About this file

This is a Questions and Answers document clarifying requirements for a federal procurement of off-road motorcycles.

The solicitation involves a 100% small business set-aside for 20 off-road motorcycles to be delivered to the Tucson Sector Garage (2430 S. Swan Rd., Tucson, AZ 85711). Key clarifications include: (1) quoted motorcycles must meet or exceed all applicable specifications in the Statement of Work with no tolerance for deviations; (2) authorized dealers and resellers are eligible for award under a Class waiver for NAICS 336999, meaning the nonmanufacturer rule does not apply; (3) only the manufacturer's standard warranty is required; (4) a Manufacturer's Statement of Origin (MSO) is required for titling, though units do not need to be street-legal as they will be used exclusively off-road; (5) the Tucson Sector Garage is the mandatory single delivery point for all 20 units regardless of contractor location; and (6) pre-delivery inspection (PDI) certification must be provided at the time of delivery, not with the initial quote.

Questions and Answers

1. "Equivalent" standard: What specific criteria or tolerances will the Technical Evaluator use to judge whether a non-Husqvarna model qualifies as "equivalent" to the Husqvarna 300 TE? Would any deviation from the listed specs (e.g., wheelbase, ground clearance, suspension travel) be an automatic fail, or is there an acceptable tolerance range? – The quoted Off-Road Motorcycle shall meet or exceed all applicable specifications listed in the Statement of Work to be considered technically acceptable.

2. Nonmanufacturer rule/dealer eligibility: Because NAICS 336999 is a manufacturing code and this is a 100% small business set-aside, does the SBA nonmanufacturer rule apply to this acquisition, or has a waiver been granted? Please confirm whether an authorized dealer/reseller (rather than the OEM/manufacturer itself) is eligible for award, and whether the awarded product must be the product of a small business manufacturer. – Yes, an authorized dealer/reseller is eligible for award. There is a Class waiver for NAICS 336999.

3. Warranty: The SOW does not specify a required warranty period or terms. What warranty coverage (parts, labor, duration) is the Government expecting on the delivered motorcycles? Only the manufactured specified warranty for the unit is required

4. Titling/registration: Will the Government require a Manufacturer's Statement of Origin (MSO) or certificate of origin for titling, and do the units need to be street-legal/OHV-registered, or will they be used off-highway exclusively? An MSO is required. The units do not need to be street legal; they will be off-road vehicles only.

5. Delivery flexibility: Section 6 of the SOW notes that "delivery options may be flexible if the contractor's business is located within Tucson, Arizona." For a quoter located outside Tucson, please confirm the Tucson Sector Garage (2430 S. Swan Rd., Tucson, AZ 85711) is the single required delivery point for all 20 units. Yes, the Tucson Sector address shall be the only delivery point.

6. Testing/certification evidence: SOW Section 4.2 requires the contractor to test and certify equipment before delivery. Should evidence of this testing/certification process be included with the technical quote, or is it only required at the time of delivery? At the time of delivery. This is to show that a pre-delivery inspection (PDI) was done and the unit is ready for use.
