INSTRUCTIONS TO PREPARE OFFERS

This solicitation does not commit the Government to pay any cost incurred in the submission of the proposal or in making necessary studies or designs for the preparation thereof, nor to contract for services or supplies.

ADDENDUM TO 52.212-1 - INSTRUCTIONS TO OFFERORS COMMERCIAL ITEMS

CBP intends to conduct the procurement via two-phase mandatory down-select process, as follows:

After the Government completes evaluation of the Phase 1 Factors, Offerors will be told via email from the Contracting Officer whether they are among the most highly rated and may proceed to the next Phase. This is a mandatory down-select and Offerors that are not among the most highly rated shall not move forward to the next Phase. The Government will select approximately 5 applications, at its sole discretion, to proceed to Phase 2. Offerors who are not included in Phase 2 may request a debrief from the Contracting Officer. For those Offerors that are rated most highly and told that they may proceed to Phase 2 of the proposal submission process, the Contracting Officer will include the Phase 2 submission instructions in the notification. The Government recommends Offerors not begin preparation of Phase 2 proposals until after receipt of the Phase 1 down-select notice. The Phases that will be followed are as follows:

Phase 1 (proposals due August 29th, 2023 at 5Pm EST): Offerors’ Prior Experience and Price (Affordability), Technical Capability, and

Phase 2 (due date TBD): Demonstration of the Offerors’ technology application, Past Performance, and Price (Fairness and Reasonableness). The Government will select approximately 5 applications, at its sole discretion, for use in a demonstration.

Offeror’s proposals must be prepared and submitted in accordance with and in compliance with instructions of the solicitation. The evaluation factors are located in the provision entitled EVALUATION CRITERIA. Each factor will be evaluated individually. Proposals will be fairly considered in accordance with the evaluation criteria and the Government may make an award without discussions. The contract will be awarded to the Offeror that has been determined to have submitted a proposal which offers the best value to the Government, considering (in descending order of importance) their Demonstrations, Technical Capability, Prior Experience, their Past Performance through responses from the Past Performance Questionnaire (PPQ), and their proposal Pricing for performing all services.

Each Offeror’s proposal submitted in response to this solicitation shall be prepared in two (2) volumes as delineated below. Each of the volumes and parts shall be separate and complete so that evaluation of one may be accomplished independently from evaluation of the other. Proposal submissions shall consist of a Written Response for Phase 1 and a Limited User Evaluation tutorial/training session (1-hour training on the App will be scheduled virtually) for Phase 2. Offerors shall submit their written proposal as summarized below.

To be eligible for award, Offerors must provide a written proposal consisting of the following: Offerors shall use the Statement of Objectives (SOO), together with other applicable portions of this solicitation, as the basis for preparing their proposal, including the Contractor's Performance Work Statement. The offeror shall ensure all aspects of the SOO are addressed. The PWS shall specify in clear, understandable terms the work to be done in developing or producing the services to be performed by the contractor to include performance measures to achieve the Government’s objectives. The offeror’s response shall not simply restate the Government’s objectives. A PWS outline and Example is provided for reference as an attachment to this solicitation.

Offers must be prepared in accordance with these instructions and provide all required information in the format specified. The Offeror is responsible for including sufficient details to permit a complete and accurate evaluation of the proposal. The required format is designed to ensure submission of information essential to the understanding and comprehensive evaluation of the Offeror’s proposal. Pages in excess of the maximum will be removed from the end of the proposal volume by the Contracting Officer without being evaluated.

No classified information shall be included in the Offeror’s written proposal. Proprietary information shall be clearly marked.

The proposal shall be clearly indexed and logically assembled. Each volume shall be clearly identified and shall begin at the top of a page. All pages of each volume shall be appropriately numbered and identified by the complete company name, date and solicitation number in the header and/or footer. Each volume of the proposal shall consist of a Table of Contents. The Table of Contents, indices, page separators, and glossaries will not count against page limitations set forth below:

MS Word files shall use the following page setup parameters:

Margins – Top, Bottom, Left, Right - 1” Gutter – 0” From Edge – Header, Footer - 0.5” Page Size, Width – 8.5” Page Size, Height – 11” The following additional restrictions apply:

Each paragraph shall be separated by at least one blank line. A standard, 12-point minimum font size applies. Arial or New Times Roman fonts are required. Spacing shall be single-spaced. Tables and illustrations may use a reduced font size not less than 9-point and may be landscape. All written technical proposal submissions will be limited to a maximum of 20 pages of content. If printing single sided, there should be 20 total physical pages. If printing double sided, there should be 10 total physical pages.

Proposals must be clear, coherent, and prepared in sufficient detail for effective evaluation. Proposals must include convincing rationale and substantiation of all claims. Offerors shall assume that the Government has no prior knowledge of their experience and will base its evaluation on the information presented in the Offeror’s proposal.

Minimum proposal Acceptance Period. The Government requires a minimum acceptance period of at least 90 calendar days from the proposal due date. A proposal allowing less than the Government’s minimum acceptance period may be rejected.

Important note regarding email attachments: CBP’s email system limits incoming email attachments to 10MB per email. Contractors should NOT submit .zip files as these may be stripped by CBP’s email system. All incoming files are scanned so there may be a delay between the time the file is submitted and the time it is received.

Therefore, Contractors must ensure they submit Quotations with sufficient time to reach the required destination no later than the response due date identified above.

Contractors are strongly encouraged to verify receipt of their response (via email) as noted above. Contractors may submit attachments in multiple emails due to size constraints; however, the complete Quotation (including all required submissions) must be received by the due date and time identified above. The Government will NOT contact Contractors to request status of their quote. The Contractor shall be responsible for ensuring that the entirety of their quotation is submitted and received on time.

NOTE: Contractors are instructed to numerically identify their email submittals to include both the attachment number AND the total number of attachments so that the Government may clearly see how many emails or attachments are being submitted (FOR EXAMPLE: 1 of 3; 2 of 3, 3 of 3).

ADDITIONAL INFORMATION:

The Technical Proposal shall be prepared in such a manner as to enable the Government reviewers to make a thorough evaluation and arrive at a sound determination of whether the Proposal meets all technical requirements of the solicitation. To this end, the Technical Proposal should be sufficiently specific, detailed, and complete to clearly and fully demonstrate that the Offeror has a thorough understanding of the requirements set forth in the solicitation. Proposals which only offer to perform in accordance with the Government's requirements or which merely paraphrase the requirements document, or use phrases such as, "standard engineering practices will be employed," or "well established techniques will be employed," etc. may be considered non-compliant and ineligible for award. The Contractor must submit an explanation of its proposed technical approach in conjunction with the tasks to be performed in achieving the SOO deliverables.

The Government intends to award a contract without further communicating with offerors. Consequently, offerors are highly encouraged to propose their best technical and pricing quotes in their initial submissions. However, the Government reserves the right to communicate with any or all offerors submitting a technical and price proposal, if it is determined advantageous to the Government to do so. This statement is not to be construed to mean that the Government is obligated to communicate with every offeror submitting a proposal. An offeror may be eliminated from consideration without further communication if its technical and/or pricing proposal is not among those offerors considered most advantageous to the Government based on a best value determination.

The Government anticipates awarding a single IDIQ contract, in accordance with the Evaluation Criteria in the Solicitation, to the Offeror whose proposal has been determined to represent the best value to the Government. The Government may award any resulting contract to other than the lowest priced Offeror, or other than the Offeror with the highest non-price rating. The Government may award without discussions.
