Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (iii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers https://sam.gov/wage-determination/MD20240021/3 4/6

Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

State Adopted Rate Identifiers

Classifications listed under the ""SA"" identifier indicate that the prevailing wage rate set by a state (or local) government was adopted under 29 C.F.R �1.3(g)-(h). Example: SAME2023-007 01/03/2024. SA reflects that the rates are state adopted. ME refers to the State of Maine. 2023 is the year during which the state completed the survey on which the listed classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination.

01/03/2024 reflects the date on which the classifications and rates under the ?SA? identifier took effect under state law in the state from which the rates were adopted.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

1. Comprehensive / Commercial General Liability Under the "Type of Insurance" in the General Liability section, the Commercial General Liability and Occurrence boxes should be checked, with a minimum amount of the following:

All policies will be broad form and shall include contractual liability, personal injury protection and completed operations coverage. These policies will be primary and non-contributory. 2. Automobile Liability In this section, Auto liability in a minimum amount of $1,000,000, per occurrence, combined single limit for both bodily injury and property damage for all owned, non-owned and hired vehicles brought onto the premises by the subcontractor.

3. Worker's Compensation Workers' Compensation coverage, in accordance with Florida statute, must be in force.

Exclusion of Workers’ Compensation is prohibited. An “N” in the box “ANY PROPRIETOR/PARTNER/EXECUTIVE OFFICE/

MEMBER EXCLUDED?” is required.

4. Employer's Liability Coverage should be in a minimum amount as follows:

5. Personal Property Property insurance coverage for tools and equipment brought on to and/or used on the Properties by the subcontractor in an amount equal to the replacement cost of all such tools and equipment. NLC must obtain the Owner's prior permission in the event that it decides to waive any of the above requirements. NLC shall obtain and keep on file a Certificate of Insurance, which shows that each subcontractor is so insured.

6. Cancellation We require that notice of cancellation be not less than 30 days. In addition, the following words should be stricken from the Cancellation Clause: "Endeavor to" and "but failure to mail such notice shall impose no obligation or liability of any kind upon the company, its agents or representatives."

7. Additional Insured / Description of Operations, et al. In this section the additional insured, with respect to all policies except workmen’s compensation, should be shown as follows:

One Town Center DST and NLC Property Management LLC, their agents, beneficiaries, successors, and assigns, all as their interests may appear, are additional insureds with respect to commercial general liability insurance.

Coverage is to apply on a primary noncontributory basis when coverage under other policies are available to the additional insureds, using CG 20 01, or its equivalent. OVERVIEW:

Design, Fabrication, and Installation services are requested for a permanent USCIS History Exhibit in the Front Lobby (1st Floor) of the USCIS Headquarters (HQ). An existing 16’W x 9’H x 1’D finished alcove will be used for this display. A museum grade appearance is desired in accordance with the decorum of HQ. Some images and text can be permanently applied however most text and pictures should be sectioned and mounted in a way that allows for easy updates and revisions. Initial design ideas and graphics are included in this scope for conceptual purposes.

DESIGN SERVICES:

Design services are requested for the development of options and a final design package. The final package will include detailed installation documents for all elements of the exhibit. All categories/themes, text, graphics, and display designs will be developed with USCIS Facilities (FAC), Multimedia Division (MMD), and the History Office and Library (HOL).

Design Concepts:

Provide (3) design concepts and costs based on this SOW and meetings with USCIS. Include four (4) meetings in the schedule and price. Provide samples of proposed systems or materials if available and fabricate prototypes or mockups if needed.

Each concept will include the following:

3D color rendering showing proposed finishes

Photo, Text, and Artifact display options

Cost Estimate (fabrication, delivery, install) Concepts should vary from basic to high-end and include display options best suited for this exhibit.

