Request for Quote (RFQ) 70B06C24Q00000179 Amendment A0001- Question and Answer
1# Question Government Response RFQ Changes (if any) 1 Confirmation of your specific requirements and quantities for each ordering period.
Technical requirements are listed in the RFQ Attachment 1- Statement of Work. Quantities to be delivered each ordering period will vary and are undetermined at this time, thus the reasoning for establishing an indefinite delivery, indefinite quantity contract. As need for deliveries arise, CBP will issue delivery orders for quantities not to exceed those listed at 52.216-19, with total orders not to exceed $7,400,000.00 over the life of the contract.
None.
2 Any additional compliance or quality standards that must be met.
All compliance and/or quality standards are identified in the solicitation, to include Attachment 1- Statement of Work.
None.
3 Preferred timelines and delivery schedules. All preferred timelines and and/or delivery schedules are identified in the solicitation, to include Attachment 1- Statement of Work.
Order-specific delivery deadlines will be established in each order.
None
4 Any other specific needs or preferences your organization may have.
All requirements are identified in the solicitation, to include Attachment 1- Statement of Work.
None.
5 Regarding the requirement that the adapter shall incorporate visual reference of adapter/suppressor alignment, our suppressor uses an internal taper lock muzzle device which self-centers the firearm and suppressor, creating consistent and repeatable proper alignment when installed.
Would this be an acceptable substitution for a visual reference?
As long as it is consistent and repeatable and can be accomplished by any field officer/agent correctly, then an internal taper lock muzzle device that self-centers the firearm and suppressor is acceptable.
RFQ Statement of Work, Section 4.4 has been revised to allow an adapter that in lieu of a visual and/or tactile reference to adapter/suppressor alignment, adapter may include an internal taper lock muzzle device.
RFQ Pg. 27 has been updated to include an internal taper lock muzzle device to ensure adapter/suppressor alignment.

and suppressor, creating consistent and repeatable proper alignment when installed.
Would this be an acceptable substitution for a tactile reference?
RFQ Pg. 27, Suppressor Adapter has been updated to include an internal taper lock muzzle device to ensure adapter/suppressor alignment in lieu of a visual and/or tactile reference to adapter/suppressor alignment.
7 Regarding the requirement that the standard suppressor shall have a reading not to exceed 140 db, will the Government specify what testing hardware/equipment is being used and to what standard? i.e, No shot above reading, average reading, etc.
No round to exceed 140 db.
The government may verify db readings utilizing PCB Piezotronics Model 377C10.
None.
8 Regarding the requirement that the mini suppressor shall have a reading not to exceed 142 db, will the Government specify what testing hardware/equipment is being used and to what standard? i.e, No shot above reading, average reading, etc.
No round to exceed 142 db.
The government may verify db readings utilizing PCB Piezotronics Model 377C10.
None.
9 Regarding the requirement that the manufacturer shall certify that the provided suppressor shall not decrease the accuracy capabilities of the host rifle over the lifecycle of the suppressor, would the customer consider a percentage value? Currently as it is written if the group unsuppressed was 3.5 MOA and with a suppressor the group was
3.55 MOA, the suppressor would fail to meet
the requirement. This does not take into consideration the barrel life wear as well.
The government maintains this requirement. If a rifle is shot unsuppressed and groups at 3.5” and suppressor is installed and an additional group is fired, that max group size shall be less than or equal to 3.5”.
None.
10 Regarding the mini suppressor length requirements of 4 inches (+/-1 inch), will the Government amend this requirement to be 4 inches (+/-1 inch) of added overall length to host weapon system when mounted on the muzzle device? This will give a more accurate determination of how the suppressor impacts the systems overall length.
The government maintains the requirement with the Mini suppressor length of 4” (+/-1 inch).
None.
11 There is a discrepancy between the acquisition threshold of this opportunity. The
In general, FAR 13 applies to procurements up to the Simplified Acquisition Threshold (SAT) of
None.
RFQ details, as well as PG. 2 of the Solicitation/Contract/Order for Commercial Products and Commercial Services, states this RFQ is authorized by FAR subpart 13.5, which has a minimum spend of $250,000.
However, under Section I “Schedules” of the Solicitation/Contract/Order for Commercial Products and Commercial Services it is stated that this RFQ is authorized by FAR subpart 52.215-22(b), or a minimum spend of $5,000. Please advise which of these options is the true threshold of this RFQ.
$250,000.00. However, FAR Part 13.5 authorizes agencies to follow the Simplified Acquisition Procedures under FAR Part 13 for actions with an estimated value up to $7,500,000.00 for commercial items. Therefore, CBP is competing this requirement utilizing Simplified Acquisition Procedures found in FAR 13, as the total contract ceiling of the resultant Indefinite Delivery, Indefinite Quantity (IDIQ) contract is $7,400,000.00. As a separate matter, FAR 16 requires that for IDIQ contracts, a minimum contract value must be established.
