Solicitation 70RFP322RE3000003 PSO Services - State of Pennsylvania

No. Question Reference (RFP Section)

QUESTION RESPONSE

1 General Who is the incumbent contractor currently providing PSO Services? The incumbent contractor is Paragon Systems, Inc.

2 General What is the current make, model, and caliber of the weapons system used by the incumbent PSOs?

The current weapon is Glock 17 9mm.

3 General Are shotguns required at any facilities? There is no shotgun requirement for this contract.

4 General Are current contractor employees fully qualified in terms of training completion? PSOs are trained for the contract requirements/post orders applicable to the posts they stand. Training requirements may vary by post and building and therefore training can vary for PSOs. The current guard force is trained to the requirements in the current contract. Offerors are cautioned that all PSOs must meet the training requirements of the Statement of Work (SOW) in this solicitation as there may be some differences.

5 General Are the current PSOs and Supervisors trained to the NWDTP standards in the solicitation?

PSOs who are assigned to x-ray and non x-ray screening posts and PSO supervisors that provide oversight and supervision for x-ray and non x-ray screening posts are trained to the NWDTP standards in the solicitation.

6 SOW Post Orders, Section 9.2.4 states, PSOs shall provide a post/shift change brief, to the on-coming PSO, of recent or anticipated occurrences of the assigned post . Does this contract require a formal guard mount? If so, what is the duration of the required guard mount?

No formal guard mount is required under this contract.

7 General Is the Post Tracking System (PTS) currently in use at all buildings? If not, when does the Government anticipate the new Post Tracking System (PTS) will become active on this contract?

PTS is a requirement of the current contract for all facilities.

8 General Are firearms required to be stored on site or are PSOs required to take weapons home after shift?

PSOs will take the firearms to and from work and home. Please refer to SOW Section 14.4.1 and 14.4.2.

9 General Will the Government provide storage space for weapons and ammo on site? The Government will not provide storage for PSO firearms and ammunition. Please refer to SOW Section 14.4.1, 14.4.2 and 14.4.5.

10 General Would the government provide the number of TAS and ESS hours performed in each of the last 3 years?

TAS and ESS hours can vary depending on different factors during the contract period. The current contract's TAS and ESS hours are not applicable to RFP 70RFP322RE3000003. The current solicitation includes hours that the Government anticpates for the follow-on contract. Please refer to page 19 of the solicitation, E. Definitions, b. Temporary Additional Services - "...The Government anticipates that approximately 4% of the maximum hours solicited under this requirement will be for temporary additional services." The SF 1449 lists the maximum quanitity of ESS hours anticipated will be 2,000 per year.

11 General Would the government confirm the last Contract Award amount and/or provide the contract number?

The current contract number is 70RFP318DE3000001 and was awarded in the total amount of $64,726,950.00.

12 RFP Contract Clauses Contract Clauses, item 4, Prices, pages 16-17, states that FPS is purchasing the services for a standard armed PSO position, as well as Top Secret (TS) armed guards. The Post exhibit indicates standard PSOs for all locations except PA0714 which requires Tier 5 Secret. Will FPS allow price adjustments for PSOs paid the Secret premium required by the CBA?

The government considers the secret and top-secret differentials for posts requiring the applicable clearances to be wages/fringes covered by the service contract act. Therefore, these differentials are incorporated into the RFP/Contract through the CBA Wage Determination(s). Any potential changes to the Wage Determination wage/fringe rates would be subject FAR 52.222- 43, Fair Labor Standards Act and Service Contract Labor Standards-Price Adjustment, upon incorporation into the contract.

13 RFP Attachment The CBA with Paragon Protective Services National Union requires a wage differential for the NFTTU post of $1.00 per hour. Which building and post)s) does this refer to and is it still being paid by the incumbent?

The NFTTU - ICE Armory (OFTP) requirement is located at Building #9903PA which includes all posts. The wage differential is a requirement in the CBA to be paid by the vendor to the employee.

14 RFP Attachment The incorporated CBAs require several premiums for Secret and Top Secret clearance levels, Lead PSO, NFTTU post, NWDTP posts, and a shift differential, which are paid in addition to the Base PSO wage. Since the contractors are required to pay these premiums per the CBA requirements, will FPS allow price adjustments since these are not "voluntary" increases?

Yes, for Secret/Top Secret clearance levels, NFTTU posts, NWDTP posts and shift differential, price adjustments are allowed in accordance with increases and decreases in the terms of the applicable CBA. In regard to Lead PSO, please refer to RFP page 15-16, 04. Prices B. Coningency Pricing. Under this contract, FPS is purchasing the services of standard Guard II Armed PSO associated with the standard PSO rates. FPS is not purchasing the services of any other type of non-supervisory PSO/guard such as Lead PSO. Because FPS is not purchasing services for any position, other than the standard armed PSO position, and use of any other non-supervisory PSO position in performance of this contract is inconsistent with the terms and conditions of the contract, the contractor will not be eligible for any price adjustment predicated on the wages and/or fringe benefit rates for these positions increasing.