The following are option examples:

Concept #1: Vinyl background; Sintra photo display; Sintra text display; Basic base for text display and enclosed/accessible artifact displays; Basic Finishes

Concept #2: Acrylic background; Acrylic photo display; Acrylic text display; Mid-grade base for text display and enclosed/accessible artifact displays; Mid-grade Finishes

Concept #3: Glass background; Glass photo display; Glass case for text and artifact display; Metal or veneer base; High-end Finishes

Cost Estimate (fabrication, delivery, install)

Initial Design Ideas:

1. Introduction Panel: USCIS logo, Exhibit name, and Exhibit narrative and footnotes. This information can be permanently applied (vs. flexible for future revisions).

2. Background Image: Historical and non-political scene such as Ellis Island

3. Photo Display: Approximately (5) sections with header text and 3-4 mounted pictures of varying sizes.

Pictures should be easily interchangeable, whether in-house (preferable) or by a pro.

4. Text and Artifact Display: Approximately (5) sections corresponding to the picture display. Each section will have text and pictures that can be easily updated, whether in-house (preferable) or pro. Text panels should be presented and positioned for easy reading and ADA compliance. Artifacts on display should be enclosed, lockable, and accessible. Artifact display sizing to be finalized with USCIS.

5. Timeline Display: Approximately (31) dates with call-out text forming a sequential timeline. Timeline text should be sectioned and mounted to account for future additions.

6. Integrated Lighting: Install downlights within existing alcove headers (site conditions to be verified) or add a structural header with integrated lighting. Lighting controls to be finalized with USCIS.

7. Maintenance Access: Easy accessibility required for the maintenance of light bulbs, wiring, and to update and clean the exhibit.

Schedule of Deliverables: The days listed below are calendar days, including Saturdays, Sundays, and Federal holidays. The Government must receive the deliverable by the start of the next business day. If the due date falls on a Saturday, Sunday, or Federal holiday, then receipt is expected by the start of the next business day.

INSTALLATION SERVICES:

Provide material, labor, equipment, and supervision for the fabrication, delivery and installation of this exhibit as described in the USCIS approved plan. NOTE: Drawings, all exhibit materials, colors, letter-type designs, etc., must be approved before any construction begins. Manufacturing of exhibits prior to Government approval shall be at the Contractor’s risk. Exhibits not given prior approval could be rejected. Errors in fabricated exhibit shall be corrected at the Contractor’s expense.

Project Management (PM):

Provide PM services to include the following:

Provide a schedule of deliverables and milestone dates, arrange transportation of fixtures, trade(s) coordination, submittal review, shop drawings review, request for information (RFI) and ensuring SOW conformance during installation progress.

Attend and manage review meetings, provide input, recommendations, and meeting minutes.

Conduct site visits during installation. Provide detailed written field observations to relay status to

USCIS Government personnel.

Take the initiative and act to mitigate circumstances that could lead to claims, resolve conflicts promptly and keep USCIS advised of any potential disputes and project delays.

Exercise due diligence to ensure that the project meets applicable requirements, codes, regulations, and standards.

Conduct a final inspection and prepare a punch-list documenting any remaining work. Conduct any required follow-up inspections to administer resolution of punch-list items.

Promptly report, in writing, any observed variances from the contract requirements and provide a copy of said variances to the Contracting Office and USCIS Project Manager.

Vendor Capabilities:

Vendor shall have the following capabilities:

Museum and exhibit planning and implementation Graphic and exhibition design Detailing and CAD drafting Specialty fabrication, crafting, and installation Machine shop, prototyping and testing Custom artifact mounts Painting and specialized finishing Acrylic fabrication Vectorworks or AutoCAD for drawings and floor plans Lighting and electrical design and adjustments

Property Ownership and Copyright:

The Contractor shall turn over to the Government full right to ownership and use without restrictions, all art, images, documents, and materials produced under this contract. The Contractor relinquishes the work, originals and copies, of all items/products developed under this contract to the Government. All items/products used shall be free of the Contractor name, logos or other identifiers and of other corporate/company identifications. These documents and materials may not be used or sold by the contractor without written permission from the Contracting Officer. The Contractor may use photos and other graphic representations of the work for their professional marketing purposes. Such representations shall be credited to USCIS. This right does not abrogate any other Government rights.

