Solicitation 70RFP322RE3000002 PSO Services - State of Delaware
No. Question Reference (RFP Section)
QUESTION RESPONSE
1 General Does the incumbent currently have the contract fully staffed? If not, what are the differences?
Please refer to the revised Attachment 10 Seniority List included with Amendment 0004. FPS cannot comment on the incumbent contractor’s current staffing but the number of active PSOs on the current contract is 13.
2 General Will the government be mandating the COVID vaccine? On December 7, 2021, the United States District Court for the Southern District of Georgia Augusta Division ordered a nationwide injunction enjoining the Government from implementing Executive Order 14042 in all covered contracts.
The injunction is still in place. At this time, all Government efforts to enforce DHS FAR Class Deviation 22-01, Executive Order 14042, “Ensuring Adequate COVID Safety Protocols for Federal Contractors” are still suspended. Please be advised, as outlined on the Safer Federal Workplaces Task Force website (https://www.saferfederalworkforce.gov), when the COVID-19 Community Level is MEDIUM or HIGH in a county where a federal facility is located, onsite contractor employees to include PSOs who are not fully vaccinated or who decline to provide information about their vaccination status should be able to provide proof of a negative COVID-19 test from within the previous 3 days when in that facility.
3 SOW SOW 3.6: How long will it take to complete each of the three courses in this section (i.e., Privacy at DHS: Protecting Personal Information, Information Technology Security, and Records Management)?
Each course takes approximately one (1) hour to complete.
4 SOW SOW 5.2 Medical: Does the current guard force meet the medical standards in this solicitation, and if not, what are the differences?
Yes. Incumbents must undergo a Medical and Physical exam every (5) years and new hires must undergo Medical and Physical exams prior to standing post.
5 SOW SOW 5.2.3.5 thru 5.2.4.5: Pages 86 and 87 of the SOW appear to be duplicative, except for Section 5.2.3.10. Please advise which of these sections in current.
Please refer to the revised SOW included with Amendment 0004.
The duplicate sections have been deleted.
6 SOW SOW 6.6.4.1: What weapon is the current guard force using? The current weapon is 9mm.
7 SOW SOW 6.7.1.4, 6.7.3.1.1.1: Do all contract employees have to take the NWDTP Instructor Certification? If not, how many can be sent to FLETC to get the certification?
No, all contract employees do not have to take the NWDTP Instructor Certification. It is at the contractor's discretion to determine how many NWDTP trainers are necessary. There is no maximum amount of trainers the contractor can send to FLETC as part of this requirement for the NWDTP Instructor Certification.
However, it is noted the vendor is responsible for all costs associated with travel to FLETC (e.g. lodging, transportation, meals, etc.).
8 SOW SOW 11.2: Is the Contract Manager required to be contract-dedicated? If so, will office space be provided for him?
It is at the contractor's discretion how to fill the Contract Manager position. As a reminder, refer to SOW, Section 11.2.5 - "The Contract Manager shall be available during normal working hours (8:00 am to 4:30 pm local time) within thirty (30) minutes by telephone or in person to discuss deficiencies; after normal duty hours or on weekends and holidays, within two (2) hours." The Contract Manager is not required to be on-site. The Government WILL NOT provide office space to the Contract Manager.
9 SOW SOW 11.5: Is the Quality Control Monitor required to be contract-dedicated? If so, will office space be provided for him?
It is at the contractor's discretion how to fill the Quality Control Monitor position. The Government WILL NOT provide office space to the Quality Control Manager.
10 SOW Attachment Attachment 2 Post Exhibit reflects a CLIN total of 24,609 hours. However, CLINs 0001, 1001, 2001, 3001, and 4001 on the SF 1449 Continuation Sheets (pages 3-4 of the RFP) reflect a total of 28,000 hours per year, which is a difference of 3,391 hours.
What is this difference?
The current, known service requirements are set forth in the post exhibit. In accordance with Addendum to FAR 52.212-4 paragraph 03. Maximum Quantities on pg. 14 of the RFP, the Schedule of Supplies/Services and Prices (i.e. the Schedule) sets forth the maximum quantify of hours that the Government may order per each stated ordering period. The maximum quantities set forth in the Schedule are based on the current known service requirement with adjustments to provide for maximum ordering flexibility. The current, known service requirements are provided for informational purposes only. The Government reserves the right to order up to the maximum quantities set forth in the Schedule.
11 SOW Attachment Attachment 10 Seniority List: The provided seniority list shows 9 PSO’s while the post hours reflect 24,609 hours. Since 9 PSO’s could not provide those hours, is the level of effort different under this SOW? Or, what accounts for the discrepancy?
Please refer to the revised Attachment 10 Seniority List included with Amendment 0004.
12 SOW Exhibit Exhibit 6 Training: Is the current guard force trained to the requirements of this solicitation? If not, what are the differences?
The current guard force is trained to the requirements in the current contract. Offerors are cautioned that all PSOs must meet the training requirements of the Statement of Work (SOW) in this solicitation as there may be some differences.
13 SOW Exhibit Exhibit 10 Post Tracking System: Which post tracking system listed on Exhibit 10 is currently being used by the incumbent contractor?
GETAC Tablet: T800 G2 Premium TAA; GETAC: T800 SnapBack - Smartcard & Magnetic Strip Reader
14 Solicitation Provisions RFP pg 288 #3 Page Limitation: Is the cover page, table of contents, past performance project forms, field level supervision exhibit, and other exclusions from the page count also exempt from the 11 point font restriction?
No, the cover page, table of contents, past performance project forms, field level supervision exhibit, and other exclusions from the page count are not exempt from the 11 point font restriction.
15 Solicitation Provisions RFP pg 288 #3 Font Restriction: Will the government confirm that the header and footer are exempt from the 11 point font restriction?
No, the header and footer are not exempt from the 11 point font restriction.
16 Solicitation Provisions RFP pg 288 #3 Font Restriction: Can the tables, figures, and graphs included in the proposal be presented in a 10 point font size?
No
17 Solicitation Provisions RFP pg 289 Relevant Past Performance: Past Performance Questionnaires (Attachment 4): Many government points of contact will not provide a response to a PPQ request if a CPARS is available. Will the government accept the most recent CPARS in lieu of providing a past performance questionnaire? And, can the CPARS be excluded from the page count?
No, the RFP does not allow offerors to submit a CPARS in lieu of a Past Performance Questionnaire. The Government may also check CPARS.
18 SOW Attachments Attachment 3 Past Project Form and Attachment 8 Field Level Supervision Exhibit: Is it acceptable if offerors convert these two forms to Word so that they can be easily completed and included in the technical volume? If so, is there a page limit for either form?
Yes, it is acceptable. Please refer to Amendment 0004 for the Word version of the Attachment 3 Past Project Form and the Excel version of the Attachment 8 Field Level Supervision Exhibit. There is no page limit for either of these forms.
19 SOW - Attachment AA Is the contractor responsible for the payment of all ongoing certifications & trainings during the duration of the contract?