15 SOW SOW 5.7.2 states that the Government has determined that performance of this contract requires Contractor to access to classified information, up to and including the Top Secret classification level. The highest clearance classification noted on the Post Exhibit is Tier 5 (Secret). Does Top Secret classification pertain to this contract?

Yes. The Tier 5 Secret clearance is the requirement for the FBI, Building PA0714. The SOW requires a Top Secret clearance as the vendor needs to have a Top Secret clearance to coordinate/process and submit the Tier 5 Secret paperwork/documentation for the FBI requirement at Building

PA0714.

16 SOW Exhibit Does Exhibit 15 apply to this contract? If so, is PA0714 the only applicable building?

Yes, Exhibit 15 applies to this requirement and PA0714 is the only applicable FBI building.

17 SOW Does SOW 6.10 Annual IRS Security Awareness Training apply at any of the buildings?

Yes, the Annual IRS Security Awareness Training applies to all IRS Campuses only.

18 SOW Exhibit On the Post Exhibit, it lists building #0896, York, twice, both showing 1,922 annual hours. One of these should be deleted, which would adjust the annual hours down by 1,992 hours per year (total annual hours would now be 246,950). Please revise and send an updated Post Exhibit.

The Post Exhibit is correct. The first listing of PA0896 on the Post Exhibit refers to an IRS requirement and the second listing of PA0896 refers to a SSA requirement.

19 SOW Exhibit The post exhibit has 248,942 annual hours and 1449 has 297,000 hours for a variance of 48,058 (19%). Are there any new buildings or additional posts already planned by the government to open or is the variance a reserve for additional unplanned opening should they occur?

The current, known service requirements are set forth in the post exhibit. In accordance with Addendum to FAR 52.212-4 paragraph 03. Maximum Quantities on pg. 14 of the RFP, the Schedule of Supplies/Services and Prices (i.e. the Schedule) sets forth the maximum quantity of hours that the Government may order per each stated ordering period. The maximum quantities set forth in the Schedule are based on the current known service requirement with adjustments to provide for maximum ordering flexibility. The current, known service requirements are provided for informational purposes only. The Government reserves the right to order up to the maximum quantities set forth in the Schedule.

20 General Is the level of effort reflected on the Post Exhibit the same level of effort that is currently being performed by the incumbent guard force?

Yes, but please also refer to RFP section 03. Maximum Quantities and the answer to question 19.

21 RFP Attachment CBA 2022-371, Appendix A (Page 34) states the H&W for the Central Area Counties decreased on 2/1/2022 from $4.60 to $4.22. Is this correct or a typo in the CBA? For the same period and CBA, the western counties increased by .04/hour.

The CBA is clear on its face.

22 RFP Attachment CBA 2022-371, Appendix A has a differential for NFTTU posts. Can you please identify the posts with NFTTU and explain the requirement?

The NFTTU - ICE Armory (OFTP) requirement for guard services is located at Building #9903PA. All posts at this location receive the NFTTU differential listed in CBA-2022-371. Please refer to SOW Exhibit 9B - Other Special Training which outlines the additional training that is required at this facility.

23 SOW Exhibit Are current PSO’s and Supervisors fully trained to the standards in Exhibit 8 Basic Training, Refresher Training, Weapons Training, NWDTP Training?

Please see responses to questions 4 and 5.

24 SOW Exhibit Do all PSO’s and Supervisor working at IRS facilities, meet the Exhibit 8a Annual IRS Security Awareness Training requirements and the Introduction to Unauthorized Access (UNAX) Briefing requirements?

Please see response to question 4.

25 SOW Exhibit Do all PSO’s and Supervisors currently meet the requirements of Exhibit 9B, Other Special Training?

Please see response to question 4.

26 SOW Exhibit Page 202 states, “Pump-action shotgun, when applicable.” Are pump action shotguns required on this contract? If so, how many are required?

Please see response to question 3.

27 Solicitation Provisions The Standard Form SF1449 instructions state “When responding to this RFP the Contractor must use the Standard Form 1449 as a cover page to the proposal.” a.

Does the Government want Offerors to include the completed 5-page SF1449 as the “cover page” for both Package One – Technical Proposal and Package Two – All Non-Technical Documents? b. By "cover page" does the Government mean that the completed SF1449 should be the first five pages of both packages?

The SF 1449 to include the the Pricing Schedule must be used as the cover page to Package Two - Non-Technical Documents. The SF 1449 and the Pricing Schedule will be the first five pages of Package Two. All pages of the SF 1449 must be completed to include the Pricing Schedule, which details all CLINs, quantities, unit prices and extended prices. Please refer to RFP Solicitation Provisions, Page 342 - Proposal Submission Requirements.

28 RFP Attachment Are Offerors required to submit Attachment 9 – Proposal Checklist for Offerors with the proposal?

No

29 RFP Attachment Attachment 9 – Proposal Checklist: The requirements for TECHNICAL (NON- PRICE) PROPOSAL’s Relevant Past Performance state “2. Past Performance Questionnaires (Attachment 4) may be submitted for each reference contract.