Construction Performance Requirements:

General Contractors performing construction and alteration work in buildings, on behalf of the U.S. Citizenship and Immigration Services (USCIS), must adhere to the following general provisions of performance while performing services in these buildings. These conditions are in effect regardless of the contracting organization whether it is the General Services Administration or USCIS.

DELIVERY: On each individual project, pricing must include shipping FOB (Free On Board) destination, inside delivery and removal of packaging material and unused product for both the initial installation and any go-backs.

The vendor will be provided a staging area with-in the building and access to a freight elevator.

Work will occur both during and after normal business hours. Any work that produces loud banging or drilling should be done after hours.

Freight Elevator Information:

Weight capacity = 4,500 lbs.

Cab (clear) dimensions = 84” H x 8’8” L x 5’1” W

Contractors will be required to submit Facilities Access Request (FAR) Forms at least (10) business days prior to delivery and installation. FAR Forms will be provided by the USCIS project manager.

No USCIS/GSA employees will assist with unloading the truck(s). The vendor shall provide all personnel and equipment needed for unloading, moving and assembling the furniture.

REQUIREMENTS: The general contractor is required to participate in a pre-installation meeting at the installation site.

This meeting may include the Government’s data/phone contractor, the building’s owner (or representative), the USCIS Project Manager and others. This is to ensure a clear and orderly installation that is coordinated with other trades working in the building.

The vendor shall conduct a site survey for accurate measurements of the existing conditions. The government shall not be held liable if measurements or information provided is not 100% accurate.

The vendor shall comply with the guidelines and standards found in the Americans with Disabilities Act (ADA) Standards, Architectural Barriers Act (ABA) Standards, and the Uniform Federal Accessibility Standards (UFAS).

Warranty: For one (1) year from the date of the Government’s final acceptance of the exhibit by this contract the Contractor shall repair and/or replace any deficiencies or defects whether warranted by a manufacturer or by the Contractor at the Contractor’s expense.

Certificate of Insurance (COI): Certificates are to be submitted upon Award. Contractors shall furnish a valid/current Certificate of Insurance (COI) valid through the SOW period of performance, and in accordance with each Facility Lessor’s COI requirements. Contractor shall provide proof of liability insurance as part of their proposal. Any damages incurred by the contractor to the facility, Government furnishings or equipment being moved, or any types of damages are the responsibility of the contractor. Financial liability for damages is the burden of the contractor.

General provisions for General and Subcontractor performance:

CIRCULATION: All corridor and hallways are to be kept clean and free of debris during the performance of this contract. Corridors and hallways must be vacuumed and wet mopped at the end of each work-shift to remove all dust and debris.

CREW SUPERVISION: Adequate on-site supervision must be provided by the Contractor at all times during the execution of this project.

All debris must be removed and disposed of off of the Federal building premises.

DAILY VACUUMING: All office areas where work is taking place, as well areas adjacent to the work area must have the carpet and any furniture that is soiled due to the construction work vacuumed at the end of each work-day.

DUST BARRIER: A dust barrier may be required to be provided and installed to protect personnel near the work area from any dust during the construction work execution. This dust barrier must be installed as follows:

NOTE: If this protective barrier is required, the Contractor will be notified by the government prior to bid formulation to ensure the cost for such is accommodated for in the Contractor’s bid proposal.

Preparation: The Contractor must provide a plastic sheeting barrier to prevent dirt and dust generated from the work area from entering into the adjacent occupied space.

Isolate the work area for the duration of the project by completely sealing off all openings and fixtures in the work area, including but not limited to, heating and ventilation outlets (ceiling mounted diffusers) ductwork penetrations, interior doorways, corridor doors used for entrance and exits, windows, and ceiling mounted lighting with two-layers of plastic sheeting taped securely in place. Plastic sheeting must be of a

“6-mil” thickness or greater to adequately maintain the purpose of its use. This barrier must be inspected by the Contractor daily at the beginning of each work-shift. If any penetrations have occurred and any other sealing integrity has been lost, it must be repaired or replaced prior to any work activities taking place that day.

