Swanton Sector Statement of Work

For Jail Space

June 18, 2025

1.0 BACKGROUND

As a component of DHS, US Customs and Border Protection (CBP) is responsible for protecting our Nation’s borders in order to prevent terrorists and terrorist weapons from entering the United States, while facilitating the flow of legitimate trade and travel. CBP is also responsible for apprehending individuals attempting to enter the U.S. illegally; stemming the flow of drugs and other contraband; protecting our agricultural and economic interests from harmful pests and diseases; protecting American business from theft of their intellectual property; and regulating and facilitating international trade, collecting import duties, and enforcing U.S. trade laws.

The U.S. Border Patrol (USBP) Swanton (SWB) Sector requires jail space to properly detain illegal subjects awaiting deportation proceedings, held as material witnesses or charged with or convicted of Federal law violations. The nature of this requirement is variable in scope due to its dependency on actual daily apprehensions.

2.0 SCOPE OF WORK

USBP SWB seeks to obtain a multiple award blanket purchase agreement (BPA) for jail space that will cover Vermont and Northern New York. Vendors have been identified to provide services in the following locations: Albany County, NY; Clinton County, NY; Franklin County, NY; Montgomery County, NY; Rensselaer County, NY; Schenectady County, NY; Coos County, NH, Vermont and are approved to house federal detainees by the U.S. Marshals Service as established under Detention Services Intergovernmental Agreements (IGA) No: 82-11-0021 A scope estimate has been made using historical data. Estimated detainees held yearly, averages to 686, combined from Vermont and Northern New York.

2.1 Period Of Performance

Five Service Years

Service Year 1: Date of Award – 07/31/2026 Service Year 2: 08/01/2026 – 07/31/2027 Service Year 3: 08/01/2027 – 07/31/2028 Service Year 4: 08/01/2028 – 07/31/2029 Service Year 5: 08/01/2029 – 07/31/2030

2.2 Place of Performance

SWB Jail Space

Detainees will be transferred by United States Border Patrol to any of the (Albany County, NY; Clinton County, NY; Franklin County, NY; Montgomery County, NY; Rensselaer County, NY; Schenectady County, NY; Coos County, NH and Vermont Department of Corrections, VT) detention center from the following SWB Sector stations:

4.0 DESCRIPTION OF TASKS AND DELIVERABLES

4.1 Specific Requirements Associated with the Task.

4.1.1 Contractor shall accept and provide for the secure custody, care and safekeeping of federal detainees in accordance with state, local laws, standards, policies, procedures or court orders

4.1.2 Contractor shall meet the minimum standard requirements of the U.S.

Marshals Service applicable to the operations of facilities

4.1.3 Contractor shall house Federal detainees within the confines of each facility at a level appropriate for detainees considered a risk of flight, a danger to the community, or wanted by other jurisdictions

4.1.4 Contractor shall provide for the housing, safekeeping and subsistence of adult male and female federal detainees

4.1.5 Contractor shall provide food services: serve three nutritionally balanced meals daily, accommodating religious and medical dietary needs.

4.1.6 Contractor shall, at all times, allow the agency access to the facility and to the federal detainees housed there, and to any records pertaining to this agreement, including financial records, for a period going back three (3) years from the date of request by the agency.

4.1.7 Contractor shall provide federal detainees with the full range of medical care inside the detention facility. The level of care inside the facility should be the same as that provided to state and local detainees. The contractor is financially responsible for all medical care provided inside the facility to federal detainees. This will cover the medical provider interactions (physical/sick calls, etc.) nurse interactions (medical intake, sick calls, etc.) and over the counter medications only.

4.1.8 Costs of medical care at a medical facility is the responsibility of the federal government.

4.1.9 The contractor shall notify the Agency of any activity by a federal detainee which would likely result in litigation or alleged criminal activity.

4.1.10 The contractor shall immediately notify the Agency of an escape of a federal detainee. The contractor shall use all reasonable means to apprehend the escaped federal detainee and all reasonable costs in connection therewith shall be the responsibility of the contractor.

4.1.11 Contractor shall comply with the CBP Prison Rape Elimination Act (PREA) (Oct 2014)

4.2 The Contractor shall

4.2.1 Bill the federal government for the day of arrival but not for the day of departure, from arrest to arraignment.

4.2.2 Bill the federal government at the per diem rate established by the MOU and is adjusted annually.

4.2.3 Provide complete “Trip Tickets” for each inmate that payment is being billed for

4.2.4 Ensure that “Name of Contractor” as listed on Optional Form 347 is on all invoices

4.2.5 Provide a Point of Contact for billing information questions

5.0 GENERAL INFORMATION

5.1 Disclosure of Information

5.1.1 Any information made available to the contractor by the government, or its customers shall be used only for the purpose of carrying out the provisions of this contract. This information shall not be divulged or made known in any manner to any person except as may be necessary in the performance of the contract.

5.1.2 In the performance of this contract, the contractor assumes responsibility for the protection of the confidentiality of government records.

5.1.3 If applicable, the contractor will adhere to the requirements found in Part 24 of the Federal Acquisition Regulation, Protection of Privacy and Freedom of Information.

Note: The Contracting Officer (CO) is the only person authorized to make or approve any changes to any of the requirements of this contract.

In the event the Contractor makes any changes at the direction of any other person other than the CO, the change shall be considered to have been made without authority and the Contractor performs at its own risk.

All questions concerning this contract shall be directed to the Contracting Officer.

6.0 Government Furnished Property

6.1 No Government Furnished property will be provided.
