NOTICE FOR FILING AGENCY PROTESTS
United States Coast Guard Ombudsman Program
It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time- consuming litigation.
OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the Government Accountability Office (GAO).
Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative
Dispute Resolution (ADR) forum rather than filing a protest with the GAO or some external forum.
Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the Contracting Officer or Ombudsman.
Informal Forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer. If the
Contracting Officer is unable to satisfy their concerns, interested parties are encouraged to contact the U.S.
Coast Guard Ombudsman for Agency Protests. Under this informal process the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, Contracting Officer, and solicitation closing date (if applicable).
Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions. If the protester’s concerns are unresolved, an Independent Review is available by the
Ombudsman. The protester may file a formal agency protest to either the Contracting Officer or as an alternative to that, the Ombudsman under the OPAP program.
Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103(d) (2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. To be timely protests must be filed within the period specified in FAR 33.103(e).
Formal protests filed under the OPAP program should be submitted electronically to OPAP@uscg.mil and the Contracting Officer or by hand delivery to the Contracting Officer.
Election of Forum. After an interested party protests a Coast Guard procurement to the Contracting
Officer or the Ombudsman, and while the protest is pending, the protester agrees not to file a protest with the GAO or other external forum. If the protest is filed with an external forum, the agency protest will be dismissed.
The Ombudsman Hotline telephone number is 202.372.3695.

52.212-2 Evaluation - Commercial Products and Commercial Services (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: (1)
Technical Capability, (2) Past Performance, and (3) Total Evaluated Price.
All non-price factors are equal in importance to each other and, when combined, are approximately equal to price. As the technical quotes become closer in rating, price increases in relative importance.
The Government will evaluate written quotes to consider the following:
(1) Technical Capability
(2) Past Performance
(3) Total Evaluated Price
(1) Technical Capability: Quotes will be evaluated on how well the proposed Technical
Capability meet or exceed the requirements in SOW Sections 1.0 and 2.0. Evaluations will specifically consider how well an offeror's Technical Capabilities and Past Performance align with the SOW and Department of Defense’s Information Assurance Workforce
Qualifications, commonly referred to ‘8570 Certifications’ (DoD’s 8570, 8140), DoD
Cyber Workforce Framework (DCWF), and National Initiative for Cybersecurity
Education (NICE) frameworks.
Offerors shall directly address the sections in the SOW citing the SOW's numbering conventions. Address sections 1 and 2 of the SOW. When addressing “Access”, use the citation “2.1. ACCESS”. When addressing “On-Demand-Learning Platform”, use the citation “2.2 ON-DEMAND LEARNING PLATFORM”. Do the same up to subsection
2.3.1. The offeror may provide additional information that it deems meaningful as long as it is under the page limitation.
Failure to explain Contractor’s ability to meet all requirements may result in the
Contractor’s quote receiving a lower rating. There shall be no pricing information within
Volume I. The vendor shall include any assumptions with regard to its Technical
Capability in this Volume I. If alternate training categories are proposed, from the
Government’s Attachment 2 - Pricing Worksheet, provide sufficient rationale for the alternate in a narrative in Volume II.
(2) Past Performance: Only past performance determined to be relevant and recent will be evaluated. To be considered relevant and recent, the past performance being referenced must have been performed within the past three (3) years on efforts of similar scope and complexity to the work outlined in the SOW. The past performance evaluation will examine the extent to which the Offeror’s past performance demonstrates their ability to successfully conform to requirements and standards in terms of quality of support services and defined deliverables;
adherence to contract schedules; management, and customer satisfaction.
A lack of any relevant Past Performance information will be treated by the Government as a
“Neutral” rating under this evaluation factor. The USCG reserves the right to consider other Past
Performance queries and databases to gather additional information other than what is submitted in response to the solicitation.
The Past Performance evaluation assesses the degree of confidence the Government has in an
Offeror’s ability to provide services that meet the Government’s needs based on a demonstrated record of performance.
(3) Total Evaluated Price (TEP): Offeror shall provide a complete and accurate price quote for the contract on a Firm Fixed Price (FFP) basis. The price quote must be filled out in
Attachment 1 - Pricing Worksheet. Pricing will be evaluated to determine:
The Contractor’s totals from CLIN 0001 through CLIN 0040 equals the TEP; and
Evaluation of the TEP will include various techniques and procedures in FAR 12.602 and 13.106.
Failure to complete and provide the Attachment 2 - Pricing Worksheet will result in a determination of non-responsiveness and your quote will not be evaluated for award.
Based on an integrated assessment of the evaluations, and in accordance with the relative importance of the evaluation factors, the Government will make a single award based on the quotes which represents the best value to the Government. This assessment will follow the guidance at FAR 15.101-1, Best Value Continuum Tradeoff Process, and the guidance for evaluation of Commercial Items at FAR 12.602(c). This determination will compare the relative merits of technical capability, past performance information, and the proposed prices associated with them. In making this comparison the Government is concerned with striking the most advantageous balance between technical, past performance, and price.
Per FAR Provision 52.212-1(g), “Contract award”, the USCG intends to award the contract resulting from this RFQ without discussions, though the USCG reserves the right to hold discussions if later determined by the Contracting Officer to be necessary. The determination to hold discussions is a unilateral right of the Government.
(b) This single award Indefinite Delivery Contract will have a one-year period and there will be no options on this award.
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the
Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
