FAR 8.405-6 (a)(1)(i)(A) Urgent and compelling need exists and following the procedures would result in unacceptable delays.
FAR 8.405-6 (a)(1)(i)(B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized
FAR 8.405-6 (a)(1)(i)(C) The new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.
Original Order Number: 70T05020F3NOSO021
FAR 8.405-6 (b) Items peculiar to one manufacturer.
Limited Source
Justification FAR Part 8
REv
SECTION V: Description of Limited Source Rationale
On 5/13/2020, TSA posted to GSA eBuy an RFQ for 300,000 surgical masks. The RFQ went to 222 vendors under three GSA Schedules:
65 II A - Medical Equipment and Supplies A-33C
51 V - Hardware Superstore 105 002
MAS - 332510C
The RFQ closed on 5/18/2020. Out of the 222 vendors, TSA received one quote (Complete Packaging & Shipping
Supplies, Inc.). TSA has an urgent need for additional masks. The TSA Administrator set a goal for the TSA warehouse in Texas to be stocked with a 60-day supply of masks. Based on the response to the RFQ, and on the market research described below, TSA has an urgent and compelling need to purchase additional masks. Through the RFQ, TSA has sourced one vendor that can provide the approved masks. TSA has one other source of masks but that vendor has limited supplies. Additionally, a centralized purchase by DHS for TSA has been postponed and reduced in quantity. Therefore, competing this requirement at this time would result in an unacceptable delay.
SECTION VI: Contracting Officer’s Determination that the Order Represents the Best Value
The Contracting Officer determines the price of the masks to be acceptable and represents the best value to the government.
SECTION VII: Market Research Description
Beginning in March 2020, TSA has been attempting to secure sources of supplies for surgical type masks (masks manufactured for medical use). This included phone calls and emails to over 100 vendors and manufacturers under
GSA Schedules, DHS strategically sourced contracts and the open market. Responses received included masks that were unverifiable in quality (lacking FDA approval verification), or pictures of the masks without any other information. Manufacturers replied that they are restricting the quantity of mask supplies to their distributers. Also, when asked to provide the number of approved masks immediately available in stock, no sources were available.
TSA wasn’t able to acquire any approved masks from this market research.
SECTION VIII: Other Facts Supporting the Limited Sources Justification
The current worldwide market for any PPE, including masks, is significantly constrained by high demand due to the
COVID-19 pandemic. TSA must acquire enough masks for the warehouse to distribute to airports on at lease weekly basis. Every available opportunity to source approved masks at a reasonable price is being taken by TSA.
SECTION IX: Actions Taken to Remove Barriers to Competition TSA continues to contact multiple vendors for supplies of masks. This may include contacting individual vendors under
GSA Schedules or the open market, and also postings under GSA eBuy for RFQs and sources sought notices.
SECTION X: Contracting Officer Certification
I certify that this justification is accurate and complete to the best of my knowledge and belief.

SECTION XII: Concurrence and Approval The required levels of concurrence and approval of this Limited Sourced Justification depend on the estimated total value of the procurement. Concurrence and approval must be obtained for that level and each previous level.

$2,000 and greater for Construction
$2,500 and greater for Services $10,000 and greater for Supplies