Build double barriers of plastic sheeting at all entrances and exists to the work area so that the work area is always closed off by one barrier when workers enter or exit.

Cover all floor and wall surfaces in the area with plastic sheeting taped securely in place to protect from damage. Assure that two layers cover all floor areas.

Before demolition or abatement work begins, all items identified in the statement of work as salvage or government reuse shall be turned over to the government or relocated to a government storage area that will identified in the initial pre-bid conference. If this requirement to relocate government items is called for in the statement of work then the Contractor is to clean all removable items and equipment by wiping them down with clean dust catching/treated fabrics then relocate the items from the work area and store as directed.

Cover all non-removable items and equipment with plastic sheeting.

Provide negative pressure ventilation to control dust and prohibit it from entering outside of the work area. If necessary, as determined by the Project Manager, use of an air filtration system or machine may be required. This device must have a HEPA filter and it must direct its discharge through a water baffle apparatus. USCIS will provide directions for how to respond to this requirement, if it is necessary as determined by the government.

In some construction projects, a solid barrier of metal studs and drywall will be needed. When this is required, the Contractor must be notified at the beginning of the project to ensure the cost for such is accommodated for in the cost proposal and the requirement is fully understood. The barrier will be subject to inspection by the USCIS Safety Officer for compliance to the appropriate standards for this application.

GOVERNMENT PROPERTY: All Government property, or systems displaced, altered, or damaged during the performance of this contract other than stated in the Statement of Work must be restored to its original condition at no cost to the Government. These repairs, if needed, must be executed immediately when notified by the contracting authority that such repairs are required due to actions by the contractor or his/her subcontractors.

POWER/COMMUNICATION INTERUPTIONS: All unscheduled power and communication outages caused by the contractor as a result of demolition or construction activities must be restored within a 4 hour time frame. The contractor is to take all necessary precautions to minimize the possibility of causing such a disruption for occurring by employing a thorough pre-construction survey. Failure to provide corrective actions for causing an outage as described above will result in the government executing the repair and charging the Contractor for the full cost of the repair performed by others as well as the administrative cost associated with executing the repair.

RELOCATED SYSTEMS: The Contractor may be responsible for relocating any electrical, mechanical, or structural building system components necessary to perform this work. If so, it will be called out in the statement of work and such work may only be performed after approval from USCIS and GSA. All electrical work must comply with the National Electrical Code and all District of Columbia municipality codes in effect.

CIRCUIT-PANEL INDEX: All electrical circuits removed from service creating unused circuit-breakers in any electrical panel and any new outlets installed must be identified as to the point of source and termination by “updating” the circuit-panel index.

FIELD VERIFICATION: All demolition and new construction work floor plan measurements are the responsibility of the Contractor to verify. Floor plans may not be drawn to a specific scale.

JOB START MEETING: A pre-construction meeting with the successful bidder shall take place within 3 days after the award of the contract.

CONSTRUCTION DEBRIS: Contractor is not allowed to use any Government trash dumpster for the disposal of construction debris.

FIELD ALTERATIONS: Any changes, by the Contractor, to the Scope of Work must be coordinated through the government or its designated representative prior to such change being executed.

PARKING: USCIS will not allow parking within the USCIS facilities during the performance of this contract.

CREW DISCLOSURE: The Contractor must possess GSA issued HSPD-12 badges prior to bidding on the project and throughout the duration of the project. The Contractor must provide the names, social security numbers, and date of birth (DOB) for each employee and for each subcontractor employee scheduled to work on this project at least two-weeks prior to actually working at any USCIS occupied building. If escorting support is required, the Contractor must coordinate with the USCIS PM and provide a detailed schedule at least two weeks prior.

AUDIO: No radio playing other noise producing devices are allowed during construction work without permission from the USCIS Project Manager.

BADGE DISPLAY: USCIS issued building badges must be worn above the waist and below the neck in a visible fashion at all times while in an USCIS security controlled building.

CONDUCT: No alcoholic beverages or substances, abusive or profane language, or other disruptive or illegal activities will be tolerated.