2. First Aid Certification
3. State Weapons Permit and Renewal (required)
4. State Security Officer Certification and Renewal (as required)
5. Local Permits and Renewals (as required)

8. Contractor Provided Refresher Training
9. Firearms Qualification 1
10. Annual Active Threat Certification
11. Other

20 RFP: page 270 CBA: Article 15 - Health & Welfare Benefits
For the rate of pay on page 20 of 25 are these payments to be added on top of the employee's regular pay for each hour. For example if they get paid $20.11 an hour for 40 hours, they would also get ($4.69 added as well for each hour of their pay for medical)?
In accordance with CBA 2021-461, Section 15.1, under Article 15 Health and Welfare benefits, the Employer will make the following health and welfare contributions, $4.69, on all hours worked on post and in training, up to forty (40) hours per week and up to a total of 2080 hours per contract year for all Employees covered by this Agreement. The minimum H&W payment(s) described in Article 15 are separate from and in addition to the minimum wages described in Article 14, Wages, of the CBA, as amended by Memorandum of Agreement effective February 1, 2022.
21 SOW - Section 5.2 Medical and Physical Qualifications.
For the physical test, they only have to pass all of the physical abilities testing to be considered an employee?
PSOs must pass the medical exam, drug screening exam, and Physical Abilities Test (which is a cardiovascular exam).
22 Solicitation Provisions Is a separate Excel Pricing Schedule required in addition to the SF1449? If yes, will the government provide?
No, a separate Excel file is not required but both a completed SF1449 and the Price Element Breakdown document (Attachment
6) must be provided.
23 General Who is the incumbent contractor currently providing PSO Services? The incumbent contractor is Valensec International.
24 SOW What is the current weapons platform used by the incumbent PSOs? Please see response to question 6.

