C - Description/Specifications

1. Background

On October 24, 2018, Category 5 Typhoon Yutu, the strongest typhoon to impact the Commonwealth of Northern Marianas Islands (CNMI) on record caused catastrophic damage to the islands of Saipan and Tinian. Typhoon Yutu caused one death, downed power poles and damaged vehicles, schools, hotels, businesses, airports and hundreds of homes on both islands.

The U.S. President signed a Disaster Declaration on October 27, 2018 making funds available to the Federal Emergency Management Agency (FEMA), to provide disaster assistance to Saipan and Tinian. The Office of Response and Recovery (ORR), Recovery Directorate is seeking to repair and/or replace eligible applicant’s housing affected by the disaster. The services required are in support of the Individual Assistance (IA) Program DR-4404-MP.

2. General Scope of Work

The purpose of this procurement is to acquire services to repair eligible applicant's dwellings impacted in Saipan and Tinian to a habitable; safe, sanitary, and functional condition per the applicable Federal, State and Local code. FEMA defines “habitable” as safe, sanitary, and functional. “Safe” refers to being secure from disaster-caused hazards or threats to occupants; “sanitary” refers to being free of disaster-caused health hazards; and “functional” refers to an item or home capable of being used for its intended purpose.

The Contractor shall ensure compliance with 2018 International Building Code (IBC) for high wind and flooding hazards, and repairs not pertaining to high wind, and flooding standard shall be completed in compliance with 2012 IBC standards to include seismic zone 4 code, permitting, licensing, Federal floodplain management standards and environmental/historical preservation requirements. Please see exceptions to the applicable code requirements, listed below. Utilizing the individual scopes of work that the government will provide, all repair work must be performed by licensed building Contractors, authorized to work in the CNMI, using materials of average quality for the lowest price (“builder grade”), IBC minimum code compliant materials and employing at a minimum 30% local labor (IAW FAR 52.226-5), to the greatest extent possible.

The Program activities require the services of professional construction technicians, engineers, and other related technical specialists with knowledge, experience, and expertise in the professional field of construction services, project management; supply chain/logistics, workforce mobilization & sustainment.

The only items authorized for repair are shown below and the Contractor shall not deviate from this approved list.

2a. Exceptions It is not the Program's intention to bring every aspect of an existing structural, electrical, plumbing and/or other building systems up to current code requirements except where expressly required by the referenced codes or when making authorized repairs to disaster caused damages. Eligible items that are storm damaged shall be repaired as per code requirements, except in cases where FEMA and CNMI have determined otherwise:

2b. Detailed Eligible Repairs for Permanent Housing Construction Interior Repairs

Debris removal

Clean and sanitize damaged materials

Interior wall cover o Ceiling is to be1/2” treated plywood (government furnished material where available), sealed and painted if required.

o Cove molding (unpainted) is to be provided at the perimeter of the ceiling where the ceiling is replaced.

o Insulation installed within the ceiling cavity shall be R-30 as per 2012 International Residential Code (IRC).

Floor, subfloor and floor covering o Ceramic Flooring

Ceramic tile may be replaced in kind where a limited area of ceramic tile is damaged. Match as closely as possible using standard material.

o Vinyl Flooring

Existing flooring that is damaged is to be removed and replaced with sheet vinyl, including vinyl composition tile (VCT) and ceramic tile (except in limited areas where replace in kind is permitted).

Interior doors o Pre-finished interior doors shall be installed, if cost effective.

o Non-finished interior doors shall be painted if more cost effective than pre-finished doors.

(All 6 sides of the door, jamb and casing to be painted as a longevity/warranty consideration).

Cabinets o Remove existing storm-damaged cabinets and replace in kind with up to 8 linear feet for uppers and 8 linear feet for lowers.

o If the cabinets are greater than 8 LF and the cabinet bodies are free of major disaster related damage, the damaged doors shall be removed, and the cabinet bodies left open if there are no sanitation concerns.

o If there is a concrete countertop in good condition (free of major disaster related damage), the damaged materials below the countertop shall be removed and the under counter space left open.

Bathroom vanity

Bathroom exhaust fan o Existing storm-damaged exhaust fans shall be removed and replaced only if there is not a window in the bathroom that meets ventilation requirements (2012 IRC).

Bathroom sink o Bathroom sinks shall be reused (detached and reset) where free of major disaster related damage. Contractors are to use extreme caution when removing a reusable sink. If damaged during the removal process the Contractor shall notify the COR.

