About this file

This is a Justification and Approval (J&A) document for a federal contract award using other than full and open competition authority. The U.S. Secret Service (USSS), Office of Procurement, is justifying the establishment of an Indefinite Delivery/Indefinite Quantity (IDIQ) contract with a five-year ordering period for training ammunition. The contract will be set aside for small businesses and is limited to authorized resellers of Defensive Tactics (DT), Combined Tactical Systems (CTS), and FN303 brand ammunition and components. The estimated ceiling value for the five-year period is $8,950,000. The solicitation number is 70US0926R70093916, funding is multi-year Operations and Support, and the contract type is IDIQ with firm fixed price delivery orders.

The James J. Rowley Training Center (RTC) requires 40mm Less Lethal, Smoke, and FN303 ammunition and components to support recurring firearms training operations. Market research identified compatibility and standardization as critical requirements; alternative products would necessitate extensive compatibility testing and operational validation. A Request for Information posted on SAM.Gov on June 30, 2026, identified three small businesses as capable sources: Southern Police Equipment Co., Helios Vanduard Inc. (deemed not capable as an unauthorized reseller), and Kiesler Policy Supply. Historical pricing from previous large contractors (FN America and Quantico Tactical) will be used to determine price reasonableness. The Contracting Officer will assess fair and reasonable pricing based on competition among proposals received, or historical pricing if only one proposal is submitted. The requirement will be competed on the open market with price determinations at order time. The J&A was approved on August 13-15, 2026, by the Technical Representative, Contracting Officer, and Head of Contracting Activity.

JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN

COMPETITION BRAND NAME JUSTIFICATION

41 U.S.C. 3304(a)

Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by the Federal Acquisition Regulation (FAR) 6.103 (FAR Class Deviation 25-11) and in accordance with the requirements of FAR 6.104 (FAR Class Deviation 25-11), the justification for the use of the statutory authority under FAR 6.103 (FAR Class Deviation 25-11) is justified by the following facts and rationale required under FAR 6.104-1 (FAR Class Deviation 25-11) as follows:

1. Agency and Contracting Activity. U.S. Secret Service (USSS), Office of Procurement, proposes to enter into a contract on a basis other than full and open competition.

2. Nature and/or Description of the Action being Approved.

(a) Nature of action. The Government requires an Indefinite Delivery/Indefinite Quantity contract with a five (5) year ordering period for the procurement of training ammunition. The Office of Training, James. J. Rowley Training Center (RTC) requires training ammunition to support firearms training for agent readiness and mission support on a reoccurring basis. This solicitation will be set aside for small business and Defensive Tactics (DT), Combined Tactical Systems (CTS), and FN303(ammunition/projectile items).

(b) Name and address of the contractor: TBD

(c) Contract type: The contract will be an IDIQ with firm fixed price delivery orders.

(d) Estimated total value, including options: The estimated ceiling for the 5-year ordering period is $8,950,00.00

(e) Type of funding: Operations and Support

(f) Year of funding: Multi- Year

(g) Solicitation number: 70US0926R70093916

(h) Background information about the requirement: Historically, these supplies have been procured through United States Secret Service IDIQ contracts 70US0921D70090020 and 70US0921D70090019, both of which are scheduled to expire this year. Additionally, the Department of Homeland Security Strategic Sourcing Vehicle ammunition contracts have either reached their maximum ceiling values or expired. As a result, establishing replacement contract

11.07.2025 v.2.0 vehicles is an urgent requirement to ensure continued support for the USSS’s recurring operational and training needs

3. Description of supplies/services.

Office of Training, James J. Rowley Training Center (RTC), is seeking to procure 40mm Less Lethal and Smoke & FN303 ammunition and Components to support training. The brand names Defensive Tactics (DT), Combined Tactical Systems (CTS) and FN303(ammunition/projectile items) are currently used at RTC for training operations.

4. Identification of statutory authority permitting other than full and open competition. Identify the most applicable statutory authority that will be used to justify other than full and open competition from the seven listed under FAR 6.103 (FAR Class Deviation 25-

11) entitled “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”

5. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.

Defense Technology, Combined Tactical Systems, and FN 303 products provide continuity, compatibility, and standardization with currently fielded USSS training and operational systems.

Use of these established products supports consistent performance, reduces the risk of incompatibility with existing equipment, preserves training continuity, and minimizes the need for additional testing, validation, and retraining that may be required with off-brand equivalents.

Procuring these items helps ensure uninterrupted training support and maintains readiness for protective operations and other mission-critical requirements.

These brand name ammunition and components are designed to work with existing USSS launchers, training systems, protective equipment, and related components. Using the same manufacturers helps reduce the risk of fit, function, or performance issue with currently fielded equipment. These products are known to perform and do not need to be tested to ensure they meet USSS training needs.

In addition, the solicitation is not being limited to one vendor, it will be competed on the open market. The USSS needs these specific brand names to ensure compatibility and reduced operational risk.

7. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable.

A Request for Information was posted on SAM. Gov on June 30, 2026, and two small businesses responded. One was found capable of providing the ammunition and components and the other vendor was found not to be capable of providing the ammunition and components because they were not authorized resellers of DT or CTS products. During the review of the RFI results, the

J&A No: Page 3 of 5 subject matter expert found another small business who was a reseller, and they were added to the Market Research results. This solicitation will be posted on SAM.Gov as a small business set-aside.

8. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer will determine whether the anticipated price(s) will be fair and reasonable based on competition amongst proposals received. If only one proposal is received, then historical pricing shall be used to determine fair and reasonableness.

9. Description of Market Research.

Market Research determined brand names Defensive Tactics (DT), Combined Tactical Systems (CTS), and FN303 were required at RTC, due to both compatibility with existing equipment and ammunition and standardization across training operations. An RFI was completed and found two small businesses that were available to provide the ammunition and components. Market Research noted the previous large contractors used as possible sources (FN America and Quantico Tactical) and pricing was determined from these historical contracts to determine price reasonableness. In addition, informal internet searches and catalogs were reviewed to see if there were additional sources that could provide the ammunition and components, but they did not meet the specs and minimum requirements of the ammunition needed.

10. Any other facts supporting the use of other than full and open competition.

The requirement is for training ammunition utilizing Defensive Tactics (DT), Combined Tactical Systems (CTS), and FN303 product lines. This solicitation consists of 132-line items for ammunition, components, munitions, and projectiles. Due to the technical nature of these items and their use in USSS training, any alternate products would require compatibility testing and operational validation to ensure they meet agency requirements and function properly with existing equipment and training programs. The current contract vehicles have expired or are otherwise unavailable, delays in procuring these supplies could disrupt scheduled training and affect mission readiness.

The requirement will be competed on the open market as a small business set-aside and limited to vendors capable of providing the required brand name Defense Technology, Combined Tactical Systems, and FN 303 products. This approach preserves competition among qualified small businesses while ensuring training continuity, compatibility, and timely fulfillment of the Government’s recurring requirement.

11. A listing of the sources, if any that expressed, in writing, an interest in the acquisition.

12. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for supplies or services required.

There is little opportunity to remove or overcome the barriers which led to an exception of fair and opportunity due to the existing compatibility of ammunition and components currently in use at RTC. The Government will continue to monitor the market for opportunities to obtain training ammunition, not particular to one brand line which can meet the Government’s minimum needs.

13. Technical/Requirements Personnel Certification. I certify this requirement meets the Government’s minimum need and that the supporting data, which forms a basis for this justification, is complete and accurate.

Duane Tomaszewski II Technical Representative/COR Date USSS, Office of Training

14. Contracting Officer’s Certification. I certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.
