STATEMENT OF WORK (SOW)

Laboratory, Specialty, and Medical Grade Gases Delivery and Refill Services

1. GENERAL INFORMATION

1.1. INTRODUCTION: The United States Secret Service provides Laboratory Threat analysis and support of the overall USSS protective mission. This is a non-personal services contract to provide compressive delivery, refill, and rental of laboratory, specialty, and medical grade gas cylinders, dewars, and tanks. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the contractor who, in turn is responsible to the Government.

1.2. Background: The USSS utilizes a five-year Blanket Purchasing Agreement (BPA) with annual task order allocations for a range of high purity, laboratory, specialty, and medical grade gases to support USSS mission. The current BPA expired 23 September 2023 and a new BPA is needed to initiate by 4 January 2024 to allow USSS to not exceed its micro purchasing limits and is vital to daily operations and operational tempo.

1.3. Objectives: The objective of this procurement is to establish a new Blanket Purchase

Agreement to ensure gases are available for use within laboratories and support areas within the National Capitol Region (NCR) during the course of the Agreement and within the continental United States (CONUS) during OY2 through the end of the agreement. Laboratory instrumentation is operational 100% of the time and able to produce accurate, defensible results in support of the USSS mission.

1.4. Scope: Laboratory and Mission Support Gases Delivery and Refill Services: The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform required high purity gases in cylinders, dewars, and tanks for continuous use as defined in this Statement of Work except for those items specified as Government furnished property and services. The contractor shall accomplish initial delivery, on-going delivery, exchange, and refill services, rental tracking, repair and/or replacement of faulty or incorrect cylinders, dewars, or tanks.

1.5. Specific Tasks:

1.5.1. Laboratory and Specialty Gases Services Initial Delivery. The Contractor shall provide an initial delivery of gases of specified type, purity, volume, and quantity within 1 week of issue of the first delivery order for each site. Each site will have its own line of accounting and tracking mechanism to allow individual invoicing, credit, and tracking.

1.5.2. On-going / reoccurring orders. Gas usage will vary day to day and requires re-ordering of additional cylinders for at most once per month. Orders will be placed by email utilizing an excel spreadsheet detailing the quantity, cylinder/dewar/tank volume or type, purity, and site for delivery. Delivery must occur 96 hours (48 hours for emergency orders) of order to the specified site. Not all sites will order at the same time or same frequency and each delivery will not be the same. All fees, charges, and rentals will be detailed prior to delivery and acceptance of the task order. Current operations may not require the contractor to supply the entire list of gases at one time, but partial combinations from the list. To assist in developing delivery schedules the contractor will also identify which gases listed above are:

In-Stock Item (Immediate Delivery; 0 to 2 days) Back Order Item (Short Term Delivery Delay; 2+ days to 2 weeks) Custom Order Item (Long Term Delivery Delay; 2+ weeks to 2 months)

1.5.3. Item Replacement. The contractor will replace industrial/specialty gases that do not meet purity specifications, laboratory standards, or content and will be replaced at no cost to the government, within 48-hours after receipt of the discrepancy notification issued from the Contracting Officer’s Representative within seven calendar days after delivery.

1.5.4. Qualified Staff: The contractor shall provide qualified drivers with appropriate

Commercial Drivers License (CDL) commensurate with US DOT and state and locality requirements. Personnel shall be trained and appropriately equipped to properly transport (including any hazardous materials carrier requirements as stipulated by federal, state, or local or US Department of Defense regulations), load, unload, and transfer all cylinders, dewars, and tanks.

1.5.5. Portable Cylinders, Containers, and Dewars. All cylinder, containers, and Dewars will be properly maintained, inspected, and marked by the contractor prior to delivery. The contractor is responsible for maintaining all markings, labels, and certifications on all cylinders and containers and transportation equipment in accordance with Federal, State, and Military regulations.

The contractor is responsible for proving portable cylinder and containers to support the government’s compressed gas requirements. The government will reimburse the contractor the appropriated rental fees associated with the cylinders, containers, or Dewars in its possession. The government will reimburse the contractor for replacement cylinders, containers, or Dewars in the event of a cylinder, container, or Dewar loss if the government is determined at fault.

1.5.6. Faulty or inoperable items. The contractor will replace externally faulty or inoperable cylinders, containers, or Dewars at no cost to the government within 96 hours after notification by the Contracting Officer’s Representative (COR).

1.5.7. Resupply Locations. The contractor will not remove or relocate any cylinder/container without prior approval by the Contracting Officer’s Representative (COR). All requests for removal or relocation of cylinders/containers must be submitted in writing to the recipient at the cylinder/container location with a copy of the request forwarded to the COR.

1.5.8. Delivery and Cylinder Management. The Contractor shall provide a delivery slip at each delivery detailing the quantity, type, and volume of cylinders delivered and removed. The delivery slip must be referenced on any invoice. Invoices must be submitted within 1 calendar week from delivery. The contractor may choose to utilize a tracking system, but it does not replace the above requirement.

Delivery It is the responsibility of the contractor to make deliveries directly to the customer buildings and storage areas as requested. These deliveries must be accomplished using contractor owned equipment and personnel. The contractor will remove all empty cylinders, containers, or dewars from the delivery location and from the facility. The government reserves the right to relocate portable cylinders, containers, or dewars, and contractor owned equipment located on government property to facilitate emergency responses or to safeguard either government or contractor owned property. The COR will notify the contractor within 5 working days should relocation become necessary. All discrepancies will be reported to the contractor by the COR within seven (7) calendar days of delivery.

The contractor will accept returns under the following conditions:

Products were delivered in error.

Containers are damaged and may pose unsafe conditions for use.

Product has been recalled by the manufacturer, regardless of the level of recall.

Product does not meet the quality standards specified.

Containers were delivered empty or partially filled.

The contractor will have the capability to track cylinders utilizing automated procedures to ensure that proper cylinder counts are maintained after each delivery and return. A proper cylinder count is necessary to accurately determine stock levels and calculate rental charges.

1.5.9. Safety and PPE. The Contractor is responsible for ensuring compliance with safety and environmental regulations, ensuring that all personnel are in the possession of, and are properly trained in the use of appropriate personal protective equipment during the performance of this contract.

1.5.10. Safety Data Sheets. The contractor will maintain a copy of all Safety Data Sheets (SDS) for the associated products provided under the purchase request. The contractor is responsible for detailing the quantity, type, and purity of cylinders at each site as part of each invoice. Invoices must be submitted within 1 calendar week of the end of the rental month period.

1.5.12. Customer Support. The Contractor shall provide priority telephone and email access to technical support, as needed, at no charge.