Appropriation law and general contracting practice requires that the minimum threshold be met through an initial order awarded at time of contract award. Therefore, the initial order issued at time of contract award will be at least $5,000.00.
12 In the SOW, under Section 4.11 “Shipping”, the Contractor is required to shipping to the CONUS, Alaska, Hawaii, Guam, US Virgin Islands, and Puerto Rico all FOB Destination.
While CONUS orders can be delivered under FOB Destination terms, the Government will need to be responsible for any and all freight charges. In addition, any order received outside of the CONUS will need to follow FCA or EXW (Incoterms 2010) in order to align with our firm’s policy and procedure. The Government will need to be responsible for any and all freight charges for such deliveries, as well.
Per Section I.2, prices shall be inclusive of all shipping and handling charges.
13 Under Section 4.5 “Performance Requirements” of the SOW: 4.5.4.1 – There is no current test data on the requested 11.5 Mini2 SOCOM as this is not, generally, a recommend combination. Please confirm that this specific test is required to conduct.
The government will be conducting testing of Section 4.5.4.1 post down select on all suppressors (one SOCOM test cycle).
None.
14 Under Section 4.7 “Quality Assurance and Standards” of the SOW: While our firm is ISO
The government can omit Section 4.7.5 as it is above the scope of this contract.
Section 4.7.5 has been removed from the SOW.
9001 certified, and can provide such documentation as requested anytime throughout the contract period, we believe the requirements in 4.7.2, 4.7.5 to be onerous and out of general scope of such a requirement. We ask that these requirements be deleted. Under Section 4.7.9, we believe this quality assurance process to be not sufficiently defined. For example, what would be the extent of testing performed by such Government owned facility of independent NIJ laboratory? Our firm would need additional information on the extent of such testing, prior to agreeing to such requirements.
Section 4.7.2 remains- Government QA testing would be completed to verify future deliveries meet the standard of the initial contract performance requirements.
Example for Section 4.7.9: If the vendor submitted signed performance data, ie. Decibel reading at left ear at 135 db, the government test a new suppressor and it reads 150 db.
15 Regarding Section 4.9 “Government Access of Contractor’s Facility”, Section 4.9.3.
requires a minimum advance of inspection of three business days. This is unreasonable and generally unenforceable. We would request the standard thirty (30) days heads-up of any incoming inspection so that we may prepare our personnel accordingly and ensure that they have availability for the Government on the days which they plan to visit. Additionally, unlike requested in Section 4.9.4, the inspection may only take place in those areas of our firm instrumental to this contract. The Government will not be made available to all aspects as requested.
The three (3) day inspection notice will remain.
The Government intends to coordinate access to the facility with the vendor to ensure all parties are prepared for the visit.
Inspection shall only take place in areas associated with the contract.
None.
16 Without a minimum order quantity and/or clarification as to the financial threshold of this opportunity, we are unable to confirm our firm’s extent of ability to conform with those requirements as listed under Sections
4.10 “Packing and Identification”, 4.11 “Shipping” and 4.12 “Production Capacity”.
Once we receive information on the financial threshold, we may advise which of these requirements we can agree to.
As established in Section I.2 of the RFQ, the guaranteed contract minimum (to be issued via a delivery order at time of IDIQ contract award) is $5,000.00. The contract maximum is $7,400,000.00. Once the government meets its contract minimum, the awardee is not guaranteed any additional orders.
17 Sections 4.13 “Contractor Performance Conference”, 4.14 “Contractor Reports” of the Statement of Work place a significant burden on the Contractor, that is generally out of scope of other Government Contracts our firm participates in. We would ask that those requirements in Sections 4.13 “Contractor Performance Conference”, 4.14 “Contractor Reports” of the Statement of Work be removed.
CBP will remove 4.14.2 Quality Control Reports.
Subsections 4.14.3 and 4.14.4 remain.
Regarding Section 4.14, subsection 4.14.2 Quality Control Reports has been deleted from the SOW.
Section 4.14.3 Warranty Reports and Section
4.14.4 Delivery Order Reports remain a
requirement.
Corrections have been made to Section 4.14.4 Delivery Order Reports to denote suppressors and not rounds.
18 On the U.S. CBP LESC Rifle Suppressor SOW (70B06C24Q00000179) technical requirements in section 4.1.3 states that the contractor must supply two lengths of suppressors (standard & mini). Will this contract be purchasing both sizes, or evaluating one or the other? Would it still be accepted and reviewed if we only submitted a suppressor to meet the Mini specifications or do we have to submit one for both sizes in order to be considered?
Per RFQ 70B06C24Q00000179 Section III.1, middle of Pg. 23, “Quoters shall not submit partial quotes. Quotes shall include all items, otherwise, the quote will be rejected.”