Exterior Repairs Windows o IBC 2018 calls for impact-resistant windows or storm shutters. Contractor shall use storm shutters.

o Storm Shutters are to be provided at all windows, whether storm-damaged or not. Storm shutters shall be accordion type.

o Existing sliding glass doors that are not damaged are to be treated as windows, accordion style shutter shall be installed.

o Security bars shall be removed as necessary to perform window repairs and install storm shutters. Rebar-type security bars are to be removed and discarded. Manufactured security bars are to be detached and set aside for the homeowner.

o The glass for damaged louver windows (jalousie type) being replaced may be used to replace missing glass in other louver windows in the home of the same size, where feasible.

o Window openings other than the standard sizes (2x2, 2x3, 2x4, 3x2, 3x3, 3x4, 4x2, 4x3, 4x4) are to be retrofitted to accommodate standard sizing. Window openings may not be reduced beyond the minimum sizes required by IBC 2018 code for light and air requirements.

Roof Covering and Roof Sheathing o Roofing systems shall be galvanized metal roofing.

The roof shall be designed and constructed utilizing government furnished material wherever possible, including 2x dimensional lumber and hurricane ties.

The roof shall be designed per the determined roof type stated in the government furnished scope of work.

o Bond beams shall be replaced only where damaged or where one did not exist and is needed for the roof structure.

Exterior Repairs o All wood installed at the exterior shall be painted for weather protection (including siding for gable ends, soffit, fascia, and the outside of the exterior door). All sides to be painted as a longevity warranty consideration.

o Exterior doors requiring replacement shall be replaced with solid core/metal doors whichever is most cost effective.

o Exterior sliding glass doors that are damaged are to be retrofitted with normal exterior doors and wood framed walls with 3/4” treated plywood sheathing on the exterior and 1/2” treated plywood sheathing on the interior.

o Ceiling/wall insulation.

Exterior Openings o Existing A/C openings that do not contain a functional unit shall be filled with 2x4 stud walls with 3/4” treated plywood sheathing.

Electrical/HVAC Exterior electrical work, to include weather, head, cable, and meter.

Wiring o Romex wiring shall be installed where permitted by code.

o Where conduit is required, the existing conduit shall be reused where it is feasible, safe, and code compliant to do so. If the existing conduit cannot safely be reused it may be replaced.

Electric panel, 200-amp main breaker – 18 circuit o When replacing the panel and rewiring the home, the electric panel may be relocated to a code-compliant location to reduce the length of trunk cable required.

o Where the home has a primary panel and a sub panel, the primary panel shall be replaced to service the entire home. The sub panel shall be disconnected and may remain in the home where it does not pose a life safety hazard.

Outlets or switches o Existing damaged outlets and switches are to be replaced in the same quantity that exists in the home.

o Outlets in wet locations, including bathrooms and kitchens, must be replaced with GFCI outlets in conformance with code requirements.

o 220V receptacles are to be replaced only where there is an existing, storm-damaged 220V outlet.

o If there is not a window in the kitchen meeting the ventilation requirements as per code, a range hood shall be installed.

Air conditioning o 1 Central or mini-split air conditioner is eligible for repair when feasible, or replacement when necessary.

o All functional central or mini- split units may be sanitized, if necessary because of the disaster.

o Repair or replacement of more than one existing, damaged central or split units requires FEMA CO/IA review and approval.

Plumbing Only items which are visible and storm damaged may be included in the scope of work. Unforeseen eligible conditions are to be reviewed by the COR for guidance.

Outhouses o If a home does not have an interior bathroom and the outhouse serves the home, FEMA will make a determination if it is more cost reasonable to replace the outhouse or relocate the bathroom to an interior location.

Kitchen sink o Kitchen sinks shall be reused (detached and reset) where in good condition (free of major disaster related damage). Where a sink is damaged either prior to removal or upon removal, it is to be replaced in kind. Contractors are to use extreme caution when removing a reusable sink. If damaged during the removal process the Contractor shall notify the COR.

Exterior Kitchens o If a home has an interior kitchen, the exterior kitchen is not eligible for repair. Unsafe exterior kitchen structures shall be removed with FEMA notification to the survivor.

o If a home does not have an interior kitchen and the exterior kitchen serves the home, FEMA will make a determination if it is more cost reasonable to replace the exterior kitchen or relocate it to an interior location.

o If an exterior kitchen serves a broader community (is used by more than one household), FEMA will review and determine if the repair of the outdoor kitchen is preferred by the applicant vs moving it to the interior.

