About this file

This document is a Questions and Answers (Q&A) record for a federal contract solicitation managed by FEMA.

The solicitation is a small business set-aside with a Commonwealth of the Northern Mariana Islands (CNMI) disaster or emergency area set-aside restriction. Only CNMI-based firms that reside or primarily conduct business in the CNMI are eligible to submit quotations as prime contractors. The anticipated award date is Tuesday, May 26, 2026, with a period of performance of 6 days after award. The solicitation does not disclose the estimated dollar value or Independent Government Estimate (IGE), as this information is procurement sensitive and not required to be released for non-construction projects. The prime contractor must own specified equipment including a barge, vessel, boat, ATV/trailer, and related equipment; equipment owned solely by proposed subcontractors will not satisfy this requirement. FAR 52.219-14 (Limitations on Subcontracting) applies to this RFQ, requiring the prime contractor to perform a specified percentage of work with its own employees and resources while limiting subcontracting to other entities.

QUESTIONS AND ANSWERS

QUESTION: I understand that period of performance is 6 days after award but is there an anticipated award date after closing so we can quote properly?

ANSWER: Anticipated award is Tuesday, May 26, 2026

QUESTION: Would you please be able to share the estimated magnitude order of this project in dollar value range, not the IGE.

ANSWER: You are referencing FAR 36.204 for construction projects. The Federal Acquisition Regulation (FAR) does not require or authorize the disclosure of the estimated dollar value or range for non-construction projects. The Independent Government Estimate (IGE) is procurement sensitive and cannot be released. Therefore, we are unable to share the estimated magnitude order of this project in dollar value range.

QUESTION: May a non-CNMI prime contractor submit a quotation if the work will be performed by a CNMI-based subcontractor that resides or primarily does business in the Commonwealth of the Northern Mariana Islands?

ANSWER: The solicitation includes FAR 52.226-3 (“Disaster or Emergency Area Representation”) and FAR 52.226-4 (“Notice of Disaster or Emergency Area Set-Aside”), which set aside the requirement for offerors that reside or primarily do business in the Commonwealth of the Northern Mariana Islands (CNMI).

Per FAR 52.226-4, only entities that reside or primarily do business in the CNMI are eligible to submit quotations as prime contractors for this set-aside. A non-CNMI prime contractor is not eligible to submit a quotation, even if the work will be performed by a CNMI-based subcontractor.

The eligibility requirement applies to the prime contractor, not the subcontractor.

Therefore, only CNMI-based firms that reside or primarily do business in the CNMI may submit quotations as prime contractors under this solicitation.

QUESTION: The SOW states that “The Contractor must own its own equipment.” Would FEMA accept equipment owned by a proposed CNMI subcontractor/team member, or must the prime offeror itself own the barge, vessel, boat, ATV/trailer, and related equipment?

ANSWER: The Statement of Work (SOW) specifies that “The Contractor must own its own equipment.” This requirement applies to the prime contractor submitting the offer. FEMA will not accept equipment owned solely by a proposed CNMI subcontractor or team member to satisfy this requirement. The prime offeror itself must own the barge, vessel, boat, ATV/trailer, and related equipment as specified in the SOW.

QUESTION: Please also confirm whether FAR 52.219-14 Limitations on Subcontracting applies to this RFQ.

ANSWER: Yes, FAR 52.219-14, “Limitations on Subcontracting,” applies to this RFQ because it is a small business set-aside. The clause requires that the prime contractor perform a specified percentage of the work with its own employees and resources and limits the amount of subcontracting to other entities.
