A. INTRODUCTION:
The Federal Emergency Management Agency (FEMA) intends to award a single-award Firm-Fixed Price IDIQ for building supplies. FEMA reserves the right to issue a multiple award IDIQ. The solicitation number is 70FBR919Q00000035 and is issued as a Request for Quotation (RFQ) prepared in accordance with FAR 16.504(a)(4). This RFQ document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-97. This acquisition is competitively solicited under a set aside for small businesses located in the area impacted by DR-4404-MP. The applicable North American Industry
Classification Standard (NAICS) code is 444130 Hardware Stores with a small business size standard of $7.5 Million.
FEMA anticipates purchasing the items in the estimated quantities that are included in the attached Pricing Template (see
Attachment 2). A detailed description of the requirement can be found in the attached Statement of Objectives (SOO)(see
Attachment 1). The factors identified under Section C of this RFQ will be the evaluation factors used to evaluate the offer. Quotes must be specific in details and clearly identify all the government requirements.
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation;
proposals are being requested and a written solicitation will not be issued.
Note: The Federal Government abides by the Buy American Act. Contracts should familiarize themselves with
FAR clause 52.225-1 located in Section E of this Request for Quote. There is no exception to the Buy American
Act for the Commonwealth of the Northern Marianas Islands (CNMI). FAR 52.225-5 Trade Agreements does not apply to this procurement.
B. INSTRUCTIONS AND GENERAL INFORMATION

Questions: Questions regarding this RFQ shall be submitted to the contracting officer and contract specialist via email only, no later than 11 am Chamorro time March 4, 2019. Questions received after this time may not be considered.
Quote: Quotes are due no later than 11 am Chamorro time March 6, 2019.

Late quotes may not be accepted.
3. Submission Requirements:
Response to this solicitation is restricted to the participation of small businesses residing or primarily doing business in the disaster affected area. The disaster affected municipalities are: Northern Marianas, Rota, Saipan, and Tinian.
4. Quote Cover Letter – Content:
All proposal submissions must include the following information:
a. Company’s Complete Name and Address
b. Tax Identification Number (TIN)
c. Dun & Bradstreet Number (DUNS)
d. Point of Contact Name
e. Contact email address
f. Contact telephone
g. Complete business mailing address
5. Price Quote:
The contractor shall complete the Pricing Template listed in Attachment (2). Do not change the government provided estimated number of units; simply complete the information per the instruction listed in the Pricing
Template. The government will confirm calculations for accuracy.
6. Proof of Local Area Representation (This Information Must Be Submitted With Your Quote):
This requirement is being set-aside for vendors located in the disaster affected area. The disaster affected municipalities are: Northern Marianas, Rota, Saipan, and Tinian.
The following FAR clauses all pertain to this solicitation: 52.226-3, 52.226-4, and 52.226-5.
1. FAR Clause 52.226-3-(d), states:
(c) An offeror is considered to be residing or primarily doing business in the set-aside area if, during the last twelve months— mailto:Kimberly.hodge@fema.dhs.gov
(1) The offeror had its main operating office in the area; and
(2) That office generated at least half of the offeror's gross revenues and employed at least half of the offeror's permanent employees.
The information listed in section (c) 1 and 2 must be submitted with your bid. The following information must be submitted.
2. Proof that the vendor’s main operating office is located within the disaster affected area. The Contracting Officer will look up the offeror SAM.gov registration, to determine the address listed in the SAM.gov. Please ensure that your registration is up to date.
3. That office generated at least half of the offeror’s gross revenue: A statement listing the total revenue generated within the last 12 months. How much of this revenue was generated in the disaster affected area.
4. The office employed at least half of the offeror’s permanent employees: A statement listing the names of the permanent employees employed by your main operating office. A statement confirming that at least half of the listed employees represent half of the offeror’s permanent employees.
Section (d) and (e) of that same clause states that:
(d) If the offeror does not meet the criteria in paragraph (c) of this provision, factors to be considered in determining whether an offeror resides or primarily does business in the set-aside area include:
(1) Physical location(s) of the offeror's permanent office(s) and date any office in the set-aside area(s) was established;
(2) Current state licenses;
(3) Record of past work in the set-aside area(s) (e.g., how much and for how long);
(4) Contractual history the offeror has had with subcontractors and/or suppliers in the set-aside area;
(5) Percentage of the offeror's gross revenues attributable to work performed in the set-aside area;
(6) Number of permanent employees the offeror employs in the set- aside area;
(7) Membership in local and state organizations in the set-aside area; and
(8) Other evidence that establishes the offeror resides or primarily does business in the set-aside area. For example, sole proprietorships may submit utility bills and bank statements.
(e) If the offeror represents it resides or primarily does business in the set-aside area, the offeror shall furnish documentation to support its representation if requested by the Contracting Officer. The solicitation may require the offeror to submit with its offer documentation to support the representation.
If the information in section cannot be provided, the offeror shall provide as much information in section (d) (1 through 8) as possible for the Contracting Officer to make a determination that the offeror primarily does business in the disaster affected area.
This RFQ requires registration with the System for Award Management (SAM) in order to be considered for award, pursuant to applicable regulations and guidelines. Registration information can be found at www.sam.gov. Registration must be
"ACTIVE" when your bid is submitted.
C. EVALUATION:
Award will be made to the Lowest Priced Technically Acceptable (LPTA) quote that meets or exceeds the acceptability standards for non-price factors (e.g. Technical). Technical factors must be rated as acceptable in order to evaluate the price factor. For example, if the technical factors are rated as acceptable, price will then be evaluated. However, if any of the http://www.sam.gov/ technical factors are rated as unacceptable; the evaluation process stops and award cannot be made to that offeror. If all offerors are rated technically acceptable, award will be made to that offeror with the lowest priced technically acceptable quote. The Government intends to make award without discussions, however, clarifications may be necessary.