26 General Are current contractor employees fully qualified in terms of training completion? Please see response to question 12.
27 General Are the current PSOs and Supervisors trained to the NWDTP standards in the solicitation?
PSOs who are assigned to x-ray and non x-ray screening posts and PSO supervisors that provide oversight and supervision for x-ray and non x-ray screening posts are in compliance with the NWDTP standards in the solicitation.
28 General Is the level of effort reflected on the Post Exhibit the same level of effort that is currently being performed by the incumbent guard force?
Yes, but please also refer to RFP section 03 Maximum Quantities and the answer to question 10.
29 SOW Does the incumbent guard force require all new medical certifications? Please see section 5.2.2.1 of SOW. All new hires require a medical and physical exam before they stand post. Incumbent PSOs are required to take a medical and physical exam every 5 years. It is the responsbility the vendor to ensure each PSO meets the requirement of the SOW before they stand post under the new contract.

34 General Is the current contract fully staffed? Please see response to question 1.
35 General When does the Government anticipate the new Post Tracking System (PTS) will become active on this contract?
12/1/2022
36 Solicitation Provisions Yes, for joint ventures, does that mean it can be two different companies submitting a bid and can use a subcontractor? Or does the joint venture mean, one primary company submitting the bid and a subcontractor can be used?
Please refer to the RFP Solicitation Provisions, pages 290 -291, Important Notes for Relevant Past Performance contained in the Factor 1 Relevant Past Performance, for information regarding joint ventures.

Source Selection Criteria Proposals will be evaluated based on the following three (3) evaluation factors:
1) Relevant Past Performance
2) Management Approach
3) Price
Source Selection Criteria (continued)
The technical evaluation factors listed below are listed in descending order of importance.
Relevant Past Performance Management Approach
The technical evaluation factors, when combined, are more important than price.
Relevant Past Performance Relevant past performance
Maximum of 3 projects Timeframe: within the past 3 years Scope: Armed PSO Services Complexity: Multiple, Geographically-dispersed Locations, Similar duties as SOW, etc.
Magnitude: minimum hours similar to the instant requirement References and Past Performance Questionnaires
The Government reserves the right to obtain information from sources other than those identified by the Contractor. The Government will also consider the quality of the Contractor’s relevant past performance.
The Government reserves the right to evaluate submitted projects individually or in the aggregate in order to determine relevance and will do so consistently across all evaluated offers.
Teaming Arrangements Reference FAR 9.6 Where teaming arrangement is proposed, an additional maximum of up to three projects total for partner(s)/subcontractor(s) shall be submitted.
Provide a narrative and/or the actual teaming agreement if one exists.
Include the roles & responsibilities and the distribution of effort for each partner (by type and percentage) anticipated in performance.
Evaluation Criteria - Management Approach

What will be inspected, methods of inspection and frequency Discuss processes for addressing non-compliance issues
Supervision Field Level Supervision Exhibit
Transition Outline significant transition steps Associated timeframes
Evaluation Criteria - Price PSO Service will be priced as fixed hourly rates Contractors shall submit price proposal on the Pricing
Schedule and include a detailed price breakdown for the unit prices.
Government suggests that the Contractor complete the ‘Price Element Breakdown’ (RFP Attachment 6).
Instructions Provided via RFP Attachment 6A Please review CBA information provided Post Tracking System (PTS)
Evaluation Criteria - Price (continued)
Total evaluated price (Base + Options)
Prices may be evaluated for realism
Minimum wage rates and fringe benefits
CBA-2021-461 applies
Proposal Evaluation Information Non-price factors, when combined, are more important than price. However, the Government contemplates the possibility that it may identify an offer(s) of such a high technical quality that it would not be in the Government’s interest to pay an additional price premium for any additional technical (non-price) advantage.
As a result, offerors are advised that the Government may not evaluate the technical proposals of all offerors under this RFP. The government will first review the total evaluated price of all proposals received. The technical proposals of those offerors whose pricing is determined by the Contracting Officer to be most competitive may be reviewed prior to, or instead of, other technical proposals received.
Proposal Evaluation Information
Based on the initial review of these technical proposals, the government may not evaluate the technical proposals of other offerors, whose total evaluated pricing was higher than that of one already evaluated and already assigned the highest possible technical adjectival rating.
This would occur when the Contracting Officer determines that one or more of the technical proposals already reviewed is of such a level of quality that it would not be in the interest of the government to incur cost beyond the price of the technical proposals already reviewed.
Basis for Selection The Government will select the responsible
Contractor whose proposal, in conforming to this RFP, provides the overall best value to meet the Government’s requirements, price and non-price factors considered. Only apparent successful contractors determined to be responsible pursuant to FAR 9.104-1 will be issued a contract.