Accessibility Related Repairs (if required) FEMA will notify the Contractor if accessibility features have been approved for a home. Specific accessibility related items shall only be included where expressly approved by FEMA or where the feature was preexisting and storm damaged.

o Where roofs are to be replaced, existing catchment systems shall be reconnected.

2c. Ineligible Items Personal Property o Window A/C units are considered personal property and are not eligible for replacement.

Interior Finishes o Backsplashes and Granite Countertops o Interior paint shall not be provided except where necessary to seal pressure treated materials or otherwise specified by FEMA o Interior finishes that did not exist prior to the typhoon (ex. floor covering) are not eligible to be installed.

o Where floor finishes are being replaced, the Contractor is to perform minimum preparation work. Floor leveling is not considered to be storm damage and is not an eligible activity.

Doors o Interior doors that are not a standard size (ex. less than 6’-8” in height) are not eligible for replacement. Damaged materials may be removed, and the opening left open (bed and bath excluded).

Plumbing o Items that were not present prior to the storm are not eligible to be replaced. For example:

If a sink was not present, it will not be installed. If a toilet is missing the tank lid and it was not storm-damaged, the toilet will not be replaced.

Electric o Ceiling fans are not eligible for repair.

o The replacement of outlets and switches shall be limited to storm damaged quantities only.

Exterior Finishes o Exterior painting not required.

2d. Clarifications

a) FEMA will only authorize the repair of septic connection/system(s) that where preexisting and storm damaged.

b) If a home did not have windows (in the CNMI, not all homes have traditional windows, and may just have screens or portals that are boarded up in times of inclement weather) FEMA will only install shutters as required by the approval memo for mitigation as it relates to 2018 IBC code. In summary, no upgrades to the pre-disaster condition of the home are to be provided; only the items listed in the above section(s) of this SOW, if they pre-existed, and were damaged by the disaster, will they be repaired.

c) If structural elements of the pre-disaster primary residence, (e.g. foundation, frame), or other components of the home requiring architectural or engineering services require repair, the home is not eligible for PHC-Repair, except that repairing or replacing roof framing is eligible so long as the home structure can support a 2018 IBC compliant roof.

3. Tasks

a) The Contractor shall obtain all required permits and perform repairs on twenty (20) residential homes (or more) of multiple construction types existing in the CNMI (e.g., wood frame, concrete, brick, etc.). The types of homes may consist of a mix between 1- and 6-bedroom homes. The Government expects the Contractor to complete each repair work order within 120 days [maximum], from the notice to proceed (NTP), and operate toward completion with a sense of urgency, always leaning forward in its planning, operations and reporting in order to complete the repairs as quickly as is possible.

b) Each of the 20 homes will have an associated work order defining the scope of repairs. The Contractor shall conduct site visits to validate the scopes as provided by the Government and submit a cost proposal, work plan and timeline for completion for each site.

c) Construction Standards: The Contractor shall be responsible to present construction plans and designs which will be subject to approval of local regulatory authorities in compliance with the minimum standards referenced herein. Permit applications may require accompanying plans and calculations that are signed/sealed by an authorized professional.

PHC- Repair is subject to numerous federal and CNMI regulations including CNMI Tittle 155-10.1, Building Safety Code Rules and Regulations. Title 155 10.1 stipulates procedures and requirements enforced by DPW related to the safe operation of buildings. DPW reviews and approves housing and commercial applications for permits prior to construction. These regulations address the following specifically:

Permit process and fees (initial application)

Rough in inspections/re-inspections (and associated fees)

Final inspection and Issuance of Certificates of Occupancy (CO)

Adoption of Tropical Energy Code

4. Contractor Furnished Items and Services:

a) The Contractor shall furnish all labor, materials, transportation, equipment, tools and any other items and all services to perform all operations required by this statement of work except items provided in Section 5 Government Furnished Materials.

b) The Contractor shall provide a fully qualified Project Manager who shall be designated as a Key Personnel (HSAR 3052.215-70) responsible for the performance of work. The name of the person and all alternates shall be designated in writing to the Contracting Officer. The project manager shall have full authority to act for the Contractor. The project manager shall be on-site in Saipan, MP during normal work hours and for contingencies requiring work beyond normal work hours. The designated individual must be able to speak and understand English. The Contracting Officer shall have the right to determine whether the proposed representative has sufficient technical and lingual capabilities and the Contractor shall immediately replace any individual not acceptable to the Government.

c) Contract shall have on hand a utility locator device for use to ensure missing existing utilities while excavating on site.

