About this file

This is a Questions and Answers document for ICE RFQ 70CMSD27Q00000001, an employee shuttle transportation service solicitation for the Office of Principal Legal Advisor (OPLA) in Newark, New Jersey. The document addresses 41 industry questions regarding contract requirements, vehicle specifications, operational parameters, and administrative procedures.

Service Requirements and Operational Details: The contractor must provide an 8-10 passenger capacity vehicle with driver to transport OPLA employees between 970 Broad Street, train stations, and nearby parking lots. Maximum simultaneous passenger capacity is approximately 10 persons. Exclusive use of the vehicle begins at 4:30 p.m. with pickups continuing through the final drop-off at approximately 7:15 p.m. Service operates Monday through Friday, excluding 11 federal holidays (Good Friday is not observed). No departure intervals or maximum passenger wait times are mandated. The contractor must provide one vehicle; multiple vehicles daily are not permitted. A designated pickup area exists at 970 Broad Street, and the contractor must secure its own parking. During unsafe weather conditions, the Government will notify the vendor to cease service, with no monthly payment adjustments for government-cancelled service.

Administrative, Subcontracting, and Award Terms: Contract performance begins November 1, 2026, with a total projected performance period through October 31, 2031. The evaluation methodology is Best Value Tradeoff Process. Pricing must be submitted using the provided template (Attachment 3) and converted to PDF format. For small-business prime contractors, subcontracting is permitted under FAR Clause 52.219-14, limiting subcontractor payments to 50 percent of government compensation for non-similarly situated entities. Subcontractors need not be SAM-registered, though prime contractors must maintain active SAM registration at quotation submission and award. Past performance requires submission of at least two references from substantially complete contracts within the last three years; offerors with no relevant past performance must affirmatively declare this status. Insurance and driver licensing verification are required before award. No background checks are currently required but may change based on future security requirements. The Government will not provide overnight parking or reimburse additional costs if vendors choose larger-capacity vehicles. Economic price adjustments may be requested for fuel fluctuations.

8-10 passengers are only required for this service. If the vendor chooses to use a larger capacity vehicle, the Government will not cover any additional costs.

Per the SOW, there is only one vehicle with a maximum capacity of 10 passengers required for this effort.

29 Does the specified 8–10 passenger capacity exclude the driver, and would a larger passenger vehicle be acceptable? Are wheelchair accessibility, vehicle age, or other equipment specifications required beyond those stated in the SOW?

The capacity excludes the driver. No other vehicle specifications are required per the SOW.

Please clarify whether the fixed monthly payment remains unchanged when the government cancels service and whether service outside the stated schedule would require separate authorization and a contract modification.

See Question #21 for weather. Resultant contract will be Firm Fixed-Priced, there will not be change in monthly payments if the Government cancels service due to weather.

35 Is this a follow-on to an existing shuttle contract? If so, is a collective bargaining agreement applicable, and will incumbent employee length-of-service information be made available for determining any applicable vacation benefit obligations?

- Follow-on contract, confirming CBA applicability for WD 2015-4211 Rev.35 is recommended.
