9MM DUTY AMMUNITION

Q&A

Questions and Answers in reference to the RFP Dated 5/31/22

Offeror Question #1: Can the due date for the solicitation be extended for a minimum of 30 days? Due to current industry supplier delays, freight company availability, expected holiday delays from the prior week, and a scheduled plant maintenance shutdown we are concerned on being able to meet the current due date.

Government Answer #1: Unfortunately, the Government is not able to extend the RFP submission date as this is a mission critical and time sensitive award for FY22.

Offeror Question #2: 52.216-19(b)(3): Please clarify regarding Order Limitations.

Government Answer #2:

Minimum Order- The Government will guarantee 50,000 rounds for EACH IDIQ award.

Number of IDIQ awards total is TBD until after the evaluation stage is completed.

Maximum Order- The Government will not award any single Delivery Order exceeding $7.5M (commercial test ceiling). The Government has established a ceiling of $24M for the life of the POP so that is the maximum amount of possible DO’s that will be ordered.

Offeror Question #3: 52.216-22(d): Please provide the maximum date of contract/order completion.

Government Answer #3: The Government may award Delivery Orders up until the expiration date of the IDIQ, which is 5 years from the POP start date of the IDIQ initial parent award(s).

Offeror Question #4: Section 4.11.4 Laminated Glass: Given glass thickness can vary from supplier to supplier even within the ¼” AS-1 designation, can DHS/ICE provide a thickness measurement of their glass test panes?

Government Answer #4: Anticipating that this was a perceived issue because the question was asked earlier this year, all glass that will be utilized in the solicitation had been measured. The glass was purchased several years ago from one supplier. Below is the data for the glass that will be used.

Average Thickness = 0.2370” Thinnest Sheet = 0.2361”

Thickest Sheet = 0.2386” Standard Deviation = 0.000798”

Offeror Question #5: Section 4.12 Function: Can DHS/ICE provide the make and model of suppressers used in conjunction with the SIG MPX?

Government Answer #5: GEMTECH Lunar 9.

Offeror Question #6: Attachment 6 - Technical Evaluation Worksheet: Page 4 only appears to have 4 1-point criteria identified out the 10 possible. Will DHS/ICE comment on the other 6 out of 10 points scoring?

Government Answer #6: Each of the three individual environmental conditions in Sections

3.14 are scored with the same point values as Section 3.13.

Offeror Question #7: Section 4.8, Bullet Push: What is the machine speed setting for execution of the test?

Government Answer #7: Machine speed is set at 0.16 in/min.

Offeror Question #8: Solicitation 70CMSW22R00000011- RFP/Attachment 1; Page 2 “Delivery Terms”- Would DHS/ICE consider limiting FOB Destination language/requirements to the CONUS, Alaska, Hawaii, Puerto Rico & the US Virgin Islands only and allow for market shipping/freight rates to Guam and the Northern Marianna Islands orders to be added at the time of delivery/fulfillment?

Government Answer #8: The Government agrees to remove the locations of Guam and Northern Marianna islands from the RFP. No ammunition orders will go to either location during the IDIQ(s) POP.

Offeror Question #9: Solicitation 70CMSW22R00000011- RFP/Attachment 1; Page 7 “Evaluation Criteria/Basis for Award”- In the event DHS/ICE chooses to make multiple awards, and in accordance with FAR 16-505.b where vendors will be” awarded competitive delivery orders”, will vendors be required to provide LAT sampling up front with the “Fair Opportunity” response or after the “Fair Opportunity” has been awarded to the vendor?

Government Answer #9: Fair Opportunity under this section refers to if a multiple award IDIQ vehicle is awarded. If that happens, each delivery order (AKA requirement) will be competed among the IDIQ awardees for the life of the IDIQ POP.

Offeror Question #10: Solicitation 70CMSW22R00000011- SOW/Attachment 2; Page 8 “3.10/Velocity”- Will OFTP use the same (n-1) method to calculate velocity as described in section 4.11.5?

Government Answer #10: Velocity data is generated through the Oehler 83 computer.

Offeror Question #11: Solicitation 70CMSW22R00000011- SOW/Attachment 2; Page 12 “4.10.2/Precision Grouping/Pistol”- Please describe what barrel length P320 will be tested during this (and other) evaluations. Also, will OFTP be firing both G19 and P320 and taking the best score or average? Or will all submissions be evaluated in one of the two?

Government Answer #11: The barrel length of the SIG P320 pistol used for Precision Grouping (Pistol) is 3.9”. All evaluations will use the SIG P320 3.9” except for Function (Section 4.12) which will also utilize the additional firearms listed.

Offeror Question #12: Solicitation 70CMSW22R00000011- SOW/Attachment 2; Page 12 “4.11/Terminal Ballistics”- Can DHS/ICE provide suppliers and part numbers for each of the following: Heavy cloth (sub-components: shirts, denim, and comforter), Laminated Glass, and 20-gauge hot rolled galvanized steel?

Government Answer #12: The barrier materials that will utilized during the test were purchased in bulk several years ago from local vendors. No suppliers or part numbers are available. The specifications for each material are detailed in Sections 4.11.2, 4.11.3, and 4.11.4.

Offeror Question #13: Solicitation 70CMSW22R00000011- SOW/Attachment 2; Page 14 “4.12/Function”- Can DHS/ICE specify the model/type of suppressor they plan to utilize in function testing? Also, can you expand upon how function testing will be conducted particular to the SIG MPX; semi-auto, full-auto, or both? Number of rounds/magazines per event? Will the test events be the identical for both suppressed and unsuppressed?

Government Answer #13: MPX suppressor will be the GEMTECH Lunar 9. Rate of fire for the function of the MPX will be 6 rounds full auto/24 rounds semi-auto for each 30-round magazine. Suppressed and unsuppressed function will follow the same rate of fire. Section 4.12 details the number of rounds/magazines.

Offeror Question #14: Is this a new requirement or a re-solicitation of a pre-existing requirement?

Government Answer #14: This is a re-compete of an existing mission critical ICE/OFTP requirement. The current IDIQ providing 9mm duty ammunition expires on 9/26/22.

Offeror Question #15: If an award is made, is the awardee (or are the awardees) required to accept every buy or purchase order on the IDIQ, or can an awardee decline an order based on supply chain issues?

Government Answer #15: If a single award IDIQ is contemplated, the IDIQ awardee is required to accept every DO for the life of the POP. If a multiple award IDIQ vehicle is awarded, each DO will be competed among all IDIQ awardees. Each awardee is encouraged to submit pricing for each competed DO.

Offeror Question #16: How much advanced notice will be made on orders and on larger orders is there flexibility in delivery time from when an order is made?

Government Answer #16: The Government will do their best to alert the IDIQ awardee(s) when a requirement is finalized. There is no set “advanced notice” standard at this time.

Offeror Question #17: Will ICE be selecting more than two awardees or is this requirement absolutely capped at 1 or 2 awardees (as references in Attachment 1 and Attachment 7)?

Government Answer #17: ICE intends to award multiple IDIQ awards; however, the ultimate decision on how many IDIQ awards will not be decided until after the evaluation stage is completed.

Offeror Question #18: Will any ammunition be delivered overseas?

Government Answer #18: No, the Government will not have a requirement for Offerors to send ammunition overseas during the POP of the IDIQ award(s).