5. Government-Furnished Materials (GFM)

The government will provide the following materials for the Contractor to draw upon per individual scopes of work. The materials will be available on Saipan for collection upon receipt of a Notice to Proceed (NTP).

The materials are staged in Saipan and shall be collected in their entirety and stored/secured by the Contractor; the location will be provided to the Contractor after award. The Contractor shall use the GFM and reflect a reduction in cost when submitting price proposal.

6. Special Requirements

6a. General The Contractor shall establish its management team on Saipan, MP to ensure close coordination with FEMA. The Contractor may be required to provide representation in FEMA facilities on an on-call or regular basis.

The Contractor shall participate in one or more weekly coordination meetings with FEMA IA at the Saipan, MP Recovery Office (RO) at the discretion of the CO /COR.

Upon completion of repairs, the Contractor shall ensure that the site is clear of all debris, hazards and machinery; that the interior is clean from construction activities and that the home is safe, sanitary, functional and ready for occupancy.

The Contractor shall ensure repairs to accessibility features and accessible routes are guided by the Americans with Disabilities Act Accessibility Guidelines (ADAAG) and the Housing and Urban Development’s (HUD) Design Details for Accessible Disaster Relief Housing.

The Contractor shall be responsible for procuring, transporting, storing, securing and disposing of all construction-related materials necessary for the repair of the homes.

The Contractor is required to use U.S. licensed engineer(s)/architect(s) as appropriate for the development of and stamping of designs being submitted for permitting.

o The contractor shall use a CNMI licensed PE for any electrical design exceeding 200 amps.

There may be additional labor regulations in the CNMI legislative code in addition to the FEMA requirement to utilize 30% local labor (FAR 52.226-5) to the maximum extent possible. The Contractor shall cite these codes and compliance within their project plan.

The Contractor shall comply with inspection requirements and coordinate with building official(s) as mandated by the building department to verify that the structure is being repaired in accordance with the issued permit.

The Contractor shall set up a construction schedule plan considering local weather conditions and forecasts during the task order.

Any construction schedule change shall be provided by the Contractor to the FEMA CO/COR for review and approval by the CO and shall be noted on the Contractor’s daily reports.

The Contractor shall be responsible for Quality Control, Construction/Project Management, production schedule, site security and safety.

The Contractor shall allow FEMA and its Contractors/agents on the work site for the purposes of technical monitoring and quality surveillance (which includes taking photographs onsite).

The Contractor shall coordinate with the local entities / authorities for permits and utility identification.

The Contractor shall ensure all construction materials meet U.S. construction standards and are procured in compliance with the Buy American Act. The Contractor shall articulate that they will meet these requirements and construction standards in their Proposal.

The Contractor shall be responsible for obtaining all required bonds and permits for all phases of construction to include, demolition, debris removal, disposal of materials, site preparation and construction and must provide copies to the CO / COR.

The Contractor shall coordinate the installation of essential utility repairs with CNMI Commonwealth Utility Company (CUC) to prevent any adverse impact on the delivery schedule.

The Contractor will be authorized to act on behalf of the homeowner to request the disconnection and reconnection of any utilities as necessary/applicable to complete repairs. The Contractor shall also be responsible for paying fees associated with the disconnection or reconnection of the utility when a fee is charged.

Unexploded Ordnance: If any item is discovered that may be an unexploded ordnance, immediately alert the COR. The COR will contact the appropriate agencies for handling.

Once repairs are completed and the permit closed, FEMA will conduct a quality inspection review and accept the property back from the Contractor in order to transfer it to the survivor. If there are items identified requiring remediation, FEMA and the Contractor shall develop an on-site list of items requiring remediation at no additional cost to the government. This list must be forward immediately to the COR.

PHC-Repair is not authorized for pre-disaster primary residences within a Special Flood Hazard Area (SFHA).

6b. Environmental and Historical Preservation Considerations for Environmental and Historic Preservation for the Repair of eligible applicants’ dwellings in the Commonwealth of Northern Marianas Islands (CNMI) damaged by Super Typhoon Yutu.