(2) Evaluation Factors and Submittal Requirements:
a. The Government will evaluate price to determine whether the offered price is fair and reasonable. Price will be the factor in making the final determination for award.
b. Analysis of price will be performed in accordance with FAR 15.404-1 to determine completeness, reasonableness.
c. Offerors must complete the attached pricing template.
(3) Technical:
a. Offeror is local to the set-aside area
b. Required specifications are met: Offeror must submit in writing their ability to meet or exceed the requirements specified in the attached Statement of Objectives (SOO).
c. Materials: Offeror must submit in writing their ability to provide all the items in the attached material supply list.
d. Supplies on Saipan: Offeror must submit in writing their ability to provide all the required items on Saipan.
e. Supplies on Tinian: Offeror must submit in writing their ability to provide all the required items on Tinian.
(4) Past performance:
a. Name at least three projects completed in the last three years that are similar in size, scope, and complexity provided building material. Supply sales to Government as well as Commercial businesses will be accepted.
(5) Ratings:
a. Price: Price will be evaluated separately from the technical proposal and will be evaluated for reasonableness and completeness
b. Technical: Technical Capability will be evaluated using the technical evaluation rating criteria set forth below to determine the most qualified source from a technical standpoint. An objective technical evaluation will be performed on each technical proposal based solely on the information furnished and not on previous knowledge or associations. The technical evaluation will result in a score of Acceptable or Unacceptable:
Acceptable: expected to meets or exceed the requirement.
Unacceptable: is not expected to meet the requirements
c. Past Performance will be evaluated to determine if the Past Performance listed is similar to the requirement being requested in this RFQ. The following rating will be used for Past Performance:
Pass: Based on the offeror’s past performance record, it is likely that the Offeror will successfully perform the required effort.
Neutral: No relevant performance record is identifiable upon which to base a meaningful performance rating.
Fail: Based on the offeror’s past performance record, it is not likely that the Offeror will successfully perform the required effort.
In addition to contacting references, the Government reserves the right to check outside sources and systems such as the Contractor Performance Assessment and Reporting System (CPARS) and the Past Performance
Information Retrieval System (PPIRS).

(h) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in
FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the
Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

52.216-18 ORDERING (OCT 1995)
(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from March 18, 2019 through March 17 2019
(estimated).
(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.
(c) If mailed, a delivery order or task order is considered “issued” when the Government deposits the order in the mail. Orders may be issued orally, by facsimile, or by electronic commerce methods only if authorized in the Schedule.

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than
$200, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.

(3) A series of orders from the same ordering office within 10 days that together call for quantities exceeding the limitation in paragraph (b)(1) or (2) of this section.
(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal
Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.
(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 5 days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.
52.216-22 INDEFINITE QUANTITY (OCT 1995)
(a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract.
(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause.
The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the "maximum." The Government shall order at least the quantity of supplies or services designated in the Schedule as the "minimum."
(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.
(d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period;
provided, that the Contractor shall not be required to make any deliveries under this contract after 6 months past effective period of contract.
52.217-6 OPTION FOR INCREASED QUANTITY (MAR 1989)
The Government may increase the quantity of supplies called for in the Schedule at the unit price specified. The Contracting
Officer may exercise the option by written notice to the Contractor within 5 days. Delivery of the added items shall continue at the same rate as the like items called for under the contract, unless the parties otherwise agree.
52.217-7 OPTION FOR INCREASED QUANTITY – SEPARATELY PRICED LINE ITEM (MAR 1989)
The Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor within 5 days. Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree.
52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract.
These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The
Contracting Officer may exercise the option by written notice to the Contractor within five (5) calendar days before the contract expires.
52.217-9 – OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within one (1) calendar days;
provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least five (5) calendar days before the contract expires.
