FAR PROVISIONS BY FULL TEXT:
52.212-2 - Evaluation—Commercial Products and Commercial Services (Nov 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
The Government intends to award one contract on a lowest price technically acceptable (LPTA) basis. Upon receipt of quotes, the Government will review the apparent lowest price quote for technical acceptability. In accordance with the evaluation criteria, if the apparent lowest price quote is rated acceptable in the Technical factor then no further evaluations will be completed and the apparent lowest price quote will be selected for award. If the apparent lowest price quote is not rated acceptable in the Technical factor, the Government will then evaluate the next apparent lowest price quote for Technical acceptability. This process will continue until the lowest priced proposal that is acceptable in the Technical factor is determined.
The Government will fairly consider all offers received in response to this solicitation. The Government intends to make a contract award without negotiations with offering contractors. Therefore, an offering contractor’s initial offer should contain its best terms.
The following factors shall be used to evaluate offers:
1. Price. Pricing must distinguish between the price of each periodical/subscription and the labor rate and amount of hours estimated for performance.
a. Example: Subscription Annual/Monthly Price: $XX.XX + (Management Rate: $XX.XX and XX Hours) = Total Price $XXX.XX.
2. Technical Acceptability: The Government will evaluate the offeror’s demonstrated understanding of the principles and concepts identified in the PWS, in particular: how the offeror shall utilize their abilities to demonstrate the qualities required by the PWS.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