If the contractor identifies a need for a variance or a consideration below was not taken, the contractor shall provide a detailed scope of work describing all work to be performed and call special attention to any point covered below. If it is not possible to comply with any specific or combination of the below items, the contractor shall notify the COR and request guidance.

Existing in-ground elements such as driveways and walkways will be left in place.

There will be no clearing and/or grubbing of vegetation or removal or trimming of trees or stumps.

All access and staging of equipment and materials shall be limited to previously existing hard (paved or gravel) surfaces.

Any fill (soil or gravel) will be obtained from a previously disturbed commercial borrow source.

No temporary debris staging sites will be established without submitting the details of the proposed site to the FEMA COR so that FEMA may conduct an EHP review. The COR will advise the Contractor upon completion of review if the site is acceptable for use. Temporary staging of debris will be limited to previously existing hard (paved or gravel) surfaces at the individual housing sites.

Debris on the site(s), including buildings and/or remnants of buildings that will be demolished, and debris generated during construction, will be removed to an existing, licensed landfill, currently limited to the Marpi Solid Waste Facility (MSWF) on Saipan; permit issued on November 15, 2015

(SWMF-S-LF-01-2015).

There are no licensed solid waste disposal facilities or transfer stations on Tinian. Debris on the site(s), including buildings and/or remnants of buildings that will be demolished, and debris generated during construction at the sites on Tinian, will be disposed of at the Marpi Solid Waste Facility (MSWF) on Saipan.

7. Period of Performance

The period of performance (PoP) for this contract is 180 calendar days from date of the notice to proceed (NTP) (including six (6) days of travel time; three (3) days for mobilization and three (3) days for de-mobilization). The Contractor shall participate in the task order kick‐off meeting at the Government’s discretion after task order award, on the date/time specified by the Contracting Officer or his/her designee.

The contract has one (1) option period for 180 calendar days. However, the Government is not obligated to exercise an option.

8. Area of Operation

The Contractor shall be tasked with performing this activity as directed by the Government; nominally in or around multiple areas in Saipan and Tinian to be determined per Government’s need. The Contractor shall provide a schedule to FEMA in writing where it is planning to construct at least 48 hours prior to commencement.

9. Experience / Skills

The Contractor shall provide personnel with expertise in construction. The Contractor shall identify shortfalls in skilled labor and provide immediate resolution and strategies for addressing shortfalls. Where discrepancies, deficiencies or weaknesses are identified by either FEMA or Contractor, the Contractor shall be responsible to make correction(s) immediately and shall be liable for any delay in the completion of a home repair due to these short-falls. The Contractor shall conduct preliminary background checks on all staff assigned to the contract and receive favorable results. This process will increase the likelihood of personnel submitted for FEMA’s background investigation receiving approval.

10. Project Execution

The Contractor shall execute the permanent housing repair mission per the purpose and scope above, per work orders issued for repair, and per the Contractor’s accepted Project Management Plan. The Contractor shall notify the COR immediately if there are unforeseen interruptions due to weather, hazardous conditions, or safety issues. If there is a potential delay in the schedule, the Contractor shall notify the CO/COR immediately but not less than 24 hours out. All services listed in the Statement of Work shall be provided in compliance with applicable Federal, Commonwealth, and local laws and regulations and as applicable to waiver(s) CNMI has issued. The Contractor shall deliver a biweekly (every two weeks) labor report to the

COR.

The Contractor shall provide professional, courteous, and timely services, activities, and management to ensure that all work identified in the Government furnished individual work orders and objectives are completed per task order. This includes incorporating customer service into operations, where appropriate, as well as employing a flexible and transparent performance management system that includes performance measures of Contractor staff, subcontractors, and other representatives.

12. Operational Day

Unless otherwise specified by the Contracting Officer or Contracting Officer’s Representative (COR) the work in this requirement is to be performed during the normal operational day. Operational days may consist of up to ten (10) hours per day, seven (7) days per week excluding Federal Holidays or as determined by the

CO.

13. Accident Prevention

The Contractor shall comply with all safety and preventative requirements and authorities during the period of performance in accordance with Occupational Safety and Health Administration standards. Written reports concerning safety issues (i.e. infractions, injuries, etc.) shall be sent to the FEMA COR immediately.

After contract award and if deemed necessary, FEMA Contracting Officer may require a Safety Plan to be submitted to the COR.

