(ix) Evaluation criteria:

The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

The following factors listed in descending order of importance, shall be used to evaluate offers:

Factor 1: Technical Capability (Volume I) - The Government will assess its level of confidence for each offeror based on the offeror’s demonstrated understanding and ability to perform the requirements in Attachment 1 – Requirements Document, sections 3 through 18.

Factor 2: Past Performance (Volume II) – The Government will evaluate the offeror’s past performance information and determine the adjectival confidence rating. The currency and relevance of the information, source of the information, context of the data and general trends in contractor performance will be considered in the comparative assessment. The Government will review the offeror’s submitted past performance information for work that was performed within the last three years or is ongoing. The Government will also consider information provided by the offeror on problems encountered on the contracts identified and the corrective actions taken. The

Government reserves the right to utilize past performance information from sources other than those provided by the contractor—including, but not limited to the Contract Performance Assessment Reporting System (CPARS).

The Government may also consider past performance information regarding predecessor companies, key personnel who have similar experience or subcontractors that will perform major or critical aspects of the requirement when such information is deemed relevant by the Government. A contractor without a record of relevant past performance or for whom information on past performance is not available will not be evaluated favorably or unfavorably, but will receive a confidence rating of neutral.

Factor 3: Price (Volume III) – The Government will evaluate price based on the Total Evaluated Price provided in Attachment 3. The offeror’s price proposal will be evaluated, using one or more of the techniques defined in FAR 12.602 and 13.106, in order to determine if it is reasonable. Failure to complete and provide the Attachment 3 - Pricing Schedule will result in a determination of non-responsiveness and your proposal will not be evaluated for award. The final determination of price reasonableness is the responsibility of the Contracting Officer.

Award Determination – All non-price factors are listed in descending order of importance and, when combined, are approximately equal to price. As the technical proposals become closer in quality, price increase in relative importance.

The government intends to award a FFP contract without discussions. Per FAR Provision 52.212-1(g), “Contract award”, the USCG intends to award the contract resulting from this RFP without discussions, though the USCG reserves the right to hold discussions if later determined by the Contracting Officer to be necessary. The determination to hold discussions is a unilateral right of the Contracting Officer.

A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(x) Offerors shall include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications–Commercial Products and Commercial Services (May 2024), with its offer. See FAR 52.212- 3(b) for those representations and certifications that the Offeror shall complete electronically, and any other provision or clause fill-in requiring completion by the offeror.