Contractors shall forward the Past Performance Questionnaire to a cognizant representative of the customer organization that purchased the services from your company.” Can Offerors submit the latest evaluation from Contractor Performance Assessment Reporting System (CPARS) in lieu of Past Performance Questionnaires?

No, the RFP does not allow offerors to submit a CPARS in lieu of a Past Performance Questionnaire. The Government may also check CPARS.

30 RFP Attachment Attachment 9 – Proposal Checklist: The requirements for TECHNICAL (NON- PRICE) PROPOSAL, A. Quality Assurance requires Offerors to submit a completed Attachment 8, “Field Level Supervision Exhibit”. Will the Government confirm if this is to be submitted as a separate Excel file?

Please refer to RFP page 342, Proposal Submission Requirements, #4. The Attachment 8 - Field Level Supervision Exhibit is a separate Excel file and is not included in the page limitation.

31 Solicitation Provisions, Proposal Submission Requirements

Paragraph 3 of the Proposal Submission Requirements states, “Proposals shall be comprised of TWO (2) separate electronic files.” However, based on the solicitation requirements, more than two (2) separate electronic files will be submitted including, Technical (Non-Price) Proposal, Attachment 8 Field Level Supervision Exhibit (Excel), All Non-Technical Documents, and Attachment 6 Price Element Breakdown Worksheet (Excel). Will the Government clarify the number of files Offerors are to submit?

The first file is the technical (non-price) proposal and will include the Attachment 8 - Field Level Supervision Exhibit. The second file is the price proposal and will include all non-technical documents. The Attachment 6 - Price Element Breakdown is a part of the price proposal and shall be submitted separately in Excel format.

32 Solicitation Provisions, Proposal Submission Requirements

As part of A. Quality Assurance, 1. Field Level Supervision of Protective Security Officers (PSO), Offerors may provide a narrative “to enhance the Government’s understanding of their proposal, containing their rationale for the proposed staffing levels, supervisory labor mix, and geographic placement of supervisors as contained in Attachment 8…” Will the Government clarify if this optional narrative counts towards the technical proposal’s 15-page limit?

Yes, the optional Field Level Supervision narrative does count towards the 15 page limit.

33 Pre-Proposal Conference

Was not clear if FPS is expecting offerors to include the Plan for Covering Costs as part of our proposal submission or is this something the FPS will request after a winning bidder is announced. Please clarify. If expected with the proposal submission, would the FPS please include instructions and requirements to address this requirement? If expected as part of our proposal submission, would it be included in the Price Proposal?

This is a firm fixed price contract not a cost reimbursement contract. The plan for covering costs is required as part of the price proposal submission. The Contractor’s price shall be inclusive of all the Contractor’s direct costs, indirect costs and profit and shall include all costs associated with providing the services described in the Statement of Work, the Post Exhibits and the Contractor’s technical proposal. Please refer to RFP pages 349-351, Price Proposal.

34 General We found that Bldg. PA0944 in Baden PA, which is in Beaver County, PA, is the only location in the Post Exhibit not covered by either of the two (2) CBAs. Is this an error? If an error, we request the Government fix and resend corrected Post Exhibit in a future amendment. If not an error, we intend to use the applicable Wage Determination to determine the rates for Beaver County, PA. Is this acceptable?

The applicable CBA for Building #PA0944 is CBA-2022-371 - PAPSONU(West) which is included as Attachment 5 to the solicitation.

35 Pre-Proposal Conference

During the conference, Mr. Schrank stressed the importance of addressing remote post locations as result of staffing issues on current and previous contracts. In order to fully address and ally Government concerns relative to remote post staffing and supervision, would the Government please consider increasing the page limit for the Technical Proposal from 15 pages to 20 pages?

The page limit for the technical proposal remains 15 pages.

Proposal Evaluation Information Non-price factors, when combined, are more important than price. However, the Government contemplates the possibility that it may identify an offer(s) of such a high technical quality that it would not be in the Government’s interest to pay an additional price premium for any additional technical (non-price) advantage.

As a result, offerors are advised that the Government may not evaluate the technical proposals of all offerors under this RFP. The government will first review the total evaluated price of all proposals received. The technical proposals of those offerors whose pricing is determined by the Contracting Officer to be most competitive may be reviewed prior to, or instead of, other technical proposals received.

PSO Services Region 3 20

Proposal Evaluation Information

Based on the initial review of these technical proposals, the government may not evaluate the technical proposals of other offerors, whose total evaluated pricing was higher than that of one already evaluated and already assigned the highest possible technical adjectival rating.

This would occur when the Contracting Officer determines that one or more of the technical proposals already reviewed is of such a level of quality that it would not be in the interest of the government to incur cost beyond the price of the technical proposals already reviewed.

PSO Services Region 3 21

Basis for Selection The Government will select the responsible

Contractor whose proposal, in conforming to this RFP, provides the overall best value to meet the Government’s requirements, price and non-price factors considered. Only apparent successful contractors determined to be responsible pursuant to FAR 9.104-1 will be issued a contract.
