Five (5) Year Indefinite Delivery Indefinite Quantity (IDIQ) Contract
(d) Estimated total value (including options): Breakdown is shown below:
Period PoP Dates Total
Base Year 12 mo. 9/16/2025 9/15/2026 Option Year 1 12 mo. 9/16/2026 9/15/2027 Option Year 2 12 mo. 9/16/2027 9/15/2028 Option Year 3 12 mo. 9/16/2028 9/15/2029 Option Year 4 12 mo. 9/16/2029 9/15/2030

4. Identification of Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitting other than full and open competition is 10 U.S.C. § 3204(a)(1) implemented by the FAR Subpart 6.302-1 entitled One Responsible Source and No Other supplies or Services Will Satisfy Agency Requirements.
5. Identification of Exception to the Buy American Statute. Not applicable. USCG anticipates that the Buy American statute will apply to this acquisition.
6. Demonstration that the Nature of the Acquisition Require Use of the Authority Cited. LMCO is the original designer of the Sea Commander system and has asserted restricted data rights architecture which precludes any entity other than LMCO from supporting the Sea Commander system. Due to the proprietary nature, to compete this requirement, USCG would first have to procure a contract for the design, installation and integration of a replacement system comparable to Sea Commander into the NSC fleet. Such an effort would take a minimum of 24- 36 months to perform at a minimal cost of without appreciably improving the mission capabilities already present in Sea Commander. After award of the new system, the same level of follow-on engineering and sustainment support would still be required at the same or higher cost for the services contemplated herein.