14. Security Considerations (DATA)

The Contractor shall provide background checks for all Employees working on this mission to the COR. The Contractor shall badge all Employees working on this mission. The Contractor’s identification (ID) badge shall include: company name, identification number, individual’s name and company phone number. The Contractor issued badge shall not include the words “FEMA or FEMA Contractor” or any governmental logo that gives the impression that the person is a Government employee or is otherwise an agent of the government. The Contractor’s personnel (including temporary or sub-Contractors) shall wear an ID badge provided by the Contractor. The Contractor provided ID badges shall always be visible when performing work.

The Contractor shall maintain, transmit, retain in the strictest confidence, and prevent the unauthorized duplication, use, and disclosure of information. The Contractor shall provide information only to HSPD-12 cleared employees, Contractors, and subcontractors having a need to know such information in the performance of their duties for this project.

Information made available to the Contractor by the Government for the performance or administration of this effort shall be used only for those purposes and shall not be used in any other way without the written agreement of the Contracting Officer.

If public information is provided to the Contractor for use in performance or administration of this effort, the Contractor, except with the written permission of the Contracting Officer, may not use such information for any other purpose. If the Contractor is uncertain about the availability or proposed use of information provided, the Contractor will consult with the COR regarding use of that.

The Contractor agrees to assume responsibility for protecting the confidentiality of Government records which are not public information. Each employee or subcontractor of the Contractor to whom information may be made available or disclosed shall use the information provided only for a purpose and to the extent authorized herein. Penalties for non-approved release of privacy data shall be subject to penalties described in accordance with the Privacy Act of 1974, 5 U.S.C. § 552a.

Performance of this effort may require the Contractor to access and use data and information proprietary to a Government agency or Government Contractor which is of such a nature that its dissemination or use, other than in performance of this effort, would be adverse to the interests of the Government and/or others.

The Contractor and its personnel shall not divulge, or release data or information developed or obtained in performance of this effort, until made public by the Government, except to authorized Government personnel or upon written approval of the Contracting Officer. The Contractor shall not use, disclose, or reproduce proprietary data that bears a restrictive legend, other than as required in the performance of this effort.

Nothing herein shall preclude the use of any data independently acquired by the Contractor without such limitations or prohibit an agreement at no cost to the Government between the Contractor and the data owner that provides for greater rights to the Contractor.

All deliverables, source code, reports, and data received, processed, evaluated, loaded, and/or created as a result of this contract shall remain the sole property of the Government unless specific exception is granted by the Contracting Officer.

15. Employment Eligibility Verification (e-verify)

Executive Order 12989 mandates the electronic verification of all employees working on any federal contract. The Contractor shall agree that each employee working on this contract will successfully pass the DHS Employment Eligibility Verification (E-Verify) Program, which is operated by the Department of Homeland Security in partnership with the Social Security Administration to establish work authorization.

The Contractor shall ensure that each employee working on this contract has a Social Security Card issued and approved by the Social Security Administration. The Contractor shall be responsible to the Government for acts and omissions of its own employees and for any subcontractor(s) and their employees.

Subject to existing law, regulations, and/or other provisions of this contract, illegal or undocumented aliens will not be employed by the Contractor or with this contract. The Contractor shall ensure that this provision is expressly incorporated into any and all subcontracts or subordinate agreements issued in support of this contract.

16. Personnel Security Requirements

The Contracting Officer, in coordination with FEMA’s Personnel Security Division (PSD), shall ensure that all solicitations and contracts comply with the following Federal Acquisition Regulations and Homeland Security Acquisition Regulations by including the requisite clauses, as applicable:

Background Investigations All Contractor personnel who require access to DHS or FEMA information systems, routine access to DHS or FEMA facilities, or access to sensitive information, including but not limited to Personally Identifiable Information (PII), shall be subject to a full background investigation commensurate with the level of the risk associated with the job function or work being performed. FEMA’s Personnel Security Division (PSD) will determine the risk designation for each Contractor position by comparing the functions and duties of the position against those of a same or similar federal position, applying the same standard for evaluating the associated potential for impact on the integrity and efficiency of federal service.

Low Risk without Information System Access Contractor personnel occupying positions or performing functions with a Low Risk designation and who do not require access to DHS or FEMA information systems shall undergo a National Agency Check with Inquiries (NACI) and a credit check and must receive a favorable adjudication thereof from FEMA PSD prior to performing work under this contract.

Low Risk with Information System Access Contractor personnel occupying positions or performing functions with a Low Risk designation and who require access to DHS or FEMA information systems shall undergo a Moderate-Risk.
